This Extrajudicial Settlement of Estate and Waiver of Rights by and among, this _____
day of ______________________, 2019, at Cabanatuan City, Nueva Ecija:

HEIRS OF GELACIO APAN represented by his daughter BETH APAN GOZUM, of

legal age, Filipino Citizen, and a resident of Poblacion, Gen. Tinio, Nueva Ecija;

HEIRS OF PURITA PELAYO represented by her daughter LAARNI PELAYO, of

legal age, Filipino Citizen, and a resident of Poblacion, Gen. Tinio, Nueva Ecija;

HEIRS OF ESTRELITA GONZALES represented by her son WILLIAM

GONZALES, of legal age, Filipino Citizen, and a resident of Poblacion, Gen. Tinio,
Nueva Ecija;

BELEN AUSTRIA, of legal age, Filipino Citizen, and a resident of Poblacion, Gen.
Tinio, Nueva Ecija;

NENITA PALLANAN, of legal age, Filipino Citizen, and a resident of Poblacion, Gen.
Tinio, Nueva Ecija;

REYNALDO APAN, of legal age, Filipino Citizen, and a resident of Poblacion, Gen.
Tinio, Nueva Ecija;

RONALD APAN, of legal age, Filipino Citizen, and a resident of Poblacion, Gen. Tinio,
Nueva Ecija;

JOCELYN APAN CAPUNO, of legal age, Filipino Citizen, married to Noriel Capuno
and a resident of Poblacion, Gen. Tinio, Nueva Ecija;

-WITNESSETH-

That the parties hereto who are the compulsory and legal surviving heirs of the late
ONOFRE APAN who died on __________________________ and ADELA APAN, who died
intestate on ______________________________, in Gen. Tinio, Nueva Ecija, hereto attached a
copy of their Certificate of Death, marked as Annex “A” & “B”;

That the deceased ONOFRE APAN and ADELA APAN, duringtheir lifetime has
acquired property, more particularly described as follows to wit:

ORIGINAL CFERTIFICATE OF TITLE NO. 041-P-17230

A PARCEL OF LAND (LOT 1096, CAD. 226-D (EXT.) SITUATED IN THE

BARANGAY OF SAN PEDRO, MUNICIPALITY OF GEN. TINIO,
PROVINCE OF NUEVA ECIJA. BOUNDED ON THE SW., ALONG LINE 1-2
BY LOT 1102, CAD. 226-D (EXT.); ON THE NW., ALONG LINE 2-3 BY
PAJARILLAGA ST.; ON THE NE., ALONG LINE 3-4 BY LOT 1104; ON THE
SE., ALONG LINE 4-5 BY LOT 1221, ALONG LINE 5-6 BY LOT 1220; AND
ON THE ALONG LINE 6-1 BY LOT 1103, CAD. 226-D (EXT.) WITH AN
AREA OF THREE HUNDRED EIGHTY NINE (389) SQUARE METERS.

That the deceased ONOFRE APAN and ADELA APAN, died without leaving any Last
Will and Testament, as well as debts of any kind whatsoever;
 NOW THEREFORE, for and in consideration of the foregoing premises, the parties
hereto have agreed as they hereby do so agree to divide, partition and adjudicate the subject land
between/among themselves;

That WE, BETH APAN GOZUM, LAARNI PELAYO, WILLIAM GONZALES,

BELEN AUSTRIA, NENITA PALLANAN, REYNALDO APAN, and RONALD
APAN,beingthe surviving heirs of the deceased, do hereby RENOUNCE AND WAIVE our
rights, interests, share and participation in the aforesaid parcel of land portion of Two Hundred
Twenty Two (222) Sqm in favor of JOCELYN APAN CAPUNO, married to Noriel Capuno;

That in view of all the foregoing,I,JOCELYN APAN CAPUNO, do hereby adjudicate

unto myself the ownership of the above-mentioned portion of Two Hundred Twenty Two (222)
Sqm, waived by BETH APAN GOZUM, LAARNI PELAYO, WILLIAM GONZALES,
BELEN AUSTRIA, NENITA PALLANAN, REYNALDO APAN, and RONALD APAN;

That this Extrajudicial Settlement of Estate and Waiver of Right is subject to the
provisions of Section II, Rule 74, of the Revised Rules of Court of the Philippines, the parties
hereto do by these presents agree to adjudicate the parcel of land described above.

IN WITNESS WHEREOF, we have hereunto set our hands on this _____ day of
