Dear Sir,

Further to the issue of the Engineer’s instruction regarding the clarification of the
ambiguity that existed between the detail shown on the drawing, reference XXXXX
and the detail reflected through the Specification, page XX item XX, we confirm that
this is not consistent with the hierarchy of documents that form part of the Contract
documentation, clause 1.6 and as such constitutes a variation as per clause 20.1 in the
Conditions of Contract.

Once the full ramification has been established we shall provide a fully detailed claim
and trust that the Engineer will approve the time and cost entitlement.
