የኮንስትራክሽን ኢንደስትሪው ማህበራዊና Recognizing the fact that the construction

ኢኮኖሚያዊ መሰረተ ሌማቶችን በመገንባት፣ industry is making significant contribution
የሥራ ዕዴሌ በመፍጠርና ዴህነትን በመቀነስ towards national development by building social
ሇሀገራዊ ሌማት ከፍተኛ አስተዋፅኦ እያበረከተ and economic infrastructure, creating job
መሆኑን በመገንዘብ፤
opportunities and reducing poverty;
ዘርፉ ከፍተኛ ቁጥር ያሇው የሰው ኃይሌ፣ Whereas a large number of human resources,

Believing that it is quite important to regulate the

አንቀጽ ፩፡ አጭር ርዕስ
GENERAL
ይህ ዯንብ “በግንባታ ሥራ ሊይ የተሰማሩ
የሠራተኞችን ዯህንነት፣ ጤና እና የግንባታ Article 1: Short Title
አካባቢውን ዯህንነት ሇመቆጣጠር የወጣ ዯንብ
This Regulation may be cited as “The Safety,

በዚህ ዯንብ ውስጥ፣ የቃለ አገባብ ላሊ ትርጉም
ካሌተሰጠው በስተቀር፡- Article 2፡ Definitions
In this Regulation, unless the context otherwise
1) “አሰሪ” ማሇት ፕሮጀክት የሚከናወንሇት ሰው
requires:

2) “ሥራ ተቋራጭ” ማሇት ሠራተኞቹ የግንባታ 1) “Client” means a person for whom a project is

የሚያስተዲዴሩ፣ ወይም የግንባታ 2) “Contractor” means a person or an entity

whose employees undertake, carry out or
የሚያከናውን ወይም የሚያስተዲዴር፣ ዕቃ፣
manage construction work, or a person who

carries out or manages construction work for
ወይም አሰሪ ወይም ሥራውን ሇማከናወን
የራሱን ወይም የላሊውን ጉሌበት የሚጠቀም a fixed or other sum, and supplies materials,
ሰው ነው፡፡ labour or both, whether the contractor’s own
3) “የተከሇሇ ቦታ” ማሇት በባህሪው የተከሇሇ labour or that of another, to carry out the

34) “Person” means natural or artificial person.
35) “Competent person” means a professional
who is certified in relevant discipline by
legally recognized entity and has experience
in construction profession.
አንቀጽ ፫፡ የአፈጻጸም ወሰን
Article 3፡ Scope of Application
(፩) ይህ ዯንብ በፌዯራሌ፣ በክሌሌ እና በከተማ (1) This Regulation shall apply to a construction

(2) Subject to Sub article (1) of this provision, the

(a) a project prolongs more than a year, or

(a) may give directions to each person who

compliance by the project consultant
with the duties imposed by this
Regulation on the project consultant,
and
(b) shall confirm the directions in writing,
including a time frame for their
execution, if the project consultant
considers that the person to whom the
directions were given has not carried
out the directions.
(2) If, in the opinion of the project consultant for
the design process, a designer, contractor or
other relevant person has not carried out
directions confirmed in writing under sub
article (1) (b), the project consultant for the
design process shall notify in writing the
Authority, the client and the person to whom
the direction was given of the opinion of the
project consultant.
(3) The content of the notification to be delivered
in accordance with this provision shall be
determined by the directive as appropriate.

(a) cooperate with the project consultant

Article 15: Consultation
አንቀጽ ፲፭፡ ምክክር
The relevant contractor shall ensure consultation

(1) A contractor responsible for a construction

Article 20: Scaffoldings, Ladders and Hoists

contractor who has direct control over any

not collapse, overturn or move

sufficient strength and capacity for the

as to ensure, so far as is reasonably

(2) The contractor responsible for a scaffold on a

(3) Subject to sub article (2), the contractor

ማረጋገጥ አሇበት። (4) Sub article (3) shall not apply in relation to a
scaffold from no part of which a person is
(፬) ማንኛውም ሰው ከሁሇት ሜትር ወይም
liable to fall from a height of 2 meters or more.

(5) A report under Sub article (3) (b) of an
inspection of a scaffold shall be delivered

under Sub article (5) shall—

(a) at all times keep the report, or a copy

(b) at all reasonable times make that report or

requests to see it;

(7) The contractor responsible for a hoist and any

(8) The contractor responsible for any hoist which

part of it,
(ሐ) በዚህ አንቀጽ ንዑስ አንቀጽ (፪) (ሇ) (b) of those parts of it in the region of any

ሇግንባታ ቦታ ኃሊፊነት ያሇው ተቋራጭ፦ Article 38: Supervision and Execution of Shoring
(ሀ) በባህር ዲርቻ ዴጋፍ ወይም የቁፋሮ፣ and Other Works

ሻፍት፣ መሬት ሥራ፣ መሬት ውስጥ
ወይም ዋሻ ሥራዎች ዴጋፍ በአግባቡ
shall ensure for that site that,
መሠራቱንና መቆሙን፣
(a) shoring or other support for any part of
(ሇ) በንዑስ አንቀጽ (ሀ) በተገሇፀው መሠረት
an excavation, shaft, earthwork,
ሁለም ሇባህር ዲርቻ ወይም ሇላሊ ዴጋፍ
underground work or tunnel is not
የሚውለ ዕቃዎች ጥቅም ሊይ
ከመዋሊቸው በፊት ብቃት ባሇው ሰው erected, substantially added to, altered

(b) all material for shoring or other support
(ሐ) በማንኛውም መሌኩ ጉዴሇት ያሇበት as specified under (a) is inspected by a

competent person on each occasion
(መ) ሇቁፋሮ፣ ሻፍት፣ መሬት ሥራ፣ before being taken into use,
መሬት ውስጥ ወይም ዋሻ ክፍሌ ሥራ (c) material found defective in any respect
የባህር ዲርቻ ዴጋፍ ወይም ላሊ ዴጋፍ is not used,

is properly maintained, and

አንቀጽ ፴፱፡ በቁፋሮ ስራ ወቅት የመዋቅርን Article 39: Excavations Likely to Reduce Security

of a Structure
(፩) ሇግንባታ ቦታ ኃሊፊነት ያሇው ተቋራጭ

site shall not commence or continue, or allow
በሠራተኛ ወይም በላሊ ሰው ሊይ የሚዯርሰውን
to be commenced or continued on that site,
አዯጋ ሇመከሊከሌ በቂ እርምጃዎች ካሌወሰዯ
በስተቀር በዚያ ቦታ ሊይ ማንኛውም ሠራተኛ any excavation, shaft, earthwork,
ወይም ላሊ ሰው አዯጋ ሊይ ሉጥሌ የሚችሌ underground works or tunnel likely to
ቁፋሮ፣ ሻፍት፣ የአፈር ሥራ፣ የመሬት ውስጥ endanger any employee or other person at
ወይም ዋሻ ሥራ መጀመር ወይም መቀጠሌ work by reducing the security or stability of
ወይም እንዱጀምር ወይም እንዱቀጥሌ መፍቀዴ any part of any temporary or permanent
የሇበትም፡፡ structure, on or adjacent to the site, unless
adequate steps are taken, both before and
(፪) ተቋራጭ በማንኛውም ሰው ሊይ አዯጋን
during the progress of the work, to prevent

danger to the employee or other person from

of it.

እንዲይንሸራተት ወይም እንዲይወዴቅእና፣ (a) no excavation or part of an excavation
(ሐ) ማንም ሰው በሚንሸራተት ወይም
collapses;
በሚወዴቅ ማቴሪያሌ በቁፋሮ ውስጥ
(b) no material forming the walls or roof of,
እንዲይቀበር ወይም ታፍኖ እንዲይያዝ
or adjacent to, any excavation is
(፫) ተቋራጭ ማንኛውም ሰው፣ የሥራ መሣሪያ dislodged or falls; and
ወይም የቁስ ክምችት ወዯ ቁፋሮ እንዲይወዴቅ (c) no person is buried or trapped in an

መወሰዲቸውን ማረጋገጥ አሇበት።
(4) Suitable and sufficient steps must be taken,
(፭) በዚህ አንቀጽ ንዑስ አንቀፅ (፪) ሥር
where necessary, to prevent any part of an
ስሇቁፋሮ የተገሇፀዉ እንዯተጠበቀ ሆኖ የግንባታ
ሥራ መከናወን ያሇበት፡-
excavation or ground adjacent to it from
(ሀ) ቁፋሮው እና ዯህንነቱን ሉጎደ የሚችለ being overloaded by work equipment or

ማቴሪያልች ብቃት ባሇው ባሇሙያ፡- (5) Construction work must not be carried out in

work can be safely carried out there.

Article 41: Safeguarding Edges of Excavations

shall ensure that material is not placed or stacked
on the site near the edge of any excavation, shaft,
pit or opening in the ground where it is likely to
endanger persons at work below.
ክፍሌ ስዴስት PART SIX

ኮፈርዲም እና ካይሰን COFFERDAMS AND CAISSONS
አንቀጽ ፵፪፡ ግንባታ እና ጥገና
Article 42፡ Construction and Maintenance
(፩) ሇግንባታ ቦታ ኃሊፊነት ያሇው ተቋራጭ (1) A contractor responsible for a construction
ኮፈርዲም እና ካይሰን ሲሰራ፦ site shall ensure for that site that every
cofferdam or caisson and every part of one is,
(ሀ) ጥራቱን የጠበቀ ዱዛይን እና ግንባታ (a) of good design and construction,
መዘጋጀቱን፣ (b) of suitable, solid and sound material,
(c) free from patent defect,
(ሇ) ተስማሚ፣ ጠንካራ እና ጥራት ያሇው (d) of adequate strength, and
ማቴሪያሌ መጠቀሙን፣ (e) properly maintained.
(ሐ) ከፓተንት ጉዴሇት የጸዲ መሆኑን፣
site shall ensure for that site that every

cofferdam or caisson are appropriately

Article 45: Inspections and Examinations

Article 48: Fitness to Work and Supervision

examined and found fit for the work,
(ሇ) በታመቀ አየር ውስጥ የሚሠራው ሥራ (b) work in compressed air is carried out only

Article 49: Maximum Pressure and Records

Article 52: Compressions and Decompressions

(ሀ) በታመቀ አየር ውስጥ ሲሠራ ጉዲት

(4) After a shot is fired on a construction site, a

(a) ensure that no person enters within the
danger zone specified in the blast

(b) inspect the blast site to check the result of

Article 62: Prohibited Activities

(1) No person other than a person engaged in

ዴረስ የፍንዲታ ተቆጣጣሪ፣ ተኳሽ፣ the transport of explosives to or from a
ሠሌጣኝ ተኳሽ ወይም የተፈቀዯሇት ሰው construction site, a shotfirer, trainee shotfirer,
ካሌሆነ በስተቀር ላሊ ሰው ወዯ ፍንዲታ
ክሌለ መግባት እንዯማይችሌ እና፣ a person authorized to handle explosives at
the site or a person appointed to be in charge
(ሇ) ስሇ ተሳሳተው ፍንዲታ ተገቢ የሆነ
መረጃ ማስቀመጥ እንዲሇበት ማረጋገጥ of the explosives store shall handle
አሇበት። explosives at the site.
አንቀጽ ፷፪፡ የተከሇከለ ተግባራት (2) No person other than a shotfirer or a trainee
shot firer shall handle detonators at a

(a) bring any substance or article (other than

explosives) likely to cause an unintended

(b) except for the purpose of lighting an

(4) No person shall forcibly remove any

detonator lead, safety fuse or other system

(፯) ማንም ሰው፦

ADJACENT TO WATER
አንቀጽ ፷፫፡ በውሃ ማጓጓዝ Article 63፡ Transport by Water
(፩) ሥራ ተቋራጭ፦ A contractor responsible for a construction site

shall ensure for that site that
(ሀ) በውኃ ሊይ የሚጓጓዝ ሰው ዯህንነቱን
ሇመጠበቅ የሚያስችሌ ተገቢ እርምጃ እና (a) when any person at work is conveyed to
or from any place of work on water,
(ሇ) በዚህ አንቀጽ (ሀ) ስር የተመሇከተው proper measures are taken to provide for
ማጓጓዣ፦
the person’s safe transport, and
(i) በአግባቡ የተገነባ፣
(b) vessels used to convey persons as
described in (a) are—
(ii) ተገቢ ጥገና የተዯረገሇት፣ (i) of suitable construction,
(ii) properly maintained,
(iii) ብቃት ባሇው ሰው የሚዘወር እና (iii) in the charge of a competent person,
and
(iv) ያሌተጨናነቀና ከመጠን በሊይ
(iv) not overcrowded or overloaded.
ያሌተጫነ መሆኑን ማረጋገጥ
አሇበት፡፡
Article 64: Prevention of Drowning
አንቀጽ ፷፬፡ የመስጠም አዯጋን መከሊከሌ
(፩) ተቋራጭ በግንባታ ቦታ ሊይ ወይም አቅራቢያ site shall ensure that where, on or adjacent to
የሚያሰጥም ውኃ ካሇ፦ the site, there is water into which a person, in
(ሀ) ምቹ የህይወት አዴን መሣሪያ the course of his or her work, is liable to fall
አቅርቦት፣ ብቁና ዝግጁ መሆኑን፣ with risk of drowning,
(ሇ) የመስጠም አዯጋ ሊይ ያሇን ሰው ሇማዲን (a) suitable rescue equipment is provided and
የሚያስችሌ አዯረጃጅት መኖሩን፣ kept in an efficient state, ready for use,
(b) arrangements are made for the prompt

(ሐ) ጥራታቸው የተረጋገጠ የግሌ መዋኛና rescue of any such person who is in
መንሳፈፊያ መሣሪያዎች መኖራቸውንና danger of drowning, and
ሠራተኞች በሥራ ሰዓት መጠቀማቸውን (c) personal flotation devices conforming to
ማረጋገጥ አሇበት፡፡ the requisite standards or equivalent
standards, as appropriate, are provided
(፪) ተቋራጭ በዚህ አንቀጽ ንዑስ አንቀጽ (፩)
(ሐ) ስር የተጠቀሰ መሣሪያ፦
and worn at all times on the site.
(ሀ) በአግባቡ የተጠገነ፣ site shall ensure for that site that personal
(ሇ) ጥቅም ሊይ ከመዋለ በፊት ዯህንነቱ flotation devices provided in pursuance of

የተርጋገጠ፣ this Regulation are,
(ሐ) በአምራቹ መመሪያ መሠረት (a) properly maintained,

(c) inspected in accordance with the

every 12 months.

(3) On the day of a required inspection or

(d) are supported on a surface sufficiently

(1) A contractor is responsible for a construction

Article 86: Insurance
(፩) ተቋራጭ በራሱ ወይም በሠራተኛ፣ በወኪለ
(1) No person shall construct or cause to be

ሇሴቶች የተሇያየ የመታጠቢያ ገንዲ believing that the work to be undertaken on
ጥቅም ሊይ መዋለን፣ the site will not be completed within 12
months after its commencement, the contractor
(ሐ) በሥራው ባህሪ ወይም በጤና ምክንያት responsible for the site shall ensure that
አስፈሊጊ ሆኖ ከተገኘ በሥራ ሊይ ሊሇ washbasins are provided.
ሰው በቂና ተስማሚ የሆኑ ሻወር (3) A contractor responsible for a construction site
አገሌግልት መሰጠቱን፣
shall ensure for that site that,
(a) the washing facilities provided are
(መ) ሇወንድች እና ሇሴቶች የተሇያየ የሻወር
ክፍሌ መኖሩን እና፣ conveniently accessible from the
accommodation for taking meals and shall
(ሠ) በግንባታ ቦታ የሚሠራ ሰው ያሇምንም be adequately lighted, properly ventilated
እንቅፋት እንዱታጠብ ሇማስቻሌ የሻወር and kept in a clean and orderly condition,
ክፍለ ምቹና ሰፊ መሆኑን ማረጋገጥ (b) separate washbasins, or separate use of
አሇበት። washbasins for men and women are
provided, when so required for reasons of
አንቀጽ ፺፩፡ የንፅህና አጠባበቅ
propriety,
(፩) ተቋራጭ ሇግንባታ ቦታ አገሌግልት የሚሰጥ (c) suitable showers in sufficient numbers are
ቢያንስ አንዴ ተስማሚና በቀሊለ ተዯራሽ የሚሆን provided for persons at work if required by

(d) provision is made for separate shower

(e) The shower rooms are sufficiently large to

shall ensure for that site at least one suitable

accessible places.
ተቋራጭ የማረፊያ ቦታን በተመሇከተ፦ (2) The contractor shall furnish, install, and
maintain ample sanitary facilities for the
(ሀ) በቂ የንፅህና መጠበቂያ መሣሪያ፣
የእረፍት ክፍሌ እና የመዝናኛ ክፍሌ workers. As the needs arise, a sufficient

conveniently placed as required.

ሇግንባታ ቦታ ኃሊፊነት ያሇው ተቋራጭ፡-
Article 92: Accommodation Areas
(ሀ) በዚህ ክፍሌ ውስጥ የተመሇከተው
መገሌገያ በሚገኝበት ቦታ ዯህንነቱ A contractor responsible for a construction site
የተጠበቀና ተዯራሽ የሆነ የመግቢያ እና shall ensure that fixed living accommodation
መውጫ መንገዴ መዘጋጀቱን፣ areas on the site,
(ሇ) የአገሌግልት መስጫ ቦታው ሇሠራተኛ (a) have sufficient sanitary equipment, a rest
ዯህንነቱ የተጠበቀ ሆኖ መቅረቡን room and a leisure room,
ማረጋገጥ አሇበት። (b) are equipped with beds, cupboards, tables
and seats with backs, taking account of the
አንቀጽ ፺፬፡ ነፍሰጡር ሴት እና የምታጠባ እናት
number of persons at work, and
ሇግንባታ ቦታ ኃሊፊነት ያሇው ሥራ ተቋራጭ (c) are allocated taking account, where
በሥራ ሊይ ያለ ነፍሰ ጡር ሴቶችና አጥቢ appropriate, of the presence of persons of
እናቶች በላልች አግባብነት ባሊቸው ሕጎች both sexes.
በተዯነገገው መሠረት ተገቢ የሆኑ መገሌገያዎች
የተዘጋጀሊቸው መሆኑን ማረጋገጥ አሇበት። Article 93: Safe Access to Places where Facilities
are Provided
አንቀጽ ፺፭፡ የአካሌ ጉዲተኛ ሰው ዯህንነት
ሇግንባታ ቦታ ኃሊፊነት ያሇው ሥራ ተቋራጭ shall ensure for that site that—
በግንባታ ቦታ ሇሚሠራ አካሌ ጉዲተኛ ምቹ እና
ተዯራሽ የሆነ በር፣ መተሊሇፊያ መንገዴ፣ ዯረጃ፣ (a) safe means of access and egress are

መታጠቢያ፣ መታጠቢያ ገንዲ፣መጸዲጃ ቤት እና provided and maintained to and from
የሥራ ቦታ መኖሩን ማረጋገጥ አሇበት፡፡ every place at which any of the facilities
referred to in this Part are situated, and
(b) every such place is made safe and kept safe
for persons using the facilities.
Article 94: Pregnant Women and Nursing

Mothers

shall ensure that pregnant women and nursing
mothers at work on the site are provided with
appropriate facilities as set out in other relevant
legislation.
Article 95: Persons with Disabilities

shall ensure for that construction site that places
of work, where necessary, are organized to take
account of persons at work with disabilities, in
particular as regards doors, passageways,
staircases, showers, washbasins, lavatories and
work-stations used or occupied directly by those
persons.

ሌዩሌዩ ዴንጋጌዎች MISCELLANEOUS PROVISIONS
አንቀጽ ፺፮፡ የቁጥጥርና ክትትሌ ዘዳዎች
Article 96: Monitoring Safety, Health, Welfare
and Environmental Protection Measures
(፩) የፕሮጀክት ባሇቤት በጨረታ ወቅት ሥራ
ተቋራጭ በጨረታ ሰነደ ውስጥ የዯህንነት፣ (1) A project owner shall ensure that a contractor

ኃሊፊነቱን ያሌተወጣ ከሆነ በላሊ ሕግ የበሇጠ A person shall have the obligation to cooperate
ቅጣት ካሌተሰጠ በስተቀር ከሶስት እስከ አምስት for the implementation of the provisions of this

(፪) በዚህ አንቀጽ ንዑስ አንቀጽ (፩) Article 98: Breach of Duty
የተመሇከተው ጥሰት የተፈፀመው በቸሌተኝነት
(1) A designer or contractor or supervisor who
የሆነ እንዯሆነ፣ ቅጣቱ ከአንዴ ዓመት እስከ
intentionally violated a provision or discharge
አምስት ዓመት በሚዯርስ ጽኑ እሥራት እና
ከአሥር ሺህ ብር የማያንስ እና ከብር አንዴ መቶ his responsibility specified under this

Notwithstanding the following provision

Regulation and Directives issued pursuant to
ወይም ተፅዕኖ አይኖረውም፡፡
other Proclamations shall remain enforce, in so far
አንቀጽ ፻፩፡ መመሪያዎችን የማውጣት ሥሌጣን as they are not inconsistent with this Regulation.
ሚኒስቴሩ ሇዚህ ዯንብ አፈጻጸም አስፈሊጊ የሆኑ Article 100: Repealed and Applicable Laws
መመሪያዎችን ሉያወጣ ይችሊሌ።
No laws and practices shall, in so far as they are
አንቀፅ ፻፪፡ መመሪያው የሚፀናበት ቀን inconsistent with this Regulation, have force or
effect in respect of matters provided for in this
