CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT TO SELL is executed and entered by and between

_________________,of lgeal age, Filipino, married and a resident of


_________________ Philippines; hereinafter referred to as the SELLER;

___________________of legal age, Filipino, single/married and a resident


of________________________Philippines, hereinafter referred to as the BUYER;

WITNESSES THAT

WHEREAS the SELLER is the ATTY-IN-FACT of a parcel of land with an area of


___________________ ( ) square meters, more or less, covered by TCT No. ________,
located at __________________________, Philippines.

THAT the SELLER has offered to sell over a portion of ___________________


( )square meters, more or less______, of the aboved- mentioned parcel of land to the
BUYER known as lot no.____block no.____survey no._____and the BUYER has agreed
to buy the same subject to terms and conditions hereinbelow specified:

NOW THEREFORE, for and in consideration of the sum of ___________________


PESOS, Philippines Currency, and the covenants hereinafter set forth the SELLER
agrees to sell and the BUYER agrees to buy the aforesaid property subject to the
following terms and conditions:

1. ____________ as straight monthly payment shall be paid upon signing and execution
of this contract this month of ___________.
2. That the balance of _________ shall be paid on the Bank Account of __________
with_____________________ payable in _________ equal monthly installment of
________ starting month of ______2021.
3. That after full payment, the SELLER shall execute DEED of Absolute Sale in favor to
the BUYER;
4. Should the BUYER fail to pay to the SELLER in three (3) consecutive months thereon
shall cause the contract to be automatically cancelled in which case aforementioned
down payment shall be deemed forfeited in favor of the SELLER.
5. That the Notarial Fees and Survey shall be borne for the account of the SELLER.
6. All Taxes but not limited to Capital Gain Tax, Documentary Stamp Tax, Transfer Fee,
and other expenses incident to the transfer of title shall be for the account of the BUYER.
7. That the SELLER and the BUYER agreed that after the BUYER had paid 90% of the
agreed total price of the lot as stipulated in this Contract, the BUYER can put up
structure or any improvements thereon.
8. The BUYER shall not and cannot assign or transfer his or her rights and interest to
any third party while full payment of the agreed total price of the lot has not yet been
made or paid by the BUYER except upon the consent of the SELLER.
9. In case of death or events which may make the BUYER incapable to continue
payment while this CONTRACT to SELL is still effective, the BUYER’s successors-in-
interest can continue the payment provided the 3-month period of amortization has not
yet lapsed as stipulated in this contract.

That both parties agreed to the aboved-stated agreements.

NOTARIAL AKNOWLEDGEMENT

they are the same pesons who executed the foregoing instrument and that the same are
their voluntary act and deed.
