The assessment will be stopped when any of the following incidents occurred:

Students who FAILED will undergo RESIT which is scheduled accordingly. A student, who fails in

student to incur a failing grade.

SCENARIO:

Johnny, Elon and Franco, all of legal age, are friends. They have reputation in their barangay as gang
members whose main activity is to rob houses and other different establishments. Prior to executing their
plan of robbing the house of Doña Amber, the three conducted surveillance of the routinary activities in the
house of Doña Amber. They even posed as technician, electricians, delivery and errand boys and befriended
the maids therein in preparation of carrying out their plan. They also become friend with Benjamin, one of the
guards of the gate of the subdivision where the house of Doña Amber is located and even confided with him
their plan of robbing. As a matter of fact, they asked him to open the gate on the day that they will pursue
their plan to which he agreed.

On April 15, 2022, Doña Amber left for Boracay for a long holiday vacation. This fact is made known by
the group. As previously conceived, they prepared to carry out their plan on the said date. After they were let
in by Benjamin at the gate, they waited for nighttime. They were able to gain entry to the house by silently
drilling the wall of the back part of the house. They are aware that only Camille, one of the maids was left in
the house. Armed with short firearms, they entered the servant’s quarter and held Camille at gunpoint. They
instructed Camille to open the vault which is located in the study room of Doña Amber. The group knew that
Camille has access to the vault as she was befriended by Johnny and the information was divulged by Camille
herself. Camile, fearing for her life opened the vault. As soon as the vault was opened, Elon and Franco
amassed all the money and jewelries inside the vault. While Johnny is guarding Camille. On their way out,
Camille was able to press the alarm of the house. The alarm created a very loud noise. Fearing that someone
might come for help, Johnny and Elon immediately fled outside with the loots. Franco was bit left behind.
Outraged, Franco hit the nape of Camille. Then, he immediately went outside and rode with their getaway
vehicle together with Johnny and Elon. The following day, the robbery incident was all over the news with
them identified. After one week, they all appeared and surrendered at the police station and implicated
Benjamin as their companion. They were charged for robbery.

QUESTIONS:

1. Is robbery as in the instant case a felony or an offense? Explain your answer.


A felony because robbery in the title of revised penal code which is crime against property.

2. Discuss the participation of Johnny, Elon, Franco, Benjamin and Camille, if any in the instant case.
Johny, Elon and Franco the participation is direct participation. They have direct participation of
execution of crime.
Benjamin the participation is principle by indispensable cooperation because he serves as access
to the offender upon entering submission.
Camille the participation is none because she committed only a crime by means intimidation of
offender.

3. Except for evident premeditation which is inherent in the instant case, what are the circumstances
present in the above-mentioned facts that may affect the criminal liability of the accused? Cite all
identified applicable circumstances.
It is aggravating circumstances because the incident did in nighttime, there is a force of entry and
conspiracy.

4. Assuming the accused in the instant case were arrested and later on found to be guilty, in what
manner shall their criminal liability be totally extinguished?
The manner shall their criminal liability be totally extinguished by service of the sentence.
