The Generations of Human Rights
When human rights are being
discussed, they are often divided up into four
categories called generations. A reflection of
three generations of human rights can be
seen in the popular phrase of the French
Revolution: liberty, equality, fraternity. The
fourth generation is emerging nowadays.
The first generation of human rights
encompasses an individual’s civil and

The first sub-category relates to the norms of
“physical and civil security.” This includes
not committing acts of torture, slavery, or
treating people inhumanely. The second
sub-category relates to the norms of “civil-

and the right to political participation. The

The second generation of human
rights encompasses socio-economic rights.
The second generation rights can also be

“economic needs.” This includes fair wages
and sufficient standards of living. The
second generation rights are based on
establishing equal conditions.
The third generation of human rights
encompasses a broad class of rights. The
third generation rights can be divided into
sub-categories as well. The first sub-category
relates to “the self-determination of
peoples'' and includes different aspects of
community development and political status.
The second sub-category is related to the
rights of ethnic and religious minorities.

The fourth generation of human rights
includes the so called “rights related to
genetic engineering”, the rights which are on
the doctrinal debate in what regards their
recognition or prohibition of certain
activities. We could put in the same category
the so-called rights of future generations, as
well as the rights that cannot belong to an
individual or to social groups, including
nations, they belong only to humanity as a
whole. The rights of humanity would treat
the common assets of the whole humanity.
Overall, recognizing the differences
between each generation of rights can help
us to better understand how broad the field of
human rights is and how varied the issues
involved truly are. Each kind of right is best
fulfilled through the use of different forms of
legislation, and recognizing the different
generations of rights can improve our ability
to identify what type of legislation is best
suited for dealing with a particular issue.

реалізується за допомогою різних форм
законодавства, і визнання різних поколінь
прав може покращити нашу здатність
визначити, який тип законодавства
найкраще підходить для вирішення
конкретного питання.
