Here are a few things to consider as you work on resolving this:

1. We used Amazon marketplace to sell our products as a Seller on Amazon.

2. We hired an account manager who could do the listing for us but instead of creating a
separate listings, he created an offer against an existing listing.
3. He copied the aforesaid ASINs and created offer against it, despite not acquiring invoices
from a verified supplier or any brand authorization letter, as per my understanding of the
listing process. But, I missed on the most important point that I cannot create without the
proper discussion offers against a private label branded product which has a registered
trademark.
4. Apart from that, Amazon system suspected that I have violated brand’s intellectual property.
Due to the acceptance of these complaints, Amazon system flagged my account and
suspended it as a precaution.
5. We failed to verify authorization with brand “WAHL, Catit” and “Petmate ” till
now or notify them of our intended Amazon sales prior to listing and selling
their products on Amazon India.
6. We also failed to respond to the IP and trademark violations in a timely
manner when we were first notified. WE NO LONGER DO THIS TYPE OF
SOURCING.
7. We sincerely believed that we were allowed to sell because there were
already a public listing and multiple sellers. Based on our understanding of
infringement and trademark it is when we use images, text, phrases,
symbols, or words that are federally registered to a specific product or brand
to make a sale that we make the infringement. While we did not create new
listings, we did joined already existing listings that had these symbols,
images, text, and words. We acknowledge that the brand owner is within his
or her right and we submit to their claim.
#### ACTIONS WE HAVE TAKEN TO RESOLVE THIS INFRINGEMENT

ISSUE
A. As soon as I received your email about the suspension my seller account, I went directly to
my performance notifications to find out what went wrong. I have carefully reviewed the
amazon guidelines, policies, terms and conditions regarding the products we can list and sell.
I am now fully aware that we can only sell authentic products on Amazon and failure to do so
may result in permanent closure of selling rights on Amazon. We cannot list a product for
which we do not have valid invoices from a verified supplier, letter of authorization or letter
agreement.
B. We have STOPPED selling items on Amazon that we bought but belongs
from the brands.
C. We removed all listings from our store for which we bought from any
unauthorized firm or supplier and we will not list any more items in the future
like this.
D. We have contacted the rights owners for all products to let them know that
we have complied with their request and removed the listing and asked them
to send a retraction notice to Amazon as early as possible.
E. Apart from that several buyers returned our products stating them to be inauthentic. When we
reviewed these returns, we found out that the product packaging boxes were damaged. This
could have led buyers to believe that the product is not being sent to them in authentic
packaging or poor packaging.

What went wrong - root causes of the problem:
 We acknowledge that the root cause of our ‘Late Shipment rate’ was a configuration
issue with our server that confirms shipments using Amazon Web Service XML
feeds.
 Due to insufficient monitoring of this server, this outage was not immediately noted.
In addition, because our order handling time was set to only 1-2 days this led to us
being unable to meet the our on time shipping target dates.
 We were still able to ship all orders during this period, but they were not immediately
confirmed as shipped in Seller Central. The customer therefore did not receive
tracking information, and our rating was adversely affected.
 In addition, we acknowledge we have had shortcomings with customer service
training, with inadequate daily checks of account health and monitoring of our order
queue in Seller Central. With such checks enforced we would have caught the issue
sooner.
What we have already done to resolve the problem:
 We immediately sent a new XML feed to confirm all the s hipped orders with USPS
tracking numbers. This triggered emails to the customer with their tracking numbers.
 We downloaded the list of affected orders from Seller Central, and checked every
one individually to confirm they were all shipped with valid tracking. They are all now
delivered.
 We have performed the necessary configuration change on our server so it can
continue to upload XML feeds without future errors.
 We are extending our shipping handling time from 1-2 days to 4 days to ensure
customers expectations are always fully met, and most customers will receive their
orders earlier than promised.
 We have observed that our late shipment rate for the past 10 days is already back
down to 0%, indicating that the underlying root cause has been addressed.
How will we prevent similar issues in future:
We are extending our shipping handling time from 1-2 days to 4 days to give time to
update tracking information within the expected time window. Our internal target will
continue to be 1 business day for all shipments.


Our warehouse manager will be checking daily with customer service for verbal
confirmation that there are no unshipped orders in the Seller Central queue before
the end of the business day.


We will continue to use the XML API to mark orders shipped within 15 minutes of
packing, and we have configured our software to email an administrator if it is ever
unable to upload an Amazon XML feed.


We will continue to offer refunds to any customers dissatisfied with any aspect of
their experience with our products and customer service before and after they
receive their order.


We will monitor our On Time Delivery Rate daily -


We will monitor our Late Shipment Rate daily -
We believe that above mentioned plan to change our daily procedures is sufficient to
address and prevent similar issues in future for our customers and to ensure our late
shipment rate remains under 4%. We hope to continue selling our products through
Amazon for many more years to come.

What actions will you be taking to prevent future complaints about the condition of

. After the listing (ASIN: …) is reinstated, I will correct color description to rose gold
instead of gold in the title, the bullet points, and the description. And also, I will retake
new photos to show its true color.
. I inspected quality of all existing inventory from all suppliers. I have disposed of
anything that could be considered used. Now the problem listing (ASIN: …) has no
inventory in FBA warehouse.
When the items are received, I check each item for correct sizes, correct colors,
manufacturer defects, damages that could have occurred during shipping from the
manufacturing facility, and matching product descriptions on the box.
All the items are placed in shaped forms which prevent the item from moving too
much and breaking during shipment. Fragile items are marked with a fragile sticker
on each side of the box to assure gentle handling.
. The current supplier seems not trustable. The supplier forgot to put date on the
invoice. And its website doesn’t work. I plan to order new and high quality makeup

I have a concern regarding to reactivate my listing which was

deactivated. We have received a notification and according to that
notification my some listings are being addressed in offering items
that may be inauthentic and condition based. As a result, My
Amazon selling account has been temporarily deactivated.

### Why product listing was done which was not approve to sell
1.We used Amazon marketplace to sell our products as a Seller on Amazon.
2.We hired an account manager who could do the listing for us but instead of creating a separate
listings, he created an offer against an existing listing.
3.He copied the aforesaid ASINs and created offer against it, despite not acquiring invoices from a
verified supplier or any brand authorization letter, as per my understanding of the listing process.
But, I missed on the most important point that I cannot create without the proper discussion offers
against a private label branded product which has a registered trademark.
4.Apart from that, Amazon system suspected that I have violated brand’s intellectual property. Due
to the acceptance of these complaints, Amazon system flagged my account and suspended it as a
precaution.
5.We failed to verify authorization with brand “PWR+”, “Uncaged Ergonomics”, “Yarrashop”,
“Verkstar” and “BONAOK” till now or notify them of our intended Amazon sales prior to listing and
selling their products on Amazon India.
6.We also failed to respond to the IP and trademark violations in a timely manner when we were
first notified. WE NO LONGER DO THIS TYPE OF SOURCING.
7.We sincerely believed that we were allowed to sell because there were already a public listing
and multiple sellers. Based on our understanding of infringement and trademark it is when we use
images, text, phrases, symbols, or words that are federally registered to a specific product or
brand to make a sale that we make the infringement. While we did not create new listings, we did
joined already existing listings that had these symbols, images, text, and words. We acknowledge
that the brand owner is within his or her right and we submit to their claim.
#### ACTIONS WE HAVE TAKEN TO RESOLVE THIS INFRINGEMENT ISSUE

A. As soon as I received your email about the suspension my seller account, I went directly to my
performance notifications to find out what went wrong. I have carefully reviewed the amazon
guidelines, policies, terms and conditions regarding the products we can list and sell. I am now
fully aware that we can only sell authentic products on Amazon and failure to do so may result in
permanent closure of selling rights on Amazon. We cannot list a product for which we do not have
valid invoices from a verified supplier, letter of authorization or letter agreement.
B. We have STOPPED selling items on Amazon that we bought but belongs from the brands.
C. We removed all listings from our store for which we bought from any unauthorized firm or
supplier and we will not list any more items in the future like this.
D. We have contacted the rights owners for all products to let them know that we have complied
with their request and removed the listing and asked them to send a retraction notice to Amazon
as early as possible.
E. Apart from that several buyers returned our products stating them to be inauthentic. When we
reviewed these returns, we found out that the product packaging boxes were damaged. This could
have led buyers to believe that the product is not being sent to them in authentic packaging or poor
packaging.
F. REMOVAL OF PRODUCTS FROM INVENTORY CONFIRMATION – We have already
removed these ASIN’s from our inventory which listings are violating the Amazon Anti-
Counterfeiting Policy of intellectual property violations. We have already reviewed the relevant help
pages which are relevant to counterfeit products on amazon.com on seller central.
### CLARIFICATION OF THE PRODUCT AUTHENTICITY - We know that The sale of counterfeit
products on Amazon is strictly prohibited.
