Unapologetic President

for inaction and promising to not


accept such a cynical status quo.

WASHINGTON -- President Barack


Obamas second inaugural address,
delivered on a crisp, overcast day at the
nations capital, was an unapologetic
one.

What makes us exceptional -- what


makes us American -- is our allegiance
to an idea, articulated in a declaration
made more than two centuries ago:
We hold these truths to be selfevident, that all men are created equal,
that they are endowed by their Creator
with certain unalienable rights, that
among these are Life, Liberty, and
the pursuit of Happiness. Today we
continue a never-ending journey, to
bridge the meaning of those words
with the realities of our time. For
history tells us that while these truths
may be self-evident, they have never
been self-executing.

The president, who has spent the first


four years navigating Washington as
much as shaping it, used his platform
on Monday to announce that his next
four years will be marked by a more
assertive approach. The speech wasnt
devoid of the classic, Obama-esque
ideal that the country itself, and the
two political parties in particular,
must come together for the common
good. But the appeal he made wasnt
so much to the good nature of each
individual lawmaker as it was to the
need to confront the severity of the
issues at hand.
The president talked about protecting
entitlement programs upon which the
elderly and the most vulnerable in
society depend.
They do not make us a nation of
takers, he declared, in a clear rebuke
to the conservative House Republicans
that have been his bte noire. They
free us to take the risks that make this
country great.
But Obama also gave a nod to items
further down on the conventional list
of top priorities: climate change and

election reform included.


The underlying theme was altogether
consistent: it is time for the countrys
reasonable majority to wrest back the
agenda.
For now decisions are upon us, and we
cannot afford delay. We cannot mistake
absolutism for principle, or substitute
spectacle for politics, or treat namecalling as reasoned debate. We must
act, knowing that our work will be
imperfect. We must act, knowing that
todays victories will be only partial,
and that it will be up to those who stand
here in four years, and forty years, and
four hundred years hence to advance
the timeless spirit once conferred to us
in a spare Philadelphia hall.
What the administration now
confronts is the issue of legacy. The
accomplishments of the first term

have given Obama an already exalted


status among his base. But inside
the White House, there is a tangible
sense of hope (and, perhaps, a bit of
trepidation) about whats to come.
Immigration reform, the ending of the
war in Afghanistan, the protection of
gay rights, the passage of gun laws, the
execution of health care and banking
reform, and the revamping of the tax
code and social safety net are all on the
docket. The means of addressing them
is the great unknown.
What Mondays speech did, more than
anything else, is provide a window
into those means. This isnt the same
Obama who, upon coming into office
amid an economic crisis, called for
an end to the politics of division. It
was a more jaded, ostensibly realistic
Obama, demanding that divided
politics no longer be used as an excuse

The presidents supporters and even


casual defenders will, undoubtedly,
cheer this second inaugural address
in a way that they never fully did the
first -- a lofty, historic but somewhat
unmemorable speech. His critics
will take it as affirmation of a liberal
agenda that theyve often warned is
coming once the burdens of reelection
are gone.
Those reactions are predictable and,
ultimately, disposable. What matters
more is the extent to which the president
acts upon the vision he outlined. The
second inaugural address showcased
an unapologetic president. Time will
tell if Monday was just a few lines in a
speech or a new, dedicated mindset for
the nations leader.

New Mexico Bill Would Criminalize Abortions After Rape As


Tampering With Evidence
A Republican lawmaker in New
Mexico introduced a bill on Wednesday
that would legally require victims of
rape to carry their pregnancies to term
in order to use the fetus as evidence
for a sexual assault trial.
House Bill 206, introduced by state
Rep. Cathrynn Brown (R), would
charge a rape victim who ended her
pregnancy with a third-degree felony
for "tampering with evidence."
Tampering with evidence shall
include procuring or facilitating an
abortion, or compelling or coercing
another to obtain an abortion, of a fetus
that is the result of criminal sexual

penetration or incest with the intent to


destroy evidence of the crime," the bill
says.
Third-degree felonies in New Mexico
carry a sentence of up to three years
in prison.
Pat Davis of ProgressNow New
Mexico, a progressive nonprofit
opposing the bill, called it "blatantly
unconstitutional" on Thursday.
The bill turns victims of rape and
incest into felons and forces them to
become incubators of evidence for
the state, he said. According to
Republican philosophy, victims who

are legitimately raped will now have


to carry the fetus to term in order to
prove their case.

Democrats have a majority in both


chambers of New Mexico's state
legislature

TEXAS PAYDAY LAW

In January of 1990, The
Texas Workforce Commission was
summoned to receive and adjudicate
wage claims on behalf of the federal
government. Every private employer
in the state of Texas was subject to
the regulations set forth in the Texas
Payday law found in Chapter 61 of the
Texas Labor Code. Recent provisions
of the law differ from an earlier federal
regulation that did not fully enforce
the procedures. Employers and their
employees should know the provisions
set forth in the Texas Payday Law so
that they remain aware of their certain
rights and responsibilities.

All Texas private employers
are subject to the Texas Payday Law
despite the business size, nature
or amount of employees. The fact
that the Texas Payday Law is for all
private employers also means that
the law does not have jurisdiction
over
governmental
employers.
Furthermore, the law specifies that any
individual who renders a service to
another for compensation is considered
an employee of the employer. It is the
employers duty to pay wages to all
employees who are exempt from the
overtime pay provisions of the Fair
Labor Standards Act. The employer
must pay these employees at least
once a month on the regular scheduled
payday and must pay wages to nonexempt employees at least twice a
month. In the case that the employer
pays his/her non-exempt employees
twice a month, each pay period shall
consist as nearly as possible of an
equal number of days. Additional
provisions of this law require that all
employers pay their employees in full
on each regular scheduled payday.
Within these bounds, an employer
may choose the specific pay days that

pay is allotted every month.



Notices must be posted in the
office outlining the specific days all
employees will receive their pay. If an
employer fails to specify specific pay
dates, the employer must pay his/her
employees the first and the fifteenth
of every month. If an employee
quits her/her position at the place of
employment, he/she may collect their
full and final paycheck at the next
regular payday. It is the employers
duty to pay an employee who has
been discharged no later than the sixth
day after being dismissed. It is the
right of the employee to still collect
a paycheck if work was rendered
for any reason even if the employee
was absent on the regular scheduled
payday. The employer may pay the
employees wages on another day at
the employees request.

The Texas Payday Law
extends to various forms of payments
such as compensation for services
rendered, commissions and bonuses,
and other binding benefits agreed upon
through a written document between
the employer and employee. The
Law does not extend to payments in
the form of expense reimbursements,
gratuities, or gifts. These payments are
not considered wages and therefore are
not considered wages under the Texas
Payday Law. For all hours worked on
behalf of the employee, wages must
be paid in United States currency
unless the employer and employee
make an agreement (upon hire) to
accept his/her wages in another form.
This agreement must be in writing in
order to be in full effect. Wages may
also be paid from the employer to the
employee by a negotiable check or by
direct deposit through electronic funds
transfer to the employees account
of choice. If an agreement is made
between the employer and employee
to arrange wages through direct
deposit, the employer must notify
the employee of the arrangement in

ordered to do so by a court, is ordered


to do so by state or federal law, or has
an authorized writing on behalf of the
employee requesting to deduct all or
part of the wages earned for a lawful
purpose only. An authorization that
is too general may not be mandated
through a court. Employers who
agree to an out-of-pocket loan on
behalf of the employee must put the
deduction in writing for the loan to
have full effect. Employees should
be cautious to maintain proper written
authorizations concerning deductions
to ensure that they are abiding by the
rules and regulations set forth in the
Texas Payday Law.

If it is found that the employer
has convicted two or more violations
of the law or if the employer neglects
to pay a final order of the Commission
by the 10th day after the order has
become final and no appeal is pending,
the Commission may mandate that the
employer deposit a bond. The bond
that must be paid will be the amount
set forth by the Commission and must
assure the payment of any sum taken
from the employer under this act. It

also mandates that the employer pay


each employee in accordance with the
bylaws set forth in the Texas Payday
Law for no more than three years. Due
to the nature of such a high cost of this
secure bond, the requirement of the
employer to furnish a security could
cause the business to fail. Although,
if the employer fails to deposit the
required bond, a court could potentially
order that the employer cease doing
business until the employer pays the
bond to the Commission.

The Texas Payday Law allows
for administrative liens and bank
levies in some cases. In the case that
the Commission orders an employer
to pay money for the sole purpose and
benefit of an employee, the law will
then allow such rights and impositions.
The Commission may assign the
administrative lien to the claimant but
only when the claimant requests such.
The Commission also has the right
to enforce many collection methods
as well as gather an order against a
party who has filed for judicial review
without making a deposit of the
ordered amount into escrow or through
failure to file an affidavit outlining the
inability to pay.

If the Commission finds that
the employer is guilty of acting in bad
faith and not paying full wages to his/
her employee as outlined by the law,
the Commission can mandate that
the employer pay an administrative
penalty in the amount of wages
claimed or $1,000, whichever is the
lesser amount. An administrative
penalty can also be filed against the
employee who is found to have filed a
wage claim in bad faith. An employer
who hires, intends to employ, or
continues employment of an employee
with a foreseeable intent to avoid
paying wages to employees for work
rendered or if the employer refuses to
pay wages even after a demand has
been made known, the employer has
then committed an offense that is a
third degree felony.

By understanding the bylaws
set forth in the Texas Payday Law,
complying with the provisions,
enforcing written documentation for
employees, and having clear lines of
communication with their employees
concerning wages, employers can
protect themselves and be aware of
what the law expects of each private
business owner.
