Problem Identified: Intellectual Property Rights Infringement.

Team, I understand that I have made few big mistakes in my business that had hurt sellers on
Amazon. I take complete responsibility for this happening, and apologize for the harm that
has been done to the Amazon brand through the poor experiences some sellers had.

Greater detail on the root cause(s) of the infringement.


 I also noticed that my listing staffs was mapping/listing products without
paying the required attention to the Intellectual Property or counterfeit rights
that could be infringed unintentionally by selling this item without the rights
owner permission.

 For some products I noticed that our employee was listing products without
paying the required attention to the Intellectual Property or Trademark
rights that could be infringed unintentionally by selling this item without
the rights owner permission. I was also out of station for few weeks so I was
not able to crosscheck each and every listing after being done by my account
manager.

 Also for some other products I have seen our newly hired listing staff
unawareness regarding IPR. I think being new to listing procedures he was
never communicated on the repercussions of mapping other standard
branded items listing.

 Also we have notice that our staffs were not properly trained to recognize
counterfeit items and they were unaware of the seriousness of this issue.

Team, I also accept my fault of being completely dependent upon my listing


staff for listing our products and didn’t paid required attention to the listings
done by the staff. I take complete responsibly of this happening and apologies
for the harm that has been done to Amazon.
Greater detail on the actions we have taken to resolve infringement issues.
Team, firstly I take complete responsibility for this happening, and apologize for the harm
that has been done to the Amazon brand through the poor experiences the some customers
had. Being a seller on amazon I understand that it’s my sole responsibility to keep abreast of
amazon policies and ACT PROACTIVELY on any of the issues.

a. I have deleted that ASIN which have received complaint from our inventory to
crosscheck them for any disorders and to verify all my suppliers for authorization letter or
agreement, in future also I will avoid mapping of other seller listing as much as possible.

b. Also we have communicated to the right owner and they have also retracted all the
complaints which we have received and in behave of that we are sharing the Case ID
and Retraction mail screen shot and suggest you to check and verify.

b. I have requested my SPN team to recheck each and every listing from their side. I have come
back from my business trip and in future also if I planned to take leave for long time (a week or
so) due to any purpose I will keep my account under holiday mode.

c. We have also apologized to them for this mistake but an suppose to be not make this type of
mistakes in future.

Greater detail on the steps we have taken to prevent infringement going forward.

a. We have gone through the information given in “Intellectual Property Violations” in Seller
Central Help link: https://sellercentral.amazon.com/gp/help/external/201361070 . We have
now gone through the topics such as “Policy Violation”, "Policies and Agreement”,
"Brand Infringement Policy (Design/Utility patent, Trademark & Copyright)”, "Trademark
Usage Guidelines”. We will strictly follow these Amazon guidelines to prevent any future
complaints regarding Infringement of intellectual property rights of others.

b. In future/after reinstatement we will deal in private label products listed under our own
brand name. We will be creating our own ASIN / Listings under our own TM brand to
ensure that our product is as per description. Listing under existing detail pages will be
done with absolute accuracy. New listings will be created keeping in mind Amazon listing
policies. This is to ensure no misrepresentation is done which may disappoint customers.

c. Our future inventory will consist of only private label products (men-women grooming
accessories, weighing scale & shoes). Also I have plans in place to opt for FBA services to
fulfil all my hot selling products via FBA only.

d. To avoid:
 Counterfeit/Patent (Design & Utility) Infringement: - I will avoid sourcing products
from local market suppliers or untrusted Sources. Also I will obtain a portfolio of
patents and other intellectual property rights before listing the product or mapping any
existing ASIN.

 Trademark Infringement: I will list my products under my own brand name and avoid
mapping at all costs. Also I will ensure that no other brand name or logo is present
anywhere (Title/Bulletpoints/Manufacture Info/Product Images) on my product PDP.

e. Most importantly we will ensure that we have invoices proper computerized invoices of each
and every product that we intent to sell on this marketplace no matter whether the product is
generic or branded or private label. For any other branded product that we source from supplier
we will always ensure that we have brand authorization letter of our supplier.

f. We are already taking help of Amazon SPN for personalized catalog based on our product;
this can be verified by checking the user permission of my account. I (Account owner) will
timely conduct listing audit with the help of my new SPN team to rectify all our listing
mistakes and to enhance our listings with more accurate/updated details.

g. Proper specification (Brand, Colour, model number, Title EAN etc) of our product along
with the images will be provided to them so that so that they can describe the product
exactly.

h. Although we will completely avoid listing or using the other brand products or brand names
in future still I have informed my listing staff that if ever he need to map product he have to
firstly use IP India to conform whether the brand name is registered or not. Also we will
properly match specifications of both the products and will only map if it is an exact match &
the listing are in compliance to all amazon policies and condition guidelines as well.

i. Listing under existing detail pages will be done with absolute accuracy. New listings
will be created keeping in mind Amazon listing policies. Any incorrect information on
detail page will be reported immediately to seller support requesting correction. This
is to ensure no misrepresentation is done which may disappoint customers.

j. We will compare or check every item physically to existing Amazon listings to ensure it is a
100% match to ensure that we don’t misclassify the condition of our marketplace in future.

k. For the product image we will properly check each image of the inventory and will
conform that they do not infringe the property rights, also for all future

listings we will consider only getting them catalogued instead of using any other online
portal images.

l. I myself has also gone through the seller university section properly to understand and
learn all the policies, condition guidelines and methods so that when needed we will be able
to list our products properly or while mapping any product we do not make any mistake and
map any incorrect listings.
m. Lastly, we have checked our policies and quality control measures; also, we have started to
train our staff to recognize the types of products or listing that can trigger an IPR infringement
and all other claims, so that I am not completely dependent on the third-party services. Also
before listing any products we will ask ourselves following questions:

Q1. Are the goods we are selling from a reputable distributor?


Q2. How did we acquire these goods, and will we be able to prove they are non-infringing
& authentic if the question arises?
Q3. Will the way we are describing these goods cause customer confusion (for example, would
something about our detail page for the generic product cause customers to believe they are
purchasing other branded product)?
Q4. Did we use a brand name or trademark in a non-confusing and truthful manner to
describe compatibility (generally allowed) instead of similarity (not allowed)?

And only after evaluating the answers for all the above questions we will list the products
for sale on this platform.

A few words

We truly understand that allegations of intellectual property infringement a serious matter and
it can cause legal actions too. Moreover the affected customers due to such violations are not
just ours they are amazon's customers too, and our carelessness can hamper amazon's image. As
a seller, our prime goal is to have a good deal with our customers and their satisfaction. We will
truly abide by each and every step mentioned above to prevent such issues going forward and
will maintain safe/trustable selling/shopping environment.
