5) 마이클 샌델(Michael J. Sandel)은 수차례 한국을 방문하여 대중을 상대로 한
강연을 진행한 바 있다. 2014년 12월에 ‘정의, 시장 그리고 좋은 사회’(Justice,
Markets and the Good Society)라는 주제로 열린 「제3회 숭실석좌강좌」에서도
그는 예의 트롤리 딜레마를 언급하여 강연의 문을 열었다. 1,700여명의 청중이
함께 한 그 자리에는 필자도 있었다. 샌델 교수의 강연을 들으며 필자는 이 문
제를 우리 형법에 대입하여 본다면 어떤 결론이 날 것인지에 대해 잠시 생각했
다. 최근 자율주행자동차를 둘러싼 윤리적 딜레마가 우리 사회에서 회자되는
것을 보며 필자는 그때 생각했던 바를 짧게나마 글로 옮겨 정리해 둘 필요성을
느끼게 되었다. 이 원고는 그 소박한 작업의 소산(所産)이다.

데에 그친다. 실행행위와 구성요건적 결과 사이에 어떠한 관계가 있을 때에 인
과관계가 있다고 볼 것인지에 대해 제17조는 별다른 내용을 담고 있지 않다.
인과관계의 주요한 내용이 오롯이 판례와 학설에 맡겨져 있는 것이다.

이번에는 사안의 내용을 바꿔, 기관사가 전차의 진로를 바꾸지 않았다고 가정해
보자. 전차는 그대로 본선을 질주하여 다섯 사람을 치어 사망케 했다. 사람이 사망하
였다는 것은 살인죄의 구성요건에 해당할 만한 결과이다. 그 결과를 귀속시킬 수
있는 앞선 행위를 찾아 이를 결과에 대한 원인으로 설정하는 것이 바로 인과관계의
판단이다. 형법상 인과관계의 판단에서는 제17조의 규정에 따라 어떤 행위가 “죄의
요소되는 위험발생에 연결”되는지를 확정하는 작업이 필요하다. 동조는 작위・부작
위를 불문하고 모든 행위가 범죄의 구성요건적 결과를 초래할 만한 위험발생에 연결
될 것을 요구하고 있다. 제17조의 “어떤 행위”라고 하는 문구는 별달리 작위와 부작
위의 구별을 예정하고 있지 않다. 그러므로 당연한 말이지만, 인과관계의 기점(起點)
이 될 살인죄의 실행행위에는 작위뿐 아니라 부작위도 포함된다.

그렇게 움직이도록 명령을 입력한 사람도 무죄가 되어야 한다. 자율주행차가 선회를
하든 직진을 하든 그렇게 알고리즘을 짠 제조사는 기대불가능성의 이론을 주장하여
법원을 설득해야 할 것이다. 기대가능성 이론이 적용될 단 한 가지 영역을 꼽으라면,
이처럼 행위자가 어떻게 행동해도 위법행위를 범할 수밖에 없는 딜레마 상황을 들
수 있으리라고 생각한다.

There is a trolley that runs over the railroad. The brakes of the trolley are broken
and the trolley cannot stop. There are five workers standing in the direction of the
trolley. If unstopped, the trolley will hit and kill these five people. If the driver turns
the trolley to the emergency rail, the five workers can live. However, there is another
worker standing on the emergency rail. If the trolley changes the direction, one person
dies. What choice could the driver make to avoid criminal liability?
Over the past decades, several theories have been put forward in various disciplines
as to what choices should humans make in this trolley problem. Recently, as
technology for autonomous driving has continued to develop, a new dilemma
surrounding it has emerged. Its contents are based on the trolley dilemma. The core
of the controversy is to which direction should the self-driving car turn if several
pedestrians were to suddenly jump in front of the car. Should the self-driving car
still turn its course, even if hitting a pedestrian on a sidewalk is inevitable? Is it
right for an automaker to use an artificial intelligence algorithm to make self-driving
cars sacrifice a single pedestrian?
In order to find the answer to this question, this study first considered the criminal
conclusions on the trolley dilemma. The act of the driver changing the direction of
the trolley was seen as a commission, whereas not changing the direction was seen
as an omission. A commission takes one person’s life, whereas an omission takes
five people’s lives. It should be considered which judgment such acts and outcome
will result in at court. The conclusion was that no matter the direction of the trolley,
the driver cannot be convicted. The driver's act cannot be a necessity regardless of
whether the trolley’s direction is changed or not. Therefore, the driver's act is judged
to be illegal. If one cannot act without violating any law, then the driver has been
put in a situation where one cannot expect a lawful conduct in the first place. Actors
who have no room for lawful conduct should not be held liable for criminal offenses.
Therefore, it is expected that the driver will be acquitted of innocence, regardless
of acts of commission or omission.
If an act of a person results in innocence, the person who entered the order for
the self-driving car to move as such should also be acquitted. Whether the self-driving
car turns or goes straight, the manufacturer of such algorithms will have to plead
innocent by claiming inexigibility.
