Subject: NOTICE TO TERMINATE CONTRACT

Dear Mr. Yo:

This refers to your contract (Proposed Construction of a 4-Classroom, 2-Storey School

Building (Phase 1)) in the amount P 4,642,622.70. Please be informed that as of June 17,
2019, you have an actual accomplishment of 35.765% versus the planned accomplishment
of 100%, thus, you have incurred a negative slippage of (-) 64.245% due to your fault
caused by insufficient resources and manpower productivity resulting to a very poor
workmanship and time delays.

Pursuant to the rules and regulations set by the Government Procurement Policy Board
(GPBB) and in pursuance to (a) of section 1.0 Item IV of Annex I “Guidelines on
Termination of Contracts” of the 2016 Revised Implementing Rules and Regulations (IRR)
of RA 9184, otherwise known as the “Government Procurement Reform Act, and (b) DPWH
Department Order No. 16, series of 2016 – Administrative Action on Contract with Negative
Slippage, the implementing agency ( Local Government Unit of Argao) shall initiate the
termination of contract.

In view hereof, you are hereby directed to “show cause” within seven (7) calendar days
from receipt hereof why your contract shout not be terminated, pursuant to section IV. 3
Annex I of the 2016 Revised Implementing Rules and Regulations (IRR) of RA 9184.

Your immediate compliance on this matter is hereby sought.
