DEED OF HEIRSHIP AND SALE of an UNDIVIDED SHARE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by NARCISO MANSING, JR.; Heirs of
ESTELITO MANSING, namely MONALISA MANSING-NEMENZO, MIKE LEO
MANSING; and MARY ANN MANSING-TEMPROSA, all of legal age, Filipinos, married,
and a residents of barangay Ajong, Sibulan, Negros Oriental, hereinafter called the HEIR-
VENDORs, in favor of,

LUWINDA G ARANAS, likewise of legal age, Filipino, single and a resident of


barangay Ajong, Sibulan, Negros Oriental, hereinafter referred to as the VENDEE;

WITNESSETH:

That ESTELITO MANSING, and NARCISO MANSING, JR. acquired thru inheritance, a
portion of a certain parcel of land known as Lot No. 3792, situated in barangay Ajong, Sibulan,
Negros Oriental, consisting of ONE HUNDRED EIGHTY NINE (189) square meters, more or
less;

That ESTELITO MANSING died intestate sometime in March 2010, leaving without any
testamentary will nor debts not paid until the present and upon his death he was survived by his
legitimate children and only compulsory heirs, namely: MONALISA, MARY ANN and MIKE
LEO, all surnamed MANSING;

That the Heirs of the original owners of Lot No. 3792 had verbally subdivided the said
parcel of land into several sub-lots, and after which they occupied their respective shares until
the present;

That invoking the provisions of Section 1, Rule 74 of the Rules of Court, the herein
heir-vendors, do hereby settle and adjudicate unto themselves that portion of Lot No. 3792,
consisting of around One Hundred Eighty Nine (189) square meters, more or less;

WITNESSETH FURTHER:

That for and in consideration of the sum of ONE HUNDRED THOUSAND PESOS
(Php 100,000.00), Philippine Currency, in hand paid by the Vendee, LUWINDA G. ARANAS
and receipt in full is hereby acknowledged by the vendors to their entire satisfactions and that by
virtue of these presents the herein Vendors do hereby SELL, TRANSFER, and CONVEY, in a
manner absolute and irrevocable, unto the vendee, her heirs and assigns, all the vendor’s rights,
interests and participation over that portion of Lot No 3792; consisting of ONE HUNDRED
EIGHTY (180) square meters, more or less, including all of the improvements found therein;
free from all liens and encumbrances;

That the vendor herein declares that this land is not tenanted nor worked upon by an
agricultural lessee and that due notice has been given to all persons affected by this transaction
in compliance with the provisions of the New Civil Code of the Philippines, pertaining to the
rights of the redemptioner and preemptioner, but nobody opted to exercise the said rights and the
sale of these parcels land is in consonance with the provisions of the Comprehensive Agrarian
Reform Law because this parcel of land is within the retention limits of the vendors, further, the
vendor warrants their ownership over the said parcel of land and will defend the rights of the
vendee herein.
