BILL 01 - GENERAL REQUIREMENTS & PRELIMINARIES

GENERALLY
The Bills Of Quanities shall be read in conjunction with NOTE

all other Tender Documents.
The Contractor shall be deemed to have examined the NOTE

Drawings and Specifications and Preambles to Work
Sections and allow here for the cost of compliance with
the provisions to the extent that such costs are not
included elsewhere in the Contract Lump Sum Fixed
Price Sectional Schedules.
The Contractor shall not be entitled to any claims NOTE

whatsoever for any increase in the Contract Price, or any
other compensation or remedies, and/or any extension
to the Time for Completion by reason of failure to
examine all the documents and satisfy himself of the
requirements necessary for the proper execution and
completion of the Works.
No alteration by the Contractor is to be made to the NOTE

tender documents unless authorised in writing by the
Construction Manager. Any unauthorised alteration
made will be ignored and the original text adhered to.
POSSESSION OF THE SITE
The Contractor is deemed to have inspected the Site ITEM

during the Tender period and has allowed for all existing
Site conditions as they may affect the Works. If in the
opinion of the Contractor existing conditions have
changed on taking possession of the Site and before
commencing work, the Contractor shall immediately
report the changes to the Employer. Thereafter, the
Contractor will be responsible for protecting the Works
from any damage whatsoever and repair of any damage
caused at his own expense.
SITE AND ACCESS
The Site of the Works is situated at Phu Tan Industrial ITEM

Park, Hoa Phu Ward, Binh Duong Province, Vietnam.
The Contractor shall meet with the Employer prior to
commencing the Works to understand the site handover
process and procedure and determine the full nature of
any restrictions, limitations and or pre-conditions for
gaining entry to the Site and proceeding with the Works.
Total Carried to Collection -
Prevent workpeople, including those employed by ITEM
Subcontractors, from trespassing on any part of the Site
not affected by the Works. If the Contractor wishes to
erect scaffolding or otherwise make use of adjoining land
or its airspace, he shall obtain written permission from
the Employer and clear away and make good any
damage at his own expense and pay all costs in
connection therewith.
Allow for forming any temporary crossovers and other NOTE
works necessary for entry to the Site, obtaining any way
leaves required and subsequently clearing away and
making good all works disturbed or damaged.
Temporary access for Contractor own works ITEM
The Contractor is advised to visit the Site and fully NOTE

acquaint himself as to the nature, extent and
practicability of the Works. He shall include in his Tender
for any costs in respect of any limitations imposed by the
Site as its surroundings.
Contractor has responsibility to protect his own works, NOTE

materials, equipment & plant during his construction time
on Site.
SAFETY
The Contractor shall ensure a safe working environment ITEM

on the Site at all times. All safety provisions shall be
properly maintained to the satisfaction of the Employer.
Without limiting the obligations, liabilities and NOTE

responsibilities, the Contractor shall effect Insurances
for:
Construction All Risk and Third Party Insurance as per ITEM
requirement
Worker's Compensation ITEM
Contractor’s Plant & Equipment ITEM
Any other insurance the Contractor deems necessary to ITEM

supplement the Construction All Risks insurance effected
by the Employer
The Contractor shall submit the proposed name of the NOTE

insurance company(ies) for consideration of the
Employer at the time of submission of this tender.
INSURANCES
The Contractor shall be responsible for any additional NOTE

premiums in connection with extending the period(s) of
insurance cover in the event that the Contractor fails to
complete the Works within the Time for Completion or
extended Time for Completion fixed in accordance with
the Conditions of Contract.
SETTING OUT AND CHECKING OF THE WORKS
The Contractor shall employ a professionally qualified ITEM

surveyor to set out the Works. Provide, maintain, protect
and reinstate reference pegs and marks as required by
the Employer for the duration of the Contract.
At completion of the Contract Works and before issue of NOTE

the Taking Over Certificate, execute a confirmatory
survey of the setting out of the Works (inclusive of any
underground services) and provide 04 copies of certified
survey plans to the Employer.
CONTRACTOR’S EQUIPMENT
Contractor is to allow mobilization of all necessary plant, ITEM

tools, equipment, etc., necessary for the proper
execution of the Works and demobilization of all these
equipments upon completion of Works.
SITE MANAGEMENT COSTS
The Contractor shall constantly keep upon the Works on ITEM

a full-time basis, the following key site personnel :
(1) A full-time Project Manager with proven management

experience who shall supervise plan & administrate all
works on site
(2) A full-time English Language speaking and writing

Site Manager with proven experience on all aspects of
the site works.
(3) A full time qualified safety supervison at all times the

Contractor is carrying out the Works
(4) Full time experienced QA/QC personnel to be

responsible in setting up and monitoring the quality of
the Works.
(5) Full time experienced Surveyor personnel to be

responsible in setting up and monitoring the level and
dimension of the Works.
(6) adequate foremen, assistances, site supervisors and

all necessary "back-up" staffs who are skilled, competent
and experienced in their respective callings.
OVERTIME
The Contractor shall include in his price for any costs ITEM
associated with overtime working necessary to complete
the Works the Time for Completion

24 Hours prior notification to the Employer shall be given ITEM
before overtime work is carried out. The Contractor shall
be responsible for any additional costs incurred by the
Employer if his attendance is required during overtime
hours.
TAXES AND CURRENCY FLUCTUATIONS

Include for all duties and taxes applicable to the entire ITEM
Works but excluded VAT
There shall be no adjustments whatsoever on the cost ITEM

and the expenses so included in consequence of any
directions and instructions ordered, addition, omission or
substitution of work, materials or goods for any price
fluctuations under the Contract.
TRANSFER OF PLANT, LABOUR AND MATERIALS

In the event of a delay occurring on one section of the ITEM
Works for any reason whatsover, the Contractor is to
transfer his plant, labour and materials as far as
practicable to another section of the Works so as not to
allow them to stand idle or cause delays.
If the Contractor fails to carry out a transfer when such a ITEM

step is considered reasonable and practicable by the
Engineer, no claim for extra payments or extension of
time will be entertained.
POLLUTION AND SITE HYGIENE

The Contractor shall ensure that site hygiene, shall ITEM
regularly remove construction rubbish and debris from
the site and shall ensure that his workforce maintain
hygienic habits. Consumption of food shall only be
allowed at designated locations and all food containers,
wrappers and food waste shall be properly disposed of.
The Contractor shall provide toilets and wash up facilities
Provide and maintain temporary channels, drains and NOTE

the like for keeping the Site clear of water.
Take all reasonable precautions to ensure the efficient NOTE

protection of all streams and waterways (if any) against
pollution arising out of or by reason of the execution of
the Works.
Where water is discharged into drains, silt traps, settling NOTE

tanks or other means of removing sediment are to be
used.
The Contractor shall not dump unwanted building debris, NOTE

chemicals, any noxious or polluting matter on any vacant
plot of land, roadside or drains thereby causing chokage
leading to mosquito breeding or causing contamination
of the Site or the drainage system.
Comply with and pay all charges levied by any NOTE
Government or Public Authority with jurisdiction on
matters of pollution or site hygiene.
REMOVAL OF RUBBISH
The Contractor shall arrange and pay all fees for ITEM
disposing of all rubbish, unwanted building debris, earth,
rubble, chemicals, noxious or polluting matter, etc. from
the site both at regular intervals and on completion.
SAFETY, HEALTH AND WELFARE OF WORKPEOPLE

The Contractor shall ensure that all welfare and safety ITEM
measures required under or by virtue of the provisions of
any enactment or regulation on conditions of
employment are fully complied with.
The Contractor shall provide for his employees on the NOTE

site and all persons visiting the Site with safety boots,
helmets, gloves, goggles, safety belts, railed gang-ways,
safety nets, and other safety equipments and comply in
full all the requirements laid down in the current Vietnam
or local Regulations.
WATER FOR THE WORKS

The Contractor to provide all necessary water for TBC
construction dand to be responsible for all lisences
required for water well construction . Location of well
shall be approved by the Engineer.
TEMPORARY LIGHTING AND POWER FOR THE

WORKS
Provide, install and maintain all necessary temporary ITEM
lighting during hours of darkness for construction, safety
or any other purpose.
All temporary electrical installation shall be carried out NOTE

under the responsibility of licensed electrical workers and
shall comply with the requirements of Vietnam and local
Regulations.
Pay all costs and charges in connection with temporary NOTE

lighting and power for the Works. Alter, shift and adapt
from time to time as necessary and clear away and make
good on completion of the Works.
TEMPORARY HOARDINGS
Contractor to provide temporary fencing to protect his Item
own works.
STORAGES
Provide and maintain any necessary watertight ITEM
temporary storage for Contractor’s tools, plant etc. Alter,
shift and adapt from time to time as necessary.
Storages used for the storage of cement, lime and other NOTE
perishable materials shall have raised floors.
All petroleum, explosives and flammable materials shall NOTE
be stored in fire-proof buildings and precautions taken
with regard to siting and fire risks.
SHOP DRAWINGS AND CO-ORDINATION DRAWINGS

The Contractor shall provide the Employer as required ITEM
with full and complete shop drawings.
No work shall be carried out until the relevant shop NOTE

drawings andor co-ordination drawings have been
approved. The approval of such drawings by the
Employer or delegated assistants, is solely an approval
of subject matters in principle and does not constitute
checking of detail measurements or acceptance of
auxiliary units or materials unless specifically mentioned
in writing by the Employer.
SHOP DRAWINGS AND CO-ORDINATION DRAWINGS
The Contractor shall not be relieved of his NOTE

responsibilities for executing the Works in accordance
with the Contract even though the shop drawings andor
co-ordination drawings have been approved by the
Employer or delegated assistants.
Shop drawings andor co-ordination drawings shall be NOTE

provided or revised as necessary for all variations to the
Works.
Required time to approve/ comment on shop drawings is NOTE

3 days
AS-BUILT DRAWINGS
As-built drawings shall be prepared and presented in a ITEM
format approved by the Employer.
The Contractor shall keep accurate records of the actual NOTE

formation levels throughout the contract period. This
information shall be submitted to the Employer and shall
form the basis of the as-built record of the completed
work.
Number of As-built drawings and Manual set is advised NOTE

by the Enginner : 7 sets.
Take colour photographs at weekly intervals and at NOTE

agreed locations to show the works in progress. Copies
of the photographs shall be provided to the Employer via
email with soft electronic copy marked dates and
necessary notes.
As-built drawings and Manuals must be submitted to the NOTE

Engineer at least 21 days prior to the Test on Completion
(or TOC Inspection Date)

FIRE PROTECTION DURING CONSTRUCTION
Provide and keep in working order adequate fire fighting ITEM
equipment for emergency use, to ensure compliance
with the Authorities' requirements.
CLEARING UP AND CLEANING

Upon completion of the Works and before the Employer ITEM
issues the Taking-Over Certificate the Contractor shall
dismantle and remove from the Site all goods,
equipment, temporary buildings and temporary works,
surplus materials and rubbish and make good all work
disturbed.
Before the Taking Over Certificate is issued the ITEM

Contractor shall clear, tidy and remove all spoil and
excess materials arising from the Works from the Site
and adjacent roads to the satisfaction of the Employer.
