Dear Amazon Seller Performance Team,

Thank you for providing us the opportunity to appeal our seller account’s suspension due to intellectual property
complaints. We have understood that Amazon takes complaints about violations of intellectual property rights
(Counterfeit without a test buy) of brands or owner’s rights very seriously and we would like to share our plan of
actions with you in order to explain what we have done to resolve the problem and what will we do to make sure
this problem will never occur in the future.

Please review our detailed plan of action below. We assure Amazon that we have fully implemented all of the
remedies in our plan to resolve and prevent any further Counterfeit without a test buy issues in the future.

– ROOT CAUSE(S) THAT LED TO THE VIOLATION Counterfeit without a test buy

First, we understand that Amazon prohibits the listing of products that violate intellectual ownership of trademark
owners and take full responsibility for the claims that we have received and that some of our listings have infringed
COUNTERFEIT.

WHAT HAPPENED

When Amazon suspended our account, we understood that we violated Amazon policies below;

How we violated Amazon Intellectual Property Policy (Counterfeit without a test buy);

We are buying our products directly to brand owners store but we didn’t take authorization.
Before listing products which one Amazon alerted us we didn’t take permission or we didn’t sign
agreement with owner of brands.

How we violated Amazon Anti-Counterfeiting Policy (Counterfeit without a test buy);

According to Amazon Anti-Counterfeiting Policy (Counterfeit without a test buy)

Products offered for sale on Amazon must be authentic. The sale of counterfeit products is strictly prohibited.
Failure to abide by this policy may result in loss of selling privileges, funds being withheld, and disposal of inventory
in our possession.

It is each seller’s and supplier’s responsibility to source, sells, and fulfills only authentic products. Prohibited
products include bootlegs, fakes, or pirated copies of products or content; products that have been illegally
replicated, reproduced, or manufactured; and products that infringe another party’s intellectual property rights. If
you sell or supply inauthentic products, we may immediately suspend or terminate your Amazon selling account
(and any related accounts) and dispose of any inauthentic products in our fulfillment centers at your expense. In
addition, we do not pay sellers until we are confident our customers have received the authentic products they
ordered. We may withhold payments if we determine that an Amazon account has been used to sell inauthentic

Before listing products we didn’t buy these products and we didn’t check products like;

Are the products in the correct packaging? Is there a UPC/EAN barcode? Type, color, brand, size etc. We
did not comply 100% with the controls. And we didn’t compare products are same or not with the original
products.

How was our listing method and Where we did mistake;

First of all, we would like to introduce our business model. Basically, we do dropshipping on Amazon.de We have
Amazon Bussiness buyer account on www.amazon.com and seller account on www.amazon.de We find proper
products according to policies of Amazon on www.amazon.com by our buyer account and those products come to
our warehouse first.

For the best seller products, we store them in our warehouse. When we receive the order, the products are
repackaged and ship to our customers via DHL Express or FedEx Express.

Also, we have used Amazon licensed software SellerRunning for product listings, pricing and stock updates. This
software are searching product from www.amazon.com.

The software had to check products have Trademarks, Critical Trademarks, Risky Words or not from authorized
trademark inquiry sites. but this program did not check for Trademark. We trusted this software and we didn’t
check products if they have trademark or not ourselves before listing.

Unfortunately, products that we found from another Amazon Seller’s list with this software infringed Trademark and
counterfeit infringement.

The program producer told us that also the program can check Trademark. We trusted them and we didn't check
our inventory for Trademark and counterfeit.

We understood that program filters don't work correctly when amazon alerted us. We failed to double check the
product’s information by ourselves after the filtering process and before listing in our seller account. Thus,
infringement occurred and we have violated Amazon Policies

Also, we didn’t checks we should do daily in our listing checks. Because I did not know that these products violate
Intellectual Property Rights. When Amazon suspended our account we saw that we violated intellectual property.

also we had to check products manually for they have trademark or not After listed products with software but We
didnt do our stuff. We didn’t do last controls about what we listed.

SUMMATION ABOUT OUR MISTAKES CHAIN

- Before listing products we didn’t read Amazon policies


- Before listing products we didn’t buy products and we didn’t check products are authentic or not.
- Before listing products we didn’t get any authorization letter and we didn’t ask their permission from owner of
brands
- Before listing products we didn’t check any product for they have trademark or not.
- We used program for listing products. We didn’t control any product which program found. We listed products
directly with program.
- We did not perform the checks Amazon requested from us

We are taking full responsibility of our action

– ON THE ACTIONS WE HAVE TAKEN TO REOLVE THE COUNTERFEIT VIOLATION

We checked our inventory and We have removed roducts from our storefront which we are NOT the registered
rights owner and holder of trademark. Also we removed products which one we don’t have documents or we are
not sure products are authenticity or not.

We have cross referenced our listings against Amazons guidelines and listing policies to ensure that our products
are 100% compliant.

We tried to reach brand owners by via email for apologize to them. But they didn’t reply. We will keep to continue
for contact them

Me and my employee read the Intellectual Property Policy on July 17, 2021 to prevent any violation of the
Intellectual Property Policies (Trademark and Copyright).

I would like to state that we fully understand the Intellectual Property Rights.

AMAZON ANTİ-COUNTERFEİTİNG POLİCY

We have read Amazon Anti-Counterfeiting on July 18, 2021 Policy and know accordingly;

Me and my employee complied with the Policies by reading the Amazon policies three times a week and doing
these steps.

The products we will sell on Amazon are original. The sale of counterfeit products is strictly prohibited.

I purchased the items we purchased to sell on the Amazon.co.uk Store directly from the Brand's website.

We have verified the existence of our supplier's contact information, including name, phone number, address,
email and website for Brand products we have purchased and will sell soon.

I also provided UPC/AEN barcode checks to ensure the authenticity of the products we will sell in our stocks in the
future.

While doing these checks (https://gepir.gs1.org/index.php/search-by-gtin), I questioned the accuracy of the


company information we encountered by querying the barcode number from this site.

By following the steps here;

Prohibited products include smuggled, counterfeit or illegally reproduced, reproduced or manufactured products
of the product or content; and products that infringe another party's intellectual property rights.
I made sure it wasn't.

I have made sure of the originality of the products we will sell in our future inventory.

Me and my employee studied and watched in vendor university.

It was a total of 8 hours of work.

Suspends our account to protect the safety of Amazon Customers and Trademark and avoid Complaints.

To check the authenticity of some of the products we List or Sell, Amazon requires a Vendor Invoice or Proof of
Entitlement issued within the last 365 days.

I sent the invoice of the products I sold. However, since I did not send these products with an intermediate
warehouse, I could not be 100% sure of their authenticity. I was disabled on the Amazon Seller Platform because
we did not send the Outer Packaging, labeling and packing slip on behalf of our company.

We have removed all branded products listed so far without an Invoice or Proof of Entitlement from our inventory
list and deactivate the remaining inventory.

The UPC/AEN barcodes of the products we will sell are checked on this website

The products are sent to our warehouse after making sure of their authenticity.

Our products are packaged and shipped according to amazon policy.

(Oneamz House) is sent to our contracted warehouse.

Unfortunately, we do not have any invoice for the products which are subject to TRADEMARK, COUNTERFEIT
violation because they were not sold nor came to our storage. Yes we listed these asins but we didn’t sell before.

After our account has been deactivated we understood that we don't have enough knowledge about Amazon
policies, trademark, counterfeit, design rights, and patent infringement. We understood that we had to educate
ourselves. We agreed with the law firm to educate to ourselves. We started to education program immediately

The law firm has developed a monthly seminar program entitled, “Laws, Changes in Regulations, Amazon Policies
and COUNTERFEIT Trainings will continue as long as we sell on amazon. All our team has to complete training
and undergo continuing education.

After started to education what did we do?

1- We deleted our all listing.


2- We stopped to use software for listing products.
3- For caring trademark and counterfeit, we created employment. One of our team members will work with the
law firm on the whole brand approval process and she/he will be researching all sources about
TRADEMARK

How we will list our new products

1- Our team members are going to list our own products manually. Before listing new products we will
complete our investigation about our new products and new suppliers. We will list our new products if
products 100% suitable according to Amazon policies. We are going to take pictures of items that are
ready for listing. By using pictures, we are going to create our listing. When we select a category for our
lists, we will make sure we have learned the specific requirements and rules for selling in that category.
When we doubt that it will violate trademark, design rights, patent rights, we will avoid listing the product to
avoid trademark, design rights and patent rights infringement.
2- When we are creating a new listing on Amazon, we will not determine the ASIN to list under by the photos.
Instead, we will use the UPC of the item to ensure we are listing under the correct ASIN that we have
approval by the brand owner to sell.
3- Before listing any new products on Amazon, we will verify that the products or listings don’t violate
anyone’s intellectual property, trademark design right, patent infringement using websites below

How we will check new supplier and products

1- We will verify each authorized distributor to make sure we obtain authorized items on Amazon
Marketplace. If our new supplier is a manufacturer we will ask brand registry and quality documents. We
will sign an agreement for we are authorized seller for their products.
2- Before purchasing with a distributor with the intent to resell an item on Amazon, we will reach out directly to
the brand owner and obtain a written authorization to resell the item in question. We will present to amazon
these documents the next time if Amazon would ask for them.
As we are not brand owners, we will provide a complete set of documents, including an authorization letter,
to prove a valid supply chain.
3- We will verify the authenticity of the products that you source. We will check UPC/EAN barcode
(https://gepir.gs1.org/index.php/search-by-gtin). We will check Type, color, brand, size etc. We will
compare products design, color, package from manufacturer web sites. If we need more information we will
contact directly to manufacturer.
4- We will take time to check the products that we source before we sell them to ensure that the product and
all associated parts work as expected and are free of any damage.
5- We will keep all documents and records of transactions, such as POs and invoices establishing that you
sourced products from reliable suppliers. If Amazon want to verify our suppliers or products we will provide
complete documentation set.
6- We will verify that the products we sell are safe. We will take time to research whether there are any safety
testing or compliance requirements for the products that we sell. We will take safety documents directly
from manufacturer.
7- We will be contacting Amazon for each potential item of brands before we transfer them to our online store.
That will help us to prevent inauthentic product complaints.
8- If we receive multiple warnings of intellectual property infringement and we believe we are selling authentic
products, we will appeal via your Seller Central account with invoices and an authorization letter proving
the authenticity of our products.
9- We will be more proactive about our Seller metrics and monitor them constantly to make them are on target
with Amazon guidelines.
10- We will continue sourcing all our inventory directly from the manufacturers.
