Exercise #2 for Midterm Period

1. Discuss briefly in your own words the main context of the Rizal Law.
Answer:
In my own understanding, the main context of the Rizal Law is to introduce the works of
Jose Rizal (Noli Me Tangere and El Filibusteresmo) in private and public-school
institutions from primary, secondary to tertiary level as part of their curriculum. This is to
educate young generations about the historical events that Filipinos and Philippines had
experienced especially in Spanish era.

2. Why did Doña Teodora choose Jose as Rizal's name?


Answer:
Doña Teodora choose Jose as Rizal's name because she was a devotee of the
Christian Saint Joseph where in order to honor the saint, she named Rizal after it. And
June 19 was the feast day of Saint Joseph when Rizal was born.

3. What could be the reason/s why Don Francisco chooses Rizal as the family name of
his children not Mercado?
Answer:
Don Francisco didn't wanted Jose to be involved in the suspection of Spaniards to the
Mercado particularly his brother Paciano who had the connection to the Martyr Priests
GOMBURZA who were advocating justice against the spaniards.

4. Why was Doña Teodora arbitrarily arrested by the Spanish authorities?


Answer:
Doña Teodora was arrested because of accusation that she attempted to poison her
sister-in-law. When Doña Teodora brought food to Teodora Alberto, the latter refused to
eat it and instead fed it to her dog, which allegedly died after eating the food. With the
help of her Guardia Civil lover, Teodora Alberto had Doña Aurora arrested in front of her
whole family. The Spaniards arrested Doña Teodora and made her walk 50 kilometers
around Laguna. Doña Teodora was charged and imprisoned for two years without trial
for falsehoods leveled against her.
5. Under our present Judicial system, what are the constitutional rights of the accused?
Answer:
The accused shall be presumed innocent until the contrary is proved, and shall enjoy
the right to be heard by himself and counsel, to be informed of the nature and cause of
the accusation against her, to have a speedy, impartial, and public trial, to meet the
witnesses face to face, and to have compulsory process to secure the attendance of
witnesses and the production of evidence in her behalf. However, after arraignment, trial
may proceed notwithstanding the absence of the accused provided that she has been
duly notified and his failure to appear is unjustifiable.

6. What is meant by due process? Explain your answer.


Answer:
Due process is an important part of Philippine legal system especially that crime rates is
increasing. Due process is defined as a legal requirement where a person cannot be
deprived of his legal rights without proper application of the law. In other words, a
person cannot be put in jail without firstly going through the legal system to determine if
they are guilty of the crime they are accused of and what punishment should be given.
There are two kinds of due process (1) Procedural process - one which hears before it
condemns. (2) Substantive due process—requires the intrinsic validity of the law in
interfering with the rights of the person to life, liberty or property.
