WHfflIAS, the Barangay Government of Sagrada Familia, Bula, Camarines Sur is presently occupying a
parcel of land or real property, the area of which about Two Hundred Twenty Four and 4/100 square
meters (224.4 sq. in.), covered by Assessment of Real Property (ARP) No.97-020-722 and is presently
being utilized by the Barangay Government as the barangay centre;

WHEREAS, the subject parcel of land or real property which is located at the corner of the provincial road
and Felix Jardinel Street, Zone 4, Barangay Sagrada Familia, this Municipality, is privately owned and is
being utilized as the current barangay centre for several years now;

WHEREAS, the main reason of the Sangguniang Barangay to acquire the subject real property is to have
its own real property for the barangay centre without the fear of being evicted by the registered owners,
and more importantly to promote the common good for public purpose;

WtlfflIAS, through the exercise power of eminent domain, the affected private property may be
acquired by the local government unit of the Barangay Sagrada Familia through expropriation proceedings
as provided by Section 19 of R.A 7190, otherwise known as the Local Government Code of 1991, to wit:
"SECTION 19. Eminent Domain. -A local government unit may, through its ch.Ief executive and acting

pursuant to an ordinance, exercise the power of eminent domain for public use, or purpose or welfare for
the benefit Of the poor and the landless, upon payment of just compensation, pursuant to the provisions
Of the Constitution and pertinent laws: Provided, however, That the power Of eminent domain may not be
exercised unless a valid and definite offer has been previously made to the owner, and such offer was nat
accepted: Provided, further, That the local government unit may immediately take possession Of the
property upon the f.IIing Of the expropriation proceed.Ings and upon making a deposit with the proper court
Of at least fifteen percent (15%) of the fair market value of the property based on the current tax
declaration of the property to be expropriated: Provided, finally, That, the amount to be paid for the

Expropriated property shall be determined by the proper court, based on the fair market value at the time
Of the taking of the property."

Wwffl£AS, however, the law requires that before expropriation proceedings may ensue, there must first
be a negotiation, valid and definite offer to the registered owner/s, successor/s-in-interest, heir/s
assignee/ s of the subject real property or parcel of land, and exhaustion of all legal means;

WHEfl£AS, as such, the Sangguniang Barangay of Sagrada Familia, this Municipality, hereby authori
the Honorable Punong Barangay Nellie P. Largo to provide a valid and definite offer as purchase pric
Mr. Porferio Soreta and/or the registered owner/s, successor/s-in-interest, heir/s or assignee/s of a

WtlEflEAS, in the event that voluntary sale of the subject property and exhaustion of all legal means would
be deemed impossible due to the refusal of Mr. Porferio Soreta and/or the registered owner/s,
successor/s-in ~interest, heir/s or assignee/s to sell, among others, the Sangguniang Barangay of Sagrada
Familia, this Municipality, hereby further authorizes the Honorable Punong Barangay to initiate
expropriation proceedings of the subject property.

NOW, THEREFORE, BE IT ENACTED, AS IT IS HEREBY ENACTED BY THE SANGGUNIANG BARANGAY OF


SAGRADA FAMILIA, BULA, CAMARINES SuR, BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, IN
SESSION ASSEMBLED, that:

Section 1. The Sangguniang Barangay of Sagrada Familia, Bula, Camarines Sur, thru the Punong
Barangay, Honorable Nellie P. Largo, shall provide a valid and definite offer as purchase price to Mr.
Porferio Soreta and/or the registered owner/s, successor/s-in-interest, heir/s or assignee/s of a Two
Hundred Twenty Four square meters (224.4 sq. in.) parcel of land covered under Assessment of Real
Property (ARP) No. 97-020-722 and located at the corner of the provincial road and Felix Jardinel
Street, Zone 4, Barangay Sagrada Familia, Bula, Camarines Sur, and to execute the necessary deed in
order to carry out the intent of this Ordinance. The purchase price to be offered shall be in
accordance with the recommendation of the Sangguniang Barangay in coordination with the
Municipal Assessor's Office of the Municipality of Bula.

Section 2. That in the event the registered owner refused to accept the aforementioned offer, to
further authorize the Honorable Nellie P. Largo, Punong Barangay, to (a) initiate expropriation
proceedings; (b) sign, execute and deliver any and all documents; and (c) undertake any and all
actions necessary to give effect to the authority to expropriate the subject property. In this case, the
just compensation shall be the ruling of the appropriate court.

Section 3. The funds for carrying out this Ordinance shall be chargeable to the appropriate funds in
the Annual/Supplemental Budget of the Barangay Sagrada Familia, Bula, Camarines Sur.

Section 4. The taking of the above-mentioned private real property or parcel of land is for public
purpose, specifically road widening purposes, an allowable ground in expropriation proceedings that
is necessary to establish ownership for the barangay centre.

Section 5. Let copy of this Ordinance be furnished to all offices concerned for their information,
guidance and reference.

Section 6. This Ordinance shall take effect after ten (10) days from the date a copy thereof is posted
in a bulletin board at the entrance of the Barangay Hall, and in at least two (2) other conspicuous
places in the territorial jurisdiction of the Barangay.

RESOLVED FINALLY, that copy/ies of this ordinance be furnished to the concerned offices.
