2) Monthly Salary and allowances (SAR):
The first party pay to second party the following
monthly wage:
Basic Salary
Housing allowance
Transportation allowance
Communication allowance
Other allowance
Total monthly wage
and shall be paid by the end of each Gregorian calendar
month according to the system followed in the Company
regarding payment of salaries and wages and everything
imposed by the regulations and by-laws of the Kingdom
shall be deducted from it as taxes, or fees or Social
Insurance or any other regulatory due amounts. Also all
due amounts of the Company shall be deducted from the
Second Party as administrative penalties by deduction
from the salary or wage within the limits stipulated by
Article (70) of the Law of Labor in the Kingdom.
Forth: General Contract Condition
1) Contract details:

The Second Party shall be subject to a probationary

to a written agreement between the parties, to a

entitled to terminate the service of the Second Party

The First Party shall provide the Second Party
healthcare insurance in according to the
Company’s Insurance Policy and Saudi Council of

7) General Organization for Social Insurance
(GOSI):
The first party shall register the second party in the
General Organization for Social Insurance (GOSI)
and pay contributions as per its regulation
8) Vacation and Holidays:
The Second party shall be entitled to:
1- A paid leave of (___) days for every contractual
year. First party shall set vacations start and end
date in relation to work requirements. Second
party shall be entitled to a wage for the accrued
days of the leave in advance. First party can
postpone vacation for a period of not more than
ninety days. Such postponement shall not,
however, exceed the end of the year following the
year the leave is due. Second party acceptance
shall be obtained for this postponement.
2- Official Eid Holidays (Ramadan and Hajj) in
addition to the Saudi "National Day" holiday; as
per regulation.

12) End of Service Reward:
Upon the end of the work relation by first party or by
mutual acceptance or result of force majeure, the
Second Party shall be entitled to end-of-service
award of a half-month wage for each of the first five
years and a one-month wage for each of the
following years. The end-of-service award shall be
calculated on the basis of the last wage (Basic
Salary plus fixed monthly cash allowances) and the
worker shall be entitled to an end-of-service award
for the portions of the year in proportion to the time
spent on the job.
Fifth: Relationship contract conditions:
1) Employee's Duties:
The Second Party shall perform work with the First Party in
as per above condition No. (1) or in any other similar or
equal position and he shall perform the following duties:
1- He shall dedicate the working hours for his work.
2- He shall perform his work most carefully and diligently.
3- He shall perform his work according to the requirements of
his duties and related issues.
4- To perform overtime work as per condition No. (3) of
above General Contract Conditions.
2) Second Party employment obligations:
1- Shall perform his significant obligations related to this
contract and shall obey the legal orders and observe the
instructions issued by the First Party concerning safety of
labor and labors.
2- Shall perform the work assigned to in the best manner and
shall exert all efforts to perform it with the most carefulness
and diligence.
3- Shall not perform any work for the account of third parties
during contract validity or during the time he is in his
regularly determined vacations or during the time he is
notified by termination of his contract, or instead he may
be removed and his contract is terminated.
4- Shall commit to all provisions and duties issued by the
competent authorities now and in future and every breach
or violation to the laws, implementing regulations and
decision issued in the field of work or else, shall be borne
by the Second Party and on his own expense.
5- Shall be bound and restricted by the instructions issued by
his seniors and shall perform them the moment he knows
through any of the methods adopted.
6- To take adequate care of the tools and equipment
assigned to the first party, which are placed at his
disposal, or in his custody, and to return to the first party
the materials that are not consumed from them.
7- To provide all assistance and without stipulating additional
pay in cases of dangers threatening the safety of the
workplace or the persons working in it.
8- Shall adhere to good behavior and ethics during work at all
times. He shall abide by the laws, customs and ethics in
the Kingdom of Saudi Arabia, as well as the rules,
regulations and instructions in force at the first party, and
he shall bear all the financial fines resulting from his
violation of all the regulations

‫يستحق الطرف الثاني عند إنهاء العالقة التعاقدية من قبل الطرف األول أو‬
‫باتفاق الطرفين أو بانتهاء مدة العقد أو نتيجة القوة القاهرة مكافأة قدرها أجر‬

‫يعمل الطرف الثاني لدى الطرف األول على الوظيفة المحددة أعاله في الشرط رقم‬
‫ ويوافق الطرف الثاني على العمل‬،‫ ) وذلك وفق توجيهه وتعليمات الطرف األول‬1(
‫بأي وظيفة أخرى مشابهة أو مختلفة إذا اقتضت مصلحة العمل ويجب عليه في‬
:‫سبيل القيام بعمله ما يلي‬
.‫ أن يخصص وقت الدوام لعمله‬-1
.‫ أن يبذل في أداء العمل كل ما في وسعه من جهد‬-2
.‫ أن يقوم بعمله حسب ما تقتضيه واجباته ومقتضياتها‬-3

:‫االلتزامات الوظيفية للطرف الثاني‬ )2
‫ وأن يطيع األوامر‬،‫ تأدية التزاماته الجوهرية المترتبة عليه في هذا العقد‬-1
‫ وعليه مراعاة التعليمات التي يصدرها الطرف األول والخاصة‬،‫المشروعة‬
.‫بسالمة العمل والعمال‬
‫ يجب على الطرف الثاني القيام بالعمل الموكل إليه بالشكل األفضل وأن يبذل‬-2
.‫من أجل أدائه كل ما يستطيع من جهد وعناية‬
‫ أو أثناء تمتعه‬،‫ ال يجوز له القيام بأي عمل لحساب غيره أثناء مدة سريان العقد‬-3
‫ أو أثناء فترة إنذاره بإنهاء عقده وإال جاز فصله من‬،‫باإلجازات المقررة نظاما‬
.‫الخدمة وإنهاء عقده‬
،‫ يلتزم بكل ما تصدره السلطات المختصة من أحكام وواجبات حاال ومستقبال‬-4
‫وكل مخالفة لألنظمة واللوائح والق اررات الصادرة في مجال العمل أو غيره يتحمل‬
.‫الطرف الثاني نتائجها وعلى حسابه الخاص‬
‫ يتقيد بالتعليمات التي يصدرها رؤساؤه ويقوم بتنفيذها بمجرد علمه بها بأي‬-5
.‫طريقة من الطرق المتبعة‬
‫ والخامات المملوكة‬،‫ والمهمات المسندة إليه‬،‫ أن يعتنى عناية كافية با ألدوات‬-6
‫ وأن يعيد‬،‫ أو التي تكون في عهدته‬،‫ الموضوعة تحت تصرفه‬،‫للطرف األول‬
.‫إلى الطرف األول الم واد غير المستهلكه منها‬
‫ أن يقدم كل عون ومساعدة دون أن يشترط لذلك أج ار إضافيا في حاالت‬-7
‫األخطار التي تهدد سالمة مكان العمل أو األشخاص العاملين فيه‬
‫ وفي جميع األوقات يلتزم باألنظمة‬،‫ يلتزم ب حسن السلوك واألخالق أثناء العمل‬-8
‫واألع ارف والعادات واألداب المرعية في المملكة العربية السعودية وكذلك‬
‫ ويتحمل كافة‬،‫بالقواعد والل وائح والتعليمات المعمول بها لدى الطرف األول‬
.‫الغرامات المالية الناتجة عن مخالفته لتكل األنظمة‬

3) Termination and revocation:
1- This Contract end with expire date or when it agreed
by both parties in written note.
2- Both of the contract parties shall have the right to
terminate the contract through a written notice
directed from one party to the other, thirty days at
minimum before expiry of the basic contract period,
and other than that, the two parties may terminate the
contract according to the third part of the Saudi Labor
Law.
3- The First Party shall be entitled to revoke the contract
without any notice or without paying for an allowance
for notice or any rewards or reimbursement at any
time due to the breaches stipulated in Article (80) of
the Saudi Labor Law.
4- The second party may leave his job without notice in
any of the cases of article (81) of the Saudi Labor
Law.
4) Force majeure:
Both parties agreed that in the event that the First
Party fails to fulfill his obligations in according with the
terms and conditions of this Contract towards the
Second Party shall for reasons beyond his control, the
First Party shall be under no liability or obligation to
Second Party.
5) Illegal competition:
The Second Party and after expiry of his work with the
First Party is not entitled to work in similar or
competitive companies and at any place within the
Kingdom, whether this for his own account ort to the
account of other parties or divulges secret of first party
that he may be acquainted with during work with the
latter. This prevention shall continue for a period of two
years commencing as of the date of expiry of work of
the Second Party with the First Party. As per article
number (83) of Saudi labor law.
6) Amendment of the contract:
The First Party shall be entitled to reconsider the
articles of the contract according to work requirements
and provided it shall not affect the acquired rights of
the Second Party whether according to this contract or
to Saudi Labor Law. This shall be furnished through
the written approval of the Second Party.

‫ أو باتفاق‬،‫ ينتهي هذا ال عقد بانتهاء مدته في العقد المحدد المدة‬-1
‫الطرفين على إنهاؤه بشرط موافقة الطرف الثاني كتابة‬
‫ لكل من طرفي العقد الحق في إنهاء هذا العقد بإشعار خطي‬-2
،‫يوجه للطرف اآلخر قبل انتهاء مدة العقد األساسي بثالثين يوما‬
‫أما غير ذلك فيحق للطرفين إنهاء العقد طبقا لما ورد في الباب‬
.‫الثالث من نظام العمل السعودي‬
‫ أو دون دفع بدل‬،‫ يحق للطرف األول فسخ العقد دون إنذار‬-3
‫ أو أي مكافآت أو تعويض في أي وقت بسبب المخالفات‬،‫إنذار‬
.‫) من نظام العمل‬80( ‫المنصوص عليها في المادة‬
‫ وإنهاء العقد دون أشعار الطرف‬،‫ يحق للطرف الثاني ترك العمل‬-4
،‫األول مع احتفاظه بحقه في الحصول على كافة مستحقاته‬
‫) من نظام العمل‬81( ‫طبقا للحاالت الواردة في المادة‬
:‫ ) القوة القاهرة‬4
‫وافق الطرف الثاني على أن يكون الطرف األول في حل من أية‬
‫مسؤولية أو التزام تجاه الطرف الثاني في حالة عدم تمكنه من‬
‫الوفاء بالتزاماته تجاه الطرف الثاني بموجب نصوص وأحكام هذا‬
.‫العقد ألسباب خارجة عن إرادته وتحكمه‬
:‫ ) المنافسة غير المشروعة‬5
‫ال يحق للطرف الثاني بعد انتهاء عمله لدى الطرف األول أن‬
‫يعمل في الشركات المماثلة أو المنافسة وفي أي جهة داخل‬
‫ ويلتزم‬،‫المملكة سواء كان ذلك لحسابه الخاص أو لحساب الغير‬
‫بالمحافظة على أسرار الطرف األول المهنية والمعلومات التي‬
‫ ويتحمل مسئولية‬،‫يكون قد اطلع عليها أثناء عمله لدى هذا األخير‬
.‫كل ضرر ينجم عن إفشائه هذه األسرار والمعلومات ومهما بلغ‬
‫ويسري هذا المنع لمدة سنتين تبدأ من تاريخ انتهاء عمل الطرف‬
‫ وفقا لما ورد في نظام العمل المادة رقم‬، ‫الثاني لدى الطرف األول‬

:‫ ) تعديل العقد‬6
‫يحق للطرف األول أن يعيد النظر في تعديل مواد هذا العقد وفقا‬
‫ وبشرط أال يؤثر على الحقوق المكتسبة للطرف‬،‫لمقتضيات العمل‬
‫الثاني سواء بموج ب هذا العقد أو بموجب نظام العمل السعودي‬
.‫وذلك بموافقة الطرف الثاني المسبقة والخطية‬

7) Disputes:
1- Any disputes or differences arising between the two
contract parties shall be solved amicably if possible
and if this was not achieved, it shall be referred to the
competent authorities concerned in solving the
disputes according to the Saudi Labor Law.
2- Notification and correspondence between two parties
shall be executed in written by agreed addresses in
forehead of this contract. Any change of addresses
shall be updated or exacted one will be the official
one.
8) Final provisions:
1- The Saudi Labor Law and the Personnel Affairs by-
law which the Second Party is aware of and realized
their contents, are considered to be complementary
to each other in all other provisions not dealt with in
the contract.
2- The Gregorian calendar is only taken as a base for
dates specified here in this contract.
3- Each of the two parties acknowledge that, his
address mentioned in this contract is his elected
home of domicile and each notice sent to him shall
be considered regulatory and consequently
regulatory effects shall result thereof.
4- This contract is made of two counterparts and the two
parties signed them and each party received one to

Employment of women appendix
This part shall be signed by both parties if second party
gender is “female”
Maternity cases:
1) Second party shall be entitled to a fully paid maternity
leave for ten weeks. Second party has the freedom of
how to schedule it, however to not start by more than
four weeks of expected day for childbirth. Date of
maternity shall be decided by company doctor or
authorized medical firm.
2) Second party shall be entitle when she returns to work
following a maternity leave, in addition to the rest
periods to a rest period, the rest periods shall not
exceeding in aggregate one hour a day for nursing her
infant. Such period or periods shall be calculated as
part of the actual working hours and shall not entail any
reduction in wages. Duration of rest periods shall not
exceed twenty four months.
3) When second party return from maternity leave, she
must notify the first party in writing of the time of the
rest with the intention of breastfeeding, and the first
party must also be notified of any change that occurs
to that time
4) entitled to a one-month leave with a wage if she gives
birth to a sick hen who needs a constant companion,
starting after the maternity leave, and she may extend
it for an additional month without pay
Husband death cases:
1) For Muslim employee in case of husband death,
she shall be entitled for a fully paid leave for a
minimum period of 4 month and 10 days. She
has the full right to extend her leave in case of
pregnancy. Leave end by her childbirth. She may
not benefited from the remaining waiting-period
after she giving the birth.
2) For non-Muslim employee, in case of husband
death, she shall be entitled to a fully paid leave
for a minimum period of fifteen days as of the
date of death as per clause No (2) of Article No,
(160) of Saudi labor law.
End of Service Reward:
Female employee shall be entitled for full End of service
reward if she end contract with in six month of her marry
or three months of her childbirth.

Compensation in case of Unlawful

Hiring Expertise appendix ‫ملحق توظيف غير السعوديين‬

Government fees:
For Expertise, first party shall bear the following expense:
1. Government fees for deployment or local
service transfer
2. Issuance and renewal of Labor permit and
Resident ID fees the consequent fines for delay
3. Profession change fee unless it is optional
4. Re-Entry visa fee
Vacation Tickets:
For expats and as per Company’s policy, the
Second party and his legible dependents shall be
entitled to return ticket, (_____) class to his Point
of Origin at the end of completed year.
Return home expense:
In the event of death, the first party is obligated to
prepare the body of the second party and transfer it
to where employment contract was concluded or
the worker was brought from it unless he was
buried in the Kingdom after obtaining the consent
of his family, Otherwise, General Organization of
Social insurance (GOSI) shall obligated to do so
whenever the death is related to work.
