Introduction
Clause 12 “Measurement and Evaluation” is a crucial
clause in the FIDIC Red Book as the book uses re-
measurement to determine the Contract Price. Sub-
Clause 14.1 “Contract Price” states that the Contract Price
shall be agreed or determined under Sub-Clause 12.3
“Evaluation”. Sub-Clause 12.3 states that the Engineer
shall proceed in accordance with Sub-Clause 3.5
‘Determinations” to agree or determine the Contract
Price by evaluating each item of work, applying the
measurement agreed or determined in accordance with
Sub-Clauses 12.1 and 12.2 and the appropriate rate or
price for the item.
Accordingly, the correct evaluation of the Contract Price
requires correct quantification of works and specifying
the appropriate rate. While Sub-Clause 12.1 covers
procedural aspects of the measurements process, Sub-
Clause 12.2 relates to technical basis of measurements
and most importantly, the quantities that should be
applied in evaluation.
This article aims at interpreting and explaining the
requirements and provisions of Sub-Clause 12.2 through
practical examples. Sub-Clause 12.3 which relates to the
“appropriate” rates and the cases where a new rate shall
be established, will be covered, along with how to
establish a new rate, in a separate future article.
Sub-Clause 12.2 (Method of Measurement)
“Except as otherwise stated in the Contract and
notwithstanding local practice:
(a) measurement shall be made of the net actual quantity
of each item of the Permanent Works, and
(b) the method of measurement shall be in accordance
with the Bill of Quantities or other applicable
Schedules.”

 Commentary
The first sentence of the Sub-Clause indicates that the
provisions of this Sub-Clause do not take precedence
over contrary provisions in any part in the contract.
However, they override any local practice
measurement.
Sub-paragraph (a) of this Sub-Clause provides a general
rule that measurement shall be “net” actual quantity of
each item of the Permanent Work. This means that
allowances in works and Temporary Works shall not be
measured or paid for. However, as indicated above, any
contrary contract provision will take precedence over this
sub-paragraph, which means that this rule is only
applicable where no contrary provisions exist in the
Contract Documents.
Sub-paragraph (b) of this Sub-Clause states the method
of measurement shall be in accordance with the Bill of
Quantities or other applicable Schedules. But what does
the term “method of measurement” mean?
construction industry, method of measurement is a
standard set of rules for measuring various elements of a
construction project and may include guidelines for
preparing the Bill of Quantities. The most renowned
publications in this field are the Royal Institute of
Chartered Surveyors (RICS) publications which include:
▪ Principles of Measurement International (POMI),
▪ Standard Method of Measurement” (SMM), and
▪ New Rules of Measurement (NRM).
The Institute of Civil Engineers also issues a similar
publication entitled the “Civil Engineering Standard
Method of Measurement” (CESMM), dedicated to
infrastructure projects.
The Bill of Quantities may be prepared using any of the
above standard methods of measurement or using
bespoke rules. In all cases, the rules must be stated in the
contract. This is usually done through the “Preambles” to
the Bill of Quantities either by reference to the standard
method of measurement used or by providing full details
of the rules used. In addition to that, it is common that the
description of the BOQ items indicates what the rate or
price shall include.
The FIDIC Contracts Guide, indicates the significance of
the method of measurement by stating: “This method

 relates primarily to what quantities are to be applicable
to the evaluation, rather than to the measuring techniques
(although they may also be described) and plays an
important part in the whole evaluation of the Contract
Price”.
The tendering time does not usually allow tenderers to
perform full measurements of the works. So, ensuring
that the BOQ does not include any omission, is
impossible at that stage. However, as work progresses,
the contractor will easily identify any omitted items and
would normally request such items to be included in the
measurement and evaluation.
In such cases, The FIDIC Contracts Guide recommends
considering various provisions in the Contract and of the
applicable Laws. However, it suggests that the effect of
Clause 12 would be:
1. “If the Bill of Quantities includes (either incorporated
by reference or specified) principles of measurement
which clearly require that an item of work be
measured, and if the Bill of Quantities contains is no
such item, then an additional Bill item will be required
in order to satisfy the requirement for measurement
in accordance with such principles”.
2. “If the Bill of Quantities includes (either incorporated
by reference or specified) principles of measurement
which do not clearly require that a particular item of
work be measured, and the work was as described in
the Contract and did not arise from a Variation, then
measurement in accordance with such principles
does not require the addition of a new Bill item”.
3. “If the Bill of Quantities does not include principles of
measurement for a particular item of work, and the
work was as described in the Contract and did not
arise from a Variation, then measurement in
accordance with such principles does not require the
addition of a new Bill item”.
Conclusion
There is no doubt that Sc. 12.2 is a significant subclause
in FIDIC Red Book. This is because it directly relates to
determining the Contract Price. Moreover, correct
application requires considering various provisions of the
Contract and applicable Laws.

 Examples
Example 1:
The Contractor refused the Engineer approach in calculating
the backfill material quantity by considering the volume of
space to be filled and asked the Engineer to consider the
actual volume of the supplied backfill material.
Analysis: The Contract Documents did not include
information on how to measure backfill material. However,
the Preambles to BOQ refer to Principles of Measurement
International (POMI) as the basis for measurement. By
checking the relevant, items in POMI, it states that filling
material shall be measured by volume as equal to the void to
be filled. Hence, the Engineer decision is correct.
Example 2:
The Contractor requested the Engineer to measure and
include in valuation the piles head breaking works as the
BOQ does not include an item for this work. The Engineer
refused justifying his position by the fact that the Contractor
did not add an item to the BOQ during the tender while the
BOQ allows for adding new items at the end of the piles bill.
Accordingly, the Contractor has lost his right and the cost of
this work is deemed included in other items.
Analysis: First, the Engineer argument is not justifiable.
Failure of the Contractor to add an item during tender stage
does not invalidate his right. Especially the omission in the
BOQ is the Employer mistake. Upon review of Contract
Documents, it was found that the Preambles to BOQ refer to
Principles of Measurement International (POMI). By checking
the relevant, items in POMI, it states that cutting off tops of
piles and connections for lengthening piles shall be
enumerated. Accordingly, cutting off tops of piles shall be
measured and included in the valuation.
Example 3:
The Contractor requested the Engineer to measure and
include in valuation the shuttering works for concrete as the
BOQ does not include an item for this work. The Engineer
refused justifying his position by the fact that the Preambles
to BOQ states that no items shall be added to the BOQ and
in case of an item is missed, the price of such items is
deemed included in other rates and prices.
Analysis: Review of the Contract Documents revealed that
the Preambles to BOQ includes bespoke principles of
measurements. These principles do not include
measurement of shuttering works. As this is the case, it is
deemed that these principles do not require the shuttering
works to be measured. Hence, shuttering works shall not be
measured or included in the valuation and shall be deemed
to be included in concrete prices.
