MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS;

The MEMORANDUM OF AGREEMENT entered into this 6th day of JULY 2018
at Barangay Pogonsino, Municipally of Bagabag, Province of Nueva Vizcaya, by and
between,
The HON. JIMMY D. DADOY, Honorable Punong Barangay of Pogonsino,
Bagabag. Nueva Vizcaya, with the office of Purok 1, Barangay Pogonsino, Municipality
of Bagabag, Province of Nueva Vizcaya, herein after referred to as the "FIRST PARTY"
--And---
The LOT owner MRS. JACQUELINE A. ESTIMADA, Principal Pogonsino
Elementary School, Pogonsino, Bagabag, Nueva Vizcaya herein after referred to as the
"SECOND PARTY".
-WITNESS THAT-
WHEREAS, the Barangay Council is looking for a lot to be used as Materials
Recovery Facility (MRF) and Vermi-Composting Facility wherein the segregated wastes
are to be delivered/ transfer by tri-Bike garbage collectors;
WHEREAS, one of the stakeholders in our Barangay has a property at
Pogonsino Elementary School (POES) and is a vacant lot without occupancy
WHEREAS, the FIRST PARTY and the SECOND PARTY signed a
MEMORANDUM OF AGREEMENT USING THE Parcel of Land having an area of Fifty
(50) square meters more or less.

NOW THEREFORE, for in consideration of the foregoing premises, and the

terms and conditions hereunder enumerated. the Parties of this Agreement hereby
agree as follows:
1. The FIRST PARTY shall use the said Parcel of Land with an area of Fifty (50)
square meters more or less for as long as the FIRST PARTY will utilizing the
said area without prescribed number of years.
2. The FIRST PARTY shall use the said Parcel of Land with an area of Fifty (50)
square meters more or less for the Construction of Materials Recovery Facility
(MRF) and Construction of Vermi-Composting Facility and to utilize the lot for
planting plants and vegetables.
3. The SECOND PARTY granted and allowed the FIRST PARTY to use the said
Parcel of Land for the Construction of the said Project and to use the lot as long
as the Sangguniang Barangay will use this for the specific said project.

IN WITNESS WHEREOF, the parties hereto have set their hands at the
Barangay Pogonsino, Municipality of Bagabag, Province of Nueva Vizcaya, on this 6h
day of July 2018
