‫)‪ (٤‬ﻳﺠﺐ ﺍﻻﻟﺘﺰﺍﻡ ﺑﻤﺎ ﻫﻮ ﻭﺍﺭﺩ ﻣﻦ ﻣﻮﺍﺩ ﺑﺎﻷﻣﺮ ﺍﻟﻤﺤﻠﻰ ﺭﻗﻢ ‪ ٩٢ / ٢٣‬ﻓﻲ ﺷﺄﻥ ﺗﻨﻈﻴﻢ ﺍﻟﻤﺒﺎﻧﻲ ﺑﻤﺴﻘﻂ‪ ,‬ﻭﺑﺼﻔﺔ ﺧﺎﺻﺔ ﺍﻟﻤﻮﺍﺩ ﺍﻷﺗﻲ ﺫﻛﺮﻫﺎ‪:‬‬

‫ﺍﻟﻤﺎﺩﺓ ) ‪ : ( ١٠٢‬ﻳﻌﻤﻞ ﺑﺈﺑﺎﺣﺔ ﺍﻟﺒﻨﺎﺀ ﻟﻤﺪﺓ ﻋﺎﻣﻴﻦ ﻣﻦ ﺗﺎﺭﻳﺦ ﺻﺪﻭﺭﻫﺎ ﻭﻳﻨﺘﻬﻲ ﻣﻔﻌﻮﻟﻬﺎ ﺇﺫﺍ ﻟﻢ ﺗﺠﺪﺩ ) ﻣﻦ ﺍﻟﺠﻬﺔ ﺍﻟﻤﺨﺘﺼﺔ ( ﻭﻳﻜﻮﻥ ﺍﻟﺘﺠﺪﻳﺪ ﻟﻔﺘﺮﺓ ﻣﻤﺎﺛﻠﺔ ﺑﻌﺪ ﻋﺎﻣﻴﻦ ﺑﻌﺪ ﺩﻓﻊ ﺍﻟﺮﺳﻮﻡ ﺍﻟﻤﻘﺮﺭ‪ ,‬ﺇﻻ ﺇﺫﺍ ﻛﺎﻥ ﻫﻨﺎﻟﻚ ﻣﻦ ﺍﻷﺳﺒﺎﺏ ﻣﺎ ﻳﻤﻨﻊ‬

‫ﺍﻟﻤﺎﺩﺓ) ‪ : (١٠٣‬ﻻ ﻳﺴﻤﺢ ﺑﺈﺟﺮﺍﺀ ﺃﻱ ﺗﻌﺪﻳﻞ ﻋﻠﻰ ﺍﻹﺑﺎﺣﺔ ﺍﻟﻤﺼﺪﻗﺔ ﺃﻭ ﻋﻠﻰ ﺍﻟﺮﺳﻮﻣﺎﺕ ﺍﻟﻤﻌﺘﻤﺪﺓ ﺃﻭ ﺃﻱ ﻣﺴﺘﻨﺪ ﺭﺳﻤﻲ ﺇﻻ ﺑﻌﺪ ﺍﻟﺤﺼﻮﻝ ﻋﻠﻰ ﺍﻟﻤﻮﺍﻓﻘﺔ ﺍﻟﻤﺴﺒﻘﺔ ﺑﺬﻟﻚ ﻣﻦ ﺍﻹﺩﺍﺭﺓ ﺍﻟﻤﺨﺘﺼﺔ ‪ ,‬ﻛﻤﺎ ﻻ ﻳﻌﺘﻤﺪ ﺫﻟﻚ ﺍﻟﺘﻌﺪﻳﻞ ﺇﻻ ﺇﺫﺍ ﻛﺎﻥ ﻣﺼﺪﻗﺎ‬

‫ﺑﻮﺍﺳﻄﺔ ﺍﻷﻃﺮﺍﻑ ﺍﻟﺜﻼﺛﺔ‪ ,‬ﻛﻤﺎ ﻳﺘﻮﺟﺐ ﻋﻠﻰ ﺍﻟﻤﺎﻟﻚ ﺃﻭ ﻭﻛﻴﻠﺔ ﺍﻟﻤﺤﺎﻓﻈﺔ ﻋﻠﻰ ﻫﺬﻩ ﺍﻟﻌﻼﺋﻢ ﻓﻲ ﻣﻮﺍﻗﻌﻬﺎ ﻇﺎﻫﺮﺓ ﺩﻭﻥ ﺃﻱ ﻋﻮﺍﺋﻖ ﺣﺘﻰ ﺍﻛﺘﻤﺎﻝ ﺍﻟﺒﻨﺎﺀ ﻭﺍﻟﺘﻘﻴﺪ ﺑﻬﺎ ﺗﻘﻴﺪﺍ ﺗﺎﻣﺎ ﺧﻼﻝ ﻋﻤﻠﻴﺔ ﺍﻟﺘﻨﻔﻴﺬ‪.‬‬
‫ﺏ‪ -‬ﻳﺸﺘﺮﻁ ﻗﺒﻞ ﺍﻟﺸﺮﻭﻉ ﻓﻲ ﺃﻱ ﺑﻨﺎﺀ ﻋﻤﻞ ﺳﻴﺎﺝ ﻋﻠﻰ ﺣﺪﻭﺩ ﺍﻟﻘﻄﻌﺔ ﺍﻟﻤﺮﺍﺩ ﺇﻗﺎﻣﺔ ﺍﻟﺒﻨﺎﺀ ﻋﻠﻴﻬﺎ ﻭﺫﻟﻚ ﻭﻓﻘﺎ ﻟﻠﺸﺮﻭﻁ ﻭﺍﻟﻤﻮﺍﺻﻔﺎﺕ ﺍﻟﺘﻲ ﺗﺤﺪﺩﻫﺎ ﺍﻟﺒﻠﺪﻳﺔ ﻭﺍﻟﻤﻮﺿﺤﺔ ﻣﻦ ﺍﻹﺑﺎﺣﺔ‪.‬‬
‫ﺝ‪ -‬ﻳﺠﺐ ﻋﻠﻰ ﺍﻟﻤﺎﻟﻚ ﺃﻭ ﺍﻟﻤﻘﺎﻭﻝ ﻋﻤﻞ ﺩﻭﺭﺓ ﻣﻴﺎﻩ ﻣﺆﻗﺘﺔ ﻟﻠﻌﻤﺎﻝ ﺩﺍﺧﻞ ﺣﺪﻭﺩ ﺍﻟﻘﻄﻌﺔ ﺑﻐﺮﺽ ﺍﺳﺘﻌﻤﺎﻟﻬﺎ ﺃﺛﻨﺎﺀ ﻓﺘﺮﺓ ﺗﻨﻔﻴﺬ ﺍﻟﻤﺒﻨﻰ ﻭﻓﻘﺎ ﻟﻠﺸﺮﻭﻁ ﺍﻟﻤﻌﺪﺓ ﻟﺬﻟﻚ ﻣﻦ ﺍﻟﺒﻠﺪﻳﺔ‪.‬‬
‫ﺩ‪ -‬ﻻ ﻳﺠﻮﺯ ﺍﻟﺸﺮﻭﻉ ﺑﺈﻗﺎﻣﺔ ﺃﻱ ﻣﻜﺎﺗﺐ ﺃﻭ ﻭﺭﺵ ﻣﺆﻗﺘﺔ ﺑﻤﻮﻗﻊ ﺍﻟﻌﻤﻞ ﺇﻻ ﺑﻌﺪ ﺍﻟﺤﺼﻮﻝ ﻋﻠﻰ ﺍﻟﻤﻮﺍﻓﻘﺔ ﺍﻟﻤﺴﺒﻘﺔ ﺑﺬﻟﻚ ﻣﻦ ﺍﻟﺒﻠﺪﻳﺔ ﻣﻊ ﺩﻓﻊ ﺍﻟﺮﺳﻮﻡ ﻭﺍﻟﺘﺄﻣﻴﻦ ﺍﻟﻤﻘﺮﺭ‬

‫ﺍﻟﻤﺎﺩﺓ) ‪ : (١١٢‬ﻳﺠﺐ ﻋﻠﻰ ﺍﻟﻤﺎﻟﻚ ﺃﻭ ﺍﻟﻤﻘﺎﻭﻝ ﻭﺿﻊ ﻻﻓﺘﻪ ﺑﻤﻜﺎﻥ ﺍﻟﻌﻤﻞ ﺑﻤﻘﻴﺎﺱ ﻻ ﻳﻘﻞ ﻋﻦ ‪ ١٨٠× ٩٠‬ﺳﻢ ﻭﺗﺜﺒﻴﺘﻬﺎ ﻋﻠﻰ ﺍﺭﺗﻔﺎﻉ ‪ ٣‬ﻣﺘﺮ ﺃﻭ ﻋﻠﻰ ﺍﻟﺴﻴﺎﺝ ﻣﻦ ﺍﻟﺨﺎﺭﺝ ‪ .‬ﻭﻳﻜﺘﺐ ﻋﻠﻴﻬﺎ ﺑﺤﺮﻭﻑ ﻭﺍﺿﺤﺔ ﻛﺎﻷﺗﻲ ‪:‬‬
‫* ﺭﻗﻢ ﺍﻟﻘﻄﻌﺔ ﻭﺍﻟﻤﺮﺑﻊ ﻭﺍﻟﻤﻨﻄﻘﺔ ) ﺍﻥ ﻭﺟﺪ (‬
‫* ﺭﻗﻢ ﺇﺑﺎﺣﺔ ﺍﻟﺒﻨﺎﺀ ‪.‬‬
‫* ﺍﺳﻢ ﺍﻟﻤﻘﺎﻭﻝ ﺃﻭ ﺍﻟﺸﺮﻛﺔ ﺍﻟﺘﻲ ﺗﻨﻔﺬ ﺍﻟﻌﻤﻞ ﻭﻋﻨﻮﺍﻧﻬﺎ‪.‬‬

‫ﺍﻟﻤﺎﺩﺓ)‪ : (١١٣‬ﻳﺠﺐ ﻋﻠﻰ ﺍﻟﻤﺎﻟﻚ ﺃﻭ ﺍﻟﻤﻘﺎﻭﻝ ﺃﻥ ﻳﻮﺩﻉ ﺟﻤﻴﻊ ﻣﻮﺍﺩ ﺍﻟﺒﻨﺎﺀ ﻭﺍﻷﻧﻘﺎﺽ ﻭﻓﻀﻼﺕ ﺍﻟﺒﻨﺎﺀ ﺩﺍﺧﻞ ﺍﻟﺴﻴﺎﺝ ‪ ,‬ﻭﺃﻥ ﻳﻌﻤﻞ ﻋﻠﻰ ﻧﻘﻞ ﺍﻟﻔﻀﻼﺕ ﻭﺍﻷﻧﻘﺎﺽ ﻣﻦ ﺍﻟﻤﻮﻗﻊ ﺃﻭﻻ ﺑﺄﻭﻝ ‪.‬‬
‫ﺍﻟﻤﺎﺩﺓ) ‪ : : (١١٤‬ﻋﻠﻰ ﺍﻟﻤﺎﻟﻚ ﺃﻭ ﻭﻛﻴﻠﺔ ﺃﻥ ﻳﻄﻠﺐ ﻣﻦ ﺍﻟﺒﻠﺪﻳﺔ ﺍﻟﻤﺨﺘﺼﺔ ﺍﻟﻜﺸﻒ ﻋﻠﻰ ﻣﺸﺮﻭﻉ ﺃﻱ ﻣﺒﻨﻰ ) ﻻ ﻳﺸﺮﻑ ﻋﻠﻰ ﺗﻨﻔﻴﺬﻩ ﺍﺳﺘﺸﺎﺭﻱ ( ﻋﻨﺪ ﺍﻻﻧﺘﻬﺎﺀ ﻣﻦ ﺣﻔﺮ ﺍﻷﺳﺎﺳﺎﺕ ﻭﺍﻟﻘﻮﺍﻋﺪ‪ ,‬ﻭﻟﻠﺘﺄﻛﺪ ﻣﻦ ﻣﻄﺎﺑﻘﺔ ﺫﻟﻚ ﻟﻠﺨﺮﺍﺋﻂ ﺍﻟﻤﻌﺘﻤﺪﺓ ﻭﺍﺛﺒﺎﺕ‬
‫ﺫﺍﻟﻚ ﺑﺪﻓﺘﺮ ﺍﻹﺑﺎﺣﺔ ‪.‬‬
‫)‪ (٥‬ﻳﺘﻮﺟﺐ ﻋﻤﻞ ﺻﻨﺪﻭﻕ ﺧﺸﺒﻲ ﻟﺘﻐﻄﻴﺔ ﻣﺠﻤﻊ ﺍﻟﻜﻬﺮﺑﺎﺀ ﺑﺎﻟﺒﻨﺎﻳﺔ ﻭﻳﻜﻮﻥ ﻣﻘﻔﻮﻝ ﻣﻦ ﺟﻤﻴﻊ ﺍﻟﺠﻮﺍﻧﺐ ﻭﺑﻪ ﻗﻔﻞ ﻟﻠﺴﻼﻣﺔ ﺍﻟﻌﺎﻣﺔ ‪.‬‬
‫)‪ (٦‬ﻳﺘﻮﺟﺐ ﺗﻐﻄﻴﺔ ﻣﻜﻴﻔﺎﺕ ﺍﻟﻬﻮﺍﺀ ﻭﺧﺰﺍﻧﺎﺕ ﻣﻴﺎﻩ ﺍﻟﺸﺮﺏ ﺑﺴﻄﺢ ﺍﻟﺒﻨﺎﻳﺔ ﻭﻳﺸﺘﺮﻁ ﺍﻻﻟﺘﺰﺍﻡ ﺑﺎﻟﻨﻤﻮﺫﺝ ﺍﻟﻤﻌﺘﻤﺪ ﻣﻦ ﺇﺩﺍﺭﺓ ﺃﺑﺎﺣﺎﺕ ﺍﻟﺒﻨﺎﺀ ﺑﺎﻟﻤﺪﻳﺮﻳﺔ ﺍﻟﻌﺎﻣﺔ ﻟﻠﺸﺆﻭﻥ ﺍﻟﻔﻨﻴﺔ ﺃﻭ ﺗﻘﺪﻳﻢ ﻧﻤﻮﺫﺝ ﻭﺍﻟﺤﺼﻮﻝ ﻋﻠﻰ ﺍﻟﻤﻮﺍﻓﻘﺔ ﻋﻠﻴﻪ‪.‬‬
‫)‪ (٧‬ﺑﻨﺎﺀﺍ ﻋﻠﻰ ﺍﻷﻣﺮ ﺍﻟﻤﺤﻠﻲ ﺭﻗﻢ ‪ ٩٢/٢٣‬ﺑﺘﺎﺭﻳﺦ ‪١٩٩١/١٢/٥‬ﻡ ﻳﻤﻨﻊ ﺗﺮﺑﻴﺔ ﺍﻟﺤﻴﻮﺍﻧﺎﺕ ﺩﺍﺧﻞ ﺍﻟﻘﻄﻌﺔ‪.‬‬
‫)‪ (٨‬ﺍﻟﻨﻤﻞ ﺍﻷﺑﻴﺾ ﻣﻦ ﻣﻦ ﺍﻟﺤﺸﺮﺍﺕ ﺍﻟﻀﺎﺭﺓ ‪ ،‬ﻭﻳﺘﺴﺒﺐ ﻓﻲ ﺇﺗﻼﻑ ﺍﻟﻤﺒﺎﻧﻲ ﻭﺍﻷﺛﺎﺙ ﻭﻟﻠﻮﻗﺎﻳﺔ ﻣﻨﻪ ﻳﻔﻀﻞ ﺭﺵ ﻭﻣﻌﺎﻟﺠﺔ ﺍﻟﻤﻮﻗﻊ ﺑﺎﻟﻤﻮﺍﺩ ﺍﻟﻜﻴﻤﻴﺎﺋﻴﺔ ﺍﻟﻤﻨﺎﺳﺒﺔ ﻗﺒﻞ ﺍﻟﺸﺮﻭﻉ ﺑﺎﻟﺒﻨﺎﺀ‪.‬‬
