የመንገድ ትራንስፖርት አዋጅ ROAD TRANSPORT PROCLAMATION

ለሀገራችን ኢኮኖሚያዊና ማህበራዊ ዕድገት WHEREAS, the economic and social

የመንገድ ትራንስፖርት አገልግሎት የሚያበረክተውን development of the country requires that road

እንዲራመድ ማድረግ አስፈላጊ በመሆኑ፣

የመንገድ ትራንስፖርት አስተዳደር የመንግሥትን WHEREAS, it is necessary to ensure that

የኢኮኖሚና ማህበራዊ ጉዳዮች ፖሊሲ በአግባቡ the administration of road transport properly
ለመተግበር፤ የመንገድ ትራስፖርት እስከታችኛው implements the government’s economic and

የሀገራችን መዋቅር ድረስ ጠንካራ አፈጻጸምና የቁጥጥር social affairs policies; ensure that there is a

ሥርዓት እንዲኖር ለማድረግና የመንገድ ትራስፖርት strong enforcement and monitoring system in

ዘርፉን በቴክኖሎጂ ተደግፎ ተደራሽና አስተማማኝ the road transport up to the lower

እንዲሆን ለማድረግ የሚያስችል ሥልጣንና ተግባር administrative level; and ensure that the road

በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ NOW, THERFORE, in accordance with

ሕገ-መንግሥት አንቀጽ ፶፭(፩) መሠረት የሚከተለው Article 55(1) of the Constitution of the Federal

ክፍል አንድ PART ONE

ጠቅላላ ድንጋጌዎች GENERAL PROVISIONS

፩. አጭር ርዕስ 1. Short Title

ይህ አዋጅ “የመንገድ ትራንስፖርት አዋጅ ቁጥር This Proclamation may be cited as the "Road
፩ሺ፪፻፸፬/፪ሺ፲፬” ተብሎ ሊጠቀስ ይችላል፡፡ Transport Proclamation No. 1274/2022".

፪. ትርጓሜ 2. Definition

የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ In this Proclamation, unless the context

በስተቀር በዚህ አዋጅ ውስጥ፡- requires otherwise:

፩/ “ሚኒስቴር” ወይም “ሚኒስትር” ማለት እንደ 1/ "Minster" or "Ministry" means the

ቅደም ተከተሉ የትራንስፖርትና ሎጂስቲክስ

Minister or Ministry of Transport and
Logistics, respectively;
ሚኒስቴር ወይም ሚኒስትር ነው፤

2/ "Enterprise" means a legal person

፪/ “ድርጅት” ማለት በንግድ የመንገድ
engaged in commercial road transport
ትራንስፖርት አገልግሎት ሥራ ላይ
service as established in accordance with
ለመሰማራት በኢትዮጵያ የንግድ ሕግ
the Ethiopian Commercial Code and
መሠረት የተቋቋመ እና በዚህ አዋጅ መሠረት
registered in accordance with this
የተመዘገበ የሕግ ሰውነት ያለው አካል ነው፤

፫/ “ተቋም“ ማለት በትራንስፖርት ዘርፍ የተሰማራ 3/ "Institution" means any governmental or

፬/ “የመንገድ ትራንስፖርት” ማለት ለዚህ አዋጅ 4/ “Road Transport” means for the

ስፍራ የማጓጓዝ አገልግሎት ሲሆን የባቡር departure to point of destination using

፭/ “የመንገድ ትራንስፖርት አገልግሎት” ማለት 5/ "Road Transport Service" means the

በግለሰብ ወይም በድርጅት የሚከናወንና service of transporting of passengers or
መንገደኞችን ወይም ዕቃዎችን በክፍያ goods with remuneration by natural or

ተብሎ ተለይቷል፡- transport as follows:

ሀ) “የግል ንግድ የመንገድ ትራንስፖርት” a) "Private Commercial Road

ማለት መንገደኞችን ወይም ዕቃዎችን Transport" means if the vehicle used

የሚያመላልሰው ተሽከርካሪ ንብረትነቱ

for carrying passengers or goods is
owned by the enterprise, and
የድርጅት ሆኖ፤

(1) የሚመላለሱት ዕቃዎች የዚያው (i) in the case of goods being

(2) የሚመላለሱት መንገደኞች የዚያው (ii) in the case of passengers being

ድርጅት ሠራተኞች ሆነው transported, the passengers are
የሚመላለሱትም ወደ ሥራ employees of the enterprise and
ቦታቸውና ከሥራ ቦታቸው የሆነ are being transported to or from
ወይም የድርጅቱን ሥራ their place of work or are

enterprise;

ለ) “የንግድ የመንገድ ትራንስፖርት” ማለት b) "General Commercial Road

ከከተማ ታክሲ በስተቀር የግል ተብሎ Transport" means except the city taxi all
ያልተመደበ ማንኛውም የንግድ commercial road transport not classified
የመንገድ ትራንስፖርት አገልግሎት as private;

6/ “Business Entity” means for the purpose

፮/ “የንግድ ማህበር” ማለት ለዚህ አዋጅ አፈጻጸም
of this Proclamation any person or
አግባብነት ባላቸው የኢትዮጵያ የንግድ ሕጎች
enterprise registered as trader in
መሠረት የንግድ ሥራ ለማከናወን ሥልጣን
accordance with the applicable
ባለው አካል የተመዘገበና የትራንስፖርት
commercials laws of Ethiopia and is
ንግድ ሥራ እንዲያከናውን የሚያስችለው
issued with a transport trade license from
የንግድ ፈቃድ የተሰጠው ግለሰብ ወይም
the competent authority;
ድርጅት ነው፤

7/ "Disciplinary Manual" means a

፯/ “የዲስፕሊን መመሪያ” ማለት በሚኒስቴሩ የወጣ

፰/ “አውራ ጎዳና” ማለት የኢትዮጵያ መንገዶች

8/ "Highway" means a road administered
አስተዳደር የሚያስተዳድረውና አውራ ጎዳና
and designated as such by the Ethiopian
ብሎ የሚሰይመው መንገድ ነው፤

፱/ “የስምሪት ፕሮግራም” ማለት የሕዝብ

9/ "Trip Schedule" means yearly, monthly,
ማመላለሻ ተሽከርካሪዎችን የዓመት፤ የወር፤
weekly or daily program scheduled for
የሳምንት ወይም የቀን አገልግሎትና
the operation of public commercial road
እንቅስቃሴ የሚወስን የስምሪት መርሃ-ግብር transport vehicles;
ነው፤

፲/ “የመንገድ ተጠቃሚ” ማለት አሽከርካሪ፣ 10/“Road User” means a driver, bicycle

የብስክሌት አሽከርካሪ ወይም የመንገድ rider and a person using a road transport
ትራንስፖርት ተገልጋይ ሲሆን እግረኛን service; and includes pedestrian;
ይጨምራል፤
11/“Driver” means a natural person issued
፲፩/ “አሽከርካሪ” ማለት አግባብነት ባለው የመንገድ with a valid driving permit from a

ትራንስፖርት ሕግ መሠረት ተሸከርካሪን competent authority for operating a

፲፪/ “የስምሪት መስመር“ ማለት በሚኒስቴሩ 12/ "Assigned Route" means the specific
የሚወሰን የሕዝብ ማመላለሻ ተሸከርካሪ departure and destination point to be

፲፫/ “መንገደኛ” ማለት በተሽከርካሪ ተሳፍሮ 13/"Passenger" means any person boarding
የሚሄድ ማንኛውም ሰው ሲሆን for travel in a vehicle, other than the
አሽከርካሪውን፤ ገንዘብ ተቀባዩንና driver, cashier or any other person
በተሽከርካሪው ላይ የተመደበ ማንኛውንም assigned to work on a vehicle;
ሌላ ሠራተኛን አይጨምርም፤

14/"Supervision" means ascertaining of the

፲፬/ “ቁጥጥር” ማለት በዚህ አዋጅ፤ በአዋጁ

ደረጃዎች እና ውሳኔዎች በትክክል በሥራ
Directives, Standards and decisions
ላይ መዋላቸውን የማረጋገጥ ተግባር ነው፤
issued in accordance with this
Proclamation;

፲፭/ “ተቆጣጣሪ” ማለት የቁጥጥር ተግባሮችን 15/"Supervisor" means an employee

እንዲያከናውን በማናቸውም የኢትዮጵያ assigned by the Ministry to execute
ክፍል በሚኒስቴሩ የሚመደብ ሠራተኛ ነው፤ supervisory activities in any part of
Ethiopia.

፲፮/ “መንገድ“ ማለት በተለምዶ ተሸከርካሪዎች 16/"Road" means any road, street, highway
የሚጠቀሙበት ማንኛውም መንገድ፤ የከተማ or other travel route customarily used by
መንገድ፤ አውራ ጎዳና ወይም መተላለፊያ vehicles including bridges;
ሲሆን ድልድይንም ይጨምራል፤

፲፯/ “ተሽከርካሪ” ማለት ልዩ ወታደራዊ 17/"Vehicle" means any type of wheeled

ተሽከርካሪዎችን ሳይጨምር በመንገድ ላይ vehicle other than specialized military

በመንኮራኩር የሚሄድ ማንኛውም ዓይነት

vehicle; and includes wagons, cycles,
motorized vehicles, semi-trailers and
ተሽከርካሪ ሆኖ ሠረገላን፣ ሳይክልን፣
trailers;
ባለሞተር ተሽከርካሪን፣ ግማሽ ተሳቢን እና
ተሳቢን ያጠቃልላል፤

፲፰/ “ሠረገላ” ማለት ከብስክሌት፣ ከባለሞተር 18/"Wagon" means any vehicle other than a
ተሽከርካሪ፣ ከግማሽ ተሳቢ እና ከተሳቢ bicycle, a motorized vehicle, a semi-
በስተቀር ማንኛውም ተሽከርካሪ ነው፤ trailer or a trailer;

፲፱/ “ብስክሌት” ማለት በሚያሽከረክረው ሰው 19/"Cycle" means a pedaled vehicle with

፳/ “ባለሞተር ተሽከርካሪ” ማለት በመካኒካል 20/"Motor Vehicle" means a vehicle

ወይም በኤሌክትሪክ ኃይል እየተንቀሳቀሰ moving by mechanical or electrical
የሚሄድ ተሽከርካሪ ሆኖ የጭነት ማመላለሻ power; and is classified as truck,
ተሽከርካሪ፣ ባለሞተር ብስክሌት፣ የግል motorcycle, private motor car, public
አውቶሞቢል፣ የሕዝብ ማመላለሻ ተሽከርካሪ፣ service vehicle, truck tractor and special
ጎታች መኪና እና ልዩ ተንቀሳቃሽ መሣሪያን mobile equipment;
ያጠቃልላል፤

፳፩/ “የጭነት ማመላለሻ ተሽከርካሪ” ማለት 21/"Truck" means a motor vehicle made or
ማንኛውንም ዓይነት ዕቃ እንዲያመላልስ adapted for the conveyance of goods or
ተብሎ የተሠራና ለዚሁ አገልግሎት used primarily for the conveyance of
እንዲውል የተደረገ ባለሞተር ተሽከርካሪ goods of any description; and includes a
ሲሆን ጎታች መኪናን ይጨምራል፤ truck tractor;

፳፪/ “ባለሞተር ብስክሌት” ማለት የጎን 22/"Motorcycle" means a motor vehicle

ተሽከርካሪውን ሳይጨምር ክብደቱ ከ፬፻ ኪሎ with less than 4 (four) wheels, the weight
ግራም የማይበልጥ ፬(ከአራት) መንኮራኩር of which, exclusive of any side-car
በታች ያለው ባለሞተር ተሽከርካሪ ነው፤ attached thereto, does not, when unladed,
exceed 400 kilograms;

፳፫/ “የግል ተሽከርካሪ” ማለት ከጭነት ማመላለሻ 23/"Private Vehicle" means a motor vehicle
ተሽከርካሪ፣ ከባለሞተር ብስክሌት፣ ከሕዝብ used for private service exclusive of a
ማመላለሻ ተሽከርካሪ፣ ከጎታች መኪና እና truck, a motorcycle, a public service
ከልዩ ተንቀሳቃሽ መሣሪያ የተለየ ለግል vehicle, a truck tractor and special
መጠቀሚያ የሚውል ባለሞተር ተሽከርካሪ mobile equipment;

፳፬/ “የሕዝብ ማመላለሻ ተሽከርካሪ” ማለት 24/"Public Transport Vehicle" means a

መንገደኞችን ለማመላለስ የሚያገለግል motor vehicle used to carry passengers;
ባለሞተር ተሽከርካሪ ሲሆን የንግድ and includes commercial motor car and
አውቶሞቢልና አውቶቡስን ያጠቃልላል፤ motor omnibus;

፳፭/ “የንግድ አውቶሞቢል” ማለት ከአስራ ሁለት 25/"Commercial Motor Car" means a
የማይበልጡ መንገደኞችን ለማመላለስ public transport service vehicle having
የሚችል የሕዝብ ትራንስፖርት አገልግሎት accommodation for not more than twelve
ማመላለሻ ተሽከርካሪ ነው፤ passengers;

፳፮/ “አውቶቡስ“ ማለት የታክሲ አገልግሎት 26/"Motor Omnibus" means a public

ከሚሰጡት በስተቀር ከአስራ ሁለት service vehicle other than vehicles

መንገደኞች በላይ ለማመላለስ የሚችል engaged in taxi service; and having a seat

የሕዝብ ማመላለሻ ተሽከርካሪ ነው፤ accommodation for more than twelve

passengers;

፳፯/ “ጎታች መኪና” ማለት በተለይ ሌሎች 27/"Truck Tractor" means a motor vehicle
ተሽከርካሪዎችን ለመጎተት የሚያገለግል ሆኖ made or adapted for drawing other
የሌላ ጭነትን ሳይሆን የሚጎትተውን vehicles, and so constructed as to carry
ተሽከርካሪና በተጎታቹ ላይ ያለውን ጭነት no load other than part of the weight of
ክብደት ብቻ በከፊል ለመሸከም የተሠራ the vehicle and the load thereon;
ባለሞተር ተሽከርካሪ ነው፤

፳፰/ “ልዩ ተንቀሳቃሽ መሣሪያ” ማለት ሰውን 28/"Special Mobile Equipment" means any
motor vehicle designed, made, adapted or
ወይም ዕቃን በመንገድ ላይ እንዲያመላልስ
used for agricultural, horticultural,
ሆኖ የተሠራ ተሽከርካሪ ሳይሆን ለእርሻ፣
livestock, road construction, building,
ለአትክልት፣ ለከብት እርባታ፣ ለመንገድ፣
digging or any other similar purposes in
ለሕንፃ፣ ለቁፋሮ ወይም ለማንኛውም
exclusion of vehicles designed, adapted
ተመሳሳይ ሌላ ሥራ የተሠራ ወይም ለዚሁ
or used for the transportation of persons
ጉዳይ እንዲውል የተደረገ ባለሞተር
or goods;
ተሽከርካሪ ነው፤

፳፱/ “ግማሽ ተሳቢ” ማለት ለመንገደኞች ወይም 29/"Semi-Trailer" means a vehicle

ለጭነት ማመላለሻ የሚያገለግልና በሌላ designed or adapted for carrying
ባለሞተር ተሽከርካሪ የሚሳብ ሆኖ passengers or goods; and so constructed
የተሽከርካሪውም የጭነቱም ክብደት በከፊል as to be drawn by a motor vehicle that
በባለሞተር ተሽከርካሪው ላይ እንዲያርፍ some part of its weight and the load
ወይም በሌላ ተሽከርካሪ እንዲሳብ ተደርጎ thereon rest upon or is carried by the
የተሠራ ተሽከርካሪ ነው፤ motor vehicle;

፴/ “ሙሉ ተሳቢ” ማለት ለራሱ የተለየ የሞተር 30/"Trailer" means a non-motorized vehicle
ኃይል የሌለው ሆኖ ጎታች በሆነ በሌላ designed to be pulled by and behind a
ባለሞተር ተሽከርካሪ ላይ ሊቀጠልና ሊጎተት motor vehicle; and so constructed that no

አይጨምርም፤

፴፩/ "ሞተር አልባ የትራንስፖርት መገልገያ" 31/"Non-motorized Transport Equipment"

ማለት በመካኒካል ወይም በኤሌክትሪክ ኃይል means any non-motorized equipment

used for transport services except motor
እየተንቀሳቀሱ ከሚሄዱ ተሽከርካሪዎች
vehicles operated with mechanical or
በስተቀር ማናቸውም ሞተር አልባ የሆነ
electrical force;
የትራንስፖርት መገልገያ መሣሪያ ነው፤

፴፪/ "የሕዝብ ትራንስፖርት አገልግሎት

32/ “Public Transport Station” means
መናኸሪያ" ማለት የሕዝብ ትራንስፖርት
infrastructure developed and designated
አገልግሎት ተሽከርካሪዎች መንገደኞችን
for the boarding and disembarkation by
እንዲያሳፍሩ እና እንዲያደርሱ ወይም
public transport vehicles of passengers or
የመንገደኞች ዕቃዎችን እንዲጭኑበት/
loading/unloading of their cargos;
እንዲያራግፉበት ታስቦ የለማ መሠረተ-ልማት
ነው፤

ለጥገና፣ ለመታጠቢያ፣ ነዳጅ ለመቅዳት እና fueling and parking of Omnibuses;
ለማደር በጋራ እንዲጠቀሙበት ታስቦ የለማ
መሠረተ-ልማት ነው፤

፴፬/ “የጭነት ትራንስፖርት አገልግሎት 34/ “Cargo Terminal” means a hub

መናኸሪያ” ማለት የጭነት ትራንስፖርት infrastructure developed and designated
አገልግሎት ሰጪዎች ተሽከርካሪዎች for loading, unloading by cargo trucks;
ጭነቶችን እንዲጭኑበት፣ እንዲያራግፉበት፣ packing and unpacking of cargos by
እንዲያሽጉበት እና እንዲበትኑበት ታስቦ cargo transport operators;
የለማ መሠረተ-ልማት ማለት ነው፤

፴፭/ “መጋዘን” ማለት የጭነት ትራንስፖርት 35/ “Warehouse” means an infrastructure

አገልግሎት መነሻ ወይም መድረሻ ሆኖ specifically designated for the purpose of
እንዲያገለግል ታስቦ የለማ መሠረተ-ልማት departure or destination of cargo transport
ነው፤ services;

፴፮/ "የሀገር ውስጥ የመንገድ ትራንስፖርት 36/ “National Road Transport Services”
አገልግሎት" ማለት ሁለት ወይም ከሁለት means a commercial transport service
በላይ ክልሎችን በሚያገናኝ መንገድ ላይ operated on roads connecting two or

የሚከናወን የንግድ መንገድ ትራንስፖርት more Regions;

አገልግሎት ነው፤

፴፯/ “ክልል” ማለት በሕገ መንግስቱ አንቀጽ ፵፯ 37/ “Region” means any Regional States

አገልግሎት” ማለት የኢትዮጵያን ድንበር Service" means border crossing road
አቋርጦ የሚካሄድ ድንበር አቋራጭ የንግድ transport service conducted by crossing
መንገድ ትራንስፖርት አገልግሎት ነው፤ the Ethiopian border;

፴፱/ “ቢሮ” ማለት የትራንስፖርት ሕጎችን 39/ "Bureau" means a State Executive Organ
ለማስፈጸም ሥልጣን የተሰጠው የክልል in charge of enforcing road transport
አስፈፃሚ አካል ነው፤ laws;

፵/ “ልዩ ሥልጠና” ማለት የጸና መደበኛ 40/ "Special Training" means training
የአሽከርካሪ ብቃት ማረጋገጫ ፈቃድ ላለው specially provided for holder of a valid
አሽከርካሪ ለልዩ የአሽከርካሪ ባለሙያነት regular driving permit as identified by
በሚኒስቴሩ ወይም በክልል ተለይቶ የሚሰጥ the Ministry or Region for acquiring a
ሥልጠና ነው፤ special driving license;

፵፩/ “መደበኛ ሥልጠና” ማለት የአሽከርካሪ 41/ "Regular Training" means training given
ብቃት ማረጋገጫ ፈቃድ ለሌለው ሰው for the first time to persons with no
ለመጀመሪያ ጊዜ ወይም አስቀድሞ driving permit; or to persons intending to

፵፪/ "ሰው" ማለት የተፈጥሮ ሰው ወይም በሕግ 42/ “Person” means any natural or juridical

፵፫/ በዚህ አዋጅ ውስጥ በወንድ ጾታ የተገለጸው 43/ Any expression in the masculine gender

ይህ አዋጅ ሁለትና ከሁለት በላይ ክልሎችን This Proclamation shall be applicable to all

ሚኒስቴሩ በፌደራል አስፈጻሚ አካላት ሥልጣንና

Without prejudice to the powers and duties
ተግባር መወሰኛ አዋጅ ቁጥር ፩ሺ፪፻፷፫/፪ሺ፲፬
vested in it by The Definitions of Powers
የተሠጡት ሥልጣንና ተግባራት እንደተጠበቁ
and Duties of the Federal Executive
ሆነው በተለይ የመንገድ ትራንስፖርትን
Organs Proclamation No. 1263/2021, the
በተመለከተ የሚከተሉት ሥልጣንና ተግባራት Ministry shall, on road transports in

፩/ የመንገድ ትራንስፖርትን የሚመለከቱ የፖሊሲ 1/ initiate policies and laws relating to

ሐሳቦችንና ሕጎችን ያመነጫል፣ ሲጸድቁም road transport; and implement the
ተግባራዊ ያደርጋል፤ አፈጻጸማቸውንም same upon approval; follow up and
ይከታተላል፤ ይቆጣጠራል፤ supervise their implementations;

፪/ የመንገድ ትራንስፖርት አገልግሎት ደኅንነቱ 2/ undertake, cause to be undertaken,

የተረጋገጠ፣ ቀልጣፋ፣ አስተማማኝ፤ ፍትሃዊ and supervises activities that ensure

እና ተደራሽ እንዲሆን ለማድረግ የሚያስችሉ the safety, efficiency, reliability,

፫/ በአካል ጉዳተኝነት ምክንያት ልዩ ድጋፍ 3/ ensure the availability of safe and

ያስተዳድራል፤ ይቆጣጠራል፤ የትራንስፖርት
አገልግሎቶችን ተደራሽነት ያረጋግጣል፤
6/ issue Directive for the development of
፮/ በኢትዮጵያ ውስጥ የተቀናጀ የሕዝብ an integrated passenger and cargo
ማመላለሻና የዕቃ ማጓጓዣ የመንገድ transport system throughout Ethiopia;
ትራንስፖርት አገልግሎት ሥርዓት the transportation of passengers, goods
እንዲስፋፋ፤ መንገደኞች፣ ዕቃዎችና and postal services through
ፖስታዎች በንግድ የመንገድ ትራንስፖርት commercial road transport; and follow
ስለሚጓጓዙበት ሁኔታ የአሰራር መመሪያ up their implementation;

፯/ የንግድ የመንገድ ትራንስፖርት ሥራ ላይ 7/ enforce appropriate remedial measures

በተሰማሩ ግለሰቦች እና ድርጅቶች የገበያ where individuals or enterprises
እጦት ሲያጋጥም ወይም ለተገልጋዩ engaged in commercial road transport
ህብረተሰብ የመንገድ የትራንስፖርት may face demand deficit or where the
አገልግሎት አቅርቦት እጥረት ሲከሰት public faces with supply side deficit of

ተገቢውን ክትትል በማድረግ የመፍትሄ road transport services; and, where

እርምጃዎችን ተግባራዊ ያደርጋል፤ አስፈላጊ necessary, employ a market based

ሆኖ ሲገኝም በገበያ ሥርዓት መሠረት approach;

አገልግሎት እንዲሰጡ ያደርጋል፤

፰/ በህዝብ ማመላለሻ ትራንስፖርት አገልግሎት 8/ Approve trip schedules submitted to it

ላይ የሚሰማሩ ግለሰቦች ወይም ድርጅቶች by individuals or enterprises engaged

የሚያቀርቡለትን የስምሪት ፕሮግራም in public transport services; follow up

መርምሮ ያጸድቃል፤ የስምሪት ፕሮግራሙ and supervise the fairness and

ፍትሃዊነትና አተገባበር ላይ ክትትልና implementation of approved trip

schedules; develop schedules and
ቁጥጥር ያደርጋል፤ የስምሪት ፕሮግራም
implement where no such schedules
ካልቀረበለትም በራሱ አዘጋጅቶ ተግባራዊ
are submitted to it; implement
እንዲሆን ያደርጋል፤ ለዚሁ የወጣውን
disciplinary Directive;
የዲሲፕሊን መመሪያ ይተገብራል፤

፱/ የተፈጥሮ አደጋ ሲያጋጥም ወይም ጊዜያዊ

9/ mobilize and assign commercial road
transport vehicles to operate in areas
የኢኮኖሚ ወይም የማህበራዊ ችግሮች ሲከሰቱ
and routes where their service are
ወይም ለሕዝብ ጥቅም አስፈላጊ ሆኖ ከተገኘ
demanded, where the occurrence of a

ለድንበር አቋራጭ ተሽከርካሪዎች ፈቃድ permit; issue cross-border permits;

ይሰጣል፤ አፈጻጸሙን ይከታተላል፤ follow up and supervise its
ይቆጣጠራል፤ implementation;

፲፩/ በሀገር ውስጥ የንግድ የመንገድ ማመላለሻ 11/ undertake periodic review of tariff and

አፈጻጸሙን ይከታተላል፤ ይቆጣጠራል፤ and follow up and supervise its

implementation;
፲፫/ በዓለም አቀፍ የመንገድ ትራፊክ የሚሰማሩ 13/ determine the registration system of
ተሸከርካሪዎችንና አሽከርካሪዎችን drivers and vehicles engaged in
አመዘጋገብ ሥርዓት ይወስናል፤ international road traffic; issue
የአሽከርካሪዎችንና የተሸከርካሪዎቹን registration certificate or special
የምዝገባ ሰርተፊኬት ወይም ልዩ ፈቃድ permits to these drivers and vehicles;
ይሰጣል፤ ሌሎች የተሸከርካሪዎቹን decide on other vehicle identifications;
መለያዎች ይወስናል፤ ፈቃድ ይሰጣል፤ issue licenses; supervises and
ይቆጣጠራል፤ በኢትዮጵያ ግዛት ውስጥ administers international road traffic
ዓለም አቀፍ የመንገድ ትራፊክን within the Ethiopian territory;
ያስተዳድራል፤

፲፬/ ከመንገድ ትራንስፖርት አገልግሎት አሰጣጥ 14/ provide arbitration services when so
ጋር በተያያዘ በማንኛውም አካል መካካል requested by adversaries engaged in

አለመግባባትና ክርክር ሲፈጠር እና commercial road transport services;

ባለጉዳዮቹ ሲጠይቁ በግልግል አይቶ and provide final administrative

15/ ensure the development of non-

Ethiopia as may be suitable to the
አቀማመጥ እና አየር ንብረት ጋር
users and harmonious with the
በሚጣጣምና ለተጠቃሚው በሚያመች
geography and environment;
መልኩ እንዲስፋፋ ያደርጋል፤ የማበረታቻ
implement incentive mechanisms;
የአሰራር ሥርዓቶችን ይዘረጋል፤
follow up and supervise its
አተገባበራቸውን ይከታተላል፤ ይቆጣጠራል፤ implementation;

፲፮/ መንገዶችን የሚጠቀሙ ባለሞተር 16/ determine the weight and dimension,
ተሽከርካሪዎች በሚሰጡት አገልግሎት number of passengers and payload of
ዓይነት ሊኖራቸው የሚገባውን ክብደትና motor vehicles depending on the
መጠን እንዲሁም የተሳፋሪን ብዛትና transport services they are purposed
የጭነት ክብደት ይወስናል፤ for;

፲፯/ ከውጭ ሀገር የሚመጡትን፤ በሀገር ውስጥ 17/ follow up and implement decisions
የሚሠሩትንና የሚገጣጠሙትን ወይም relating to vehicle age limit on
በከፊል የሚሠሩትን ወይም በሥራ ላይ imported, locally manufactured,
የተሰማሩ ማናቸውም ዓይነት ባለሞተር assembled or semi-assembled motor
ተሽከርካሪዎች የዕድሜ ገደብ በማስወሰን vehicles or motor vehicles already in
ተግባራዊነቱን ይከታተላል፤ ለዚሁም use; and issue technical specifications
መመዘኛ የሚያገለግል ዝርዝር መስፈርት thereof; undertake monitoring and

፲፰/ የመንገድ ደህንነት ደረጃዎችን ያዘጋጃል፤ 18/ issue standards relating to road safety;

፲፱/ ማናቸውንም የተሽከርካሪ ጋራዥ የቴክኒክ 19/ issue Directives under which
ብቃት ለማረጋገጥ፣ የሥራ ፈቃድና ዕድሳት certification of technical competence,
አሰጣጥ እና ደረጃውን ለመወሰን operational license and levels of
የሚያስችል መመሪያ ያወጣል፤ የብቃት vehicle maintenance and overhaul
ማረጋገጫ ፈቃድ ይሰጣል፤ ያድሳል፤ garages may be determined, issue,

ይሰርዛል፤ renew, cancel certificate of

፳/ ተሽከርካሪዎች እንደገና ስለሚሠሩበት፣ 20/ determine through Directives the
ስለሚፈቱበት ወይም ይዘታቸውንና manufacturing, dismantling,
አገልግሎታቸውን ስለሚቀይሩበት ሁኔታ; refurbishment or changing the original

፳፮/ ተግባርና ኃላፊነቱን በአግባቡ ለመፈፀም 26/ assign supervisors on permanent or

SERVICE
፮. ንግድ ፈቃድ አስፈላጊ ስለመሆኑ
6. Business License Necessary

፩/ በንግድ የመንገድ ትራንስፖርት አገልግሎት 1/ Any person intending to engage in

ሥራ ላይ ለመሠማራት የሚፈልግ ማንኛውም commercial road transport services shall
ሰው በቅድሚያ በሕግ ሥልጣን ከተሰጠው first secure a valid transport business

፪/ በንግድ የመንገድ ትራንስፖርት አገልግሎት 2/ The requirements to obtain operator’s

፫/ አስፈላጊውን መረጃ ለማስተላለፍ የሚረዳ 3/ The Ministry shall develop sample

፰. ስለ ሥልጣን ውክልና
8. Delegation of Powers
፩/ አስፈላጊ ሆኖ ሲገኝ ሚኒስቴሩ ከሥልጣንና 1/ The Ministry may, where necessary and

9. Repealed, Cancelled and Effective Laws

፱. የተሻሩ፤ የተሰረዙና ፀንተው የሚቆዩ ሕጎች

1/ The Transport Proclamation

፩/ የትራንስፖርት አዋጅ ቁጥር ፬፻፷፰/፲፱፻፺፯
No.468/2005 is hereby repealed by this
በዚህ አዋጅ ተሽሯል፡፡
Proclamation.

፪/ የዚህ አንቀጽ ንዑስ-አንቀጽ (፩) ድንጋጌ 2/ Without prejudice to the provisions of

ቢኖርም በአዋጅ ቁጥር ፬፻፷፰/፲፱፻፺፯ Sub-Article (1) of this Article all
መሠረት ወጥተው ወይም ፀንተው የነበሩ Regulations and Directives issued based
ደንቦች እና መመሪያዎች ሁሉ ከዚህ አዋጅ on Proclamation No. 468/2005 shall, in

፫/ የተሸከርካሪ መለያና መመዝገቢያ አዋጅ ቁጥር 3/ Article 15 and the Annex of Vehicle
፮፻፹፩/፪ሺ፪ አንቀጽ ፲፭ እና አባሪው በዚህ Identification and Registration
አዋጅ ተሰርዘዋል፤ Proclamation No. 681/2010 is cancelled
by this Proclamation;
፬/ የአሽከርካሪ ብቃት ማረጋገጫ ፈቃድ አዋጅ 4/ Article 7, 12 and the Annex of Drivers’
ቁጥር ፩ሺ፸፬/፪ሺ፲ አንቀጽ ፯፤ ፲፪ እና Competence Certification Proclamation
አባሪው በዚህ አዋጅ ተሰርዘዋል፤ No. 1074/2019 is cancelled;
5/ Matters covered by Article 15 and the
፭/ በተሸከርካሪ መለያና መመዝገቢያ አዋጅ ቁጥር
Annex of Vehicle Identification and
፮፻፹፩/፪ሺ፪ አንቀጽ ፲፭ እና አባሪው፤
Registration Proclamation No. 681/2010
እንዲሁም በአሽከርካሪ ብቃት ማረጋገጫ ፈቃድ
and Article 7, 12 and the Annex of
አዋጅ ቁጥር ፩ሺ፸፬/፪ሺ፲ አንቀጽ ፯፤ ፲፪ እና
Drivers’ Competence Certification
አባሪው ውስጥ ተደንግገው የነበሩትን ጉዳዮች
Proclamation No. 1074/2019 shall be
በሚመለከት ሚኒስቴሩ ኢትዮጵያ
governed by Directives to be issued by
የተቀበለቻቸውን ዓለም ዓቀፍ ስምምነቶች

፮/ ይህን አዋጅ የሚቃረን ሌላ ማንኛውም አዋጅ፣ 6/ Any Proclamation, Regulation and

1/ Commercial Road Transport enterprises

፩/ በትራንስፖርት አዋጅ ቁጥር ፬፻፷፰/፲፱፻፺፯
and individuals established or registered
መሠረት የተቋቋሙና የብቃት ማረጋገጫ
pursuant to Proclamation 468/2005 shall
ፈቃድ የተሰጣቸው የንግድ የመንገድ
be considered as being established by
ትራንስፖርት አገልግሎት የሚሰጡ ሰዎችና
this Proclamation and shall continue
ድርጅቶች በዚህ አዋጅ እንደተቋቋሙና
their activities.
የብቃት ማረጋገጫው እንደተሰጣቸው
ተቆጥረው ሥራቸውን ይቀጥላሉ፡፡

፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተደነገገው 2/ Notwithstanding the provisions of Sub-
ድንጋጌ ቢኖርም በትራንስፖርት አዋጅ Article (1) of this Article, individuals
ቁጥር ፬፻፷፰/፲፱፻፺፯ መሠረት የተቋቋሙ and enterprises established as per
ግለሰቦችና ድርጅቶች ይህ አዋጅ በነጋሪት Proclamation No. 468/2005 shall be re-
ጋዜጣ ታትሞ ከወጣበት ዕለት ጀምሮ በአንድ registered within one year from the
ዓመት ጊዜ ውስጥ በዚህ አዋጅ ሥልጣን coming into force of this Proclamation;
በተሰጠው አካል እንደገና መመዝገብ
አለባቸው፡፡

፫/ በዚህ አንቀጽ ንዑስ-አንቀጽ (፪) መሠረት 3/ Persons or enterprises not re-registered

ያልተመዘገቡ ግለሰቦች ወይም ድርጅቶች in accordance with the provisions of

ተሰጥቶት የነበረው የኦፐሬተርነት ብቃት Sub-Article (2) of this Article shall be

ማረጋገጫ ፈቃድ ይሰረዛል፤ ዝርዝሩ revoked their operator’s certificate;

ሚኒስቴሩ በሚያወጣው መመሪያ ይወሰናል፤ details shall be determined in the

Directive to be issued by the Ministry;

፬/ በትራንስፖርት አዋጅ ቁጥር ፬፻፷፰/፲፱፻፺፯ 4/ Commercial Road Transport

መሠረት ተመዝግበው የነበሩ የትራንስፖርት Associations established pursuant to

ማህበራት ይህ አዋጅ በነጋሪት ጋዜጣ ታትሞ

shall be re-established as a business
ከወጣበት ዕለት ጀምሮ ባሉት ዘጠኝ ወራት
company in accordance with the

፭/ በዚህ አንቀጽ ንዑስ-አንቀጽ (፬) ከተጠቀሰው 5/ After the lapse of the period provided
ጊዜ በኋላ ማንኛውም የትራንስፖርት ማህበር under Sub-Article (4) of this Article any
ምዝገባው እንደተሰረዘ ተቆጥሮ ምንም Commercial Road Transport
ዓይነት ሕጋዊ ሰውነት አይኖረውም፡፡ Association shall have considered
dissolved and shall have no legal
personality.
፮/ በዚህ አንቀጽ ንዑስ-አንቀጽ (፬) መሠረት ወደ 6/ Commercial Road Transport
ንግድ ማህበርነት የሚለወጡ የቀድሞው Associations registered in the former
የትራንስፖርት ባለሥልጣኑ ዘንድ Authority and intending to re-establish
ተመዝግበው የነበሩ ማህበራት ያፈሩትን as a commercial entity as per Sub-
ንብረት በሕግ አግባብ ወደሚለወጡበት የንግድ Article (4) of this Article may transfer
ማህበር ማስተላለፍ ይችላሉ፡፡ they accumulated assets to the newly
reestablished commercial entity.
፯/ በዚህ አንቀጽ ንዑስ-አንቀጽ (፮) የተደነገገው 7/ Without prejudice to the provisions of
ቢኖርም በዚህ አንቀጽ መሠረት ወደ ንግድ Sub-Article (6) of this Article, the
ማህበርነት ሳይለወጥ የችሮታ ጊዜው accumulated assets of an Association
ያለፈበት የትራንስፖርት ማህበር ያፈራው which failed to be reestablished as a
ንብረት ላይ አግባብነት ያለው የኢትዮጵያ commercial entity shall be treated in
የፍትሐብሔር ሕግ ድንጋጌ ተፈጻሚ accordance with the relevant provisions
ይደረጋል፡፡ of the Ethiopian Civil Code.

፰/ በዚህ አዋጅ አንቀጽ ፱ ንዑስ-አንቀጽ (፭) ስር 8/ The provisions of Article 15 and the

፲፪. ደንብ እና መመሪያ የማውጣት ስልጣን 12. Power to Issue Regulation and Directive

፩/ ይህን አዋጅ በአግባቡ ሥራ ላይ ለማዋል 1/ The Council of Ministers may issue

፲፫. የመተባበር ግዴታ
13. Duty to Cooperate

ማንኛውም አካል ለዚህ አዋጅ እና አዋጁን

Any person shall have the duty to

፲፬. አዋጁ የሚፀናበት ጊዜ

14. Effective Date

ይህ አዋጅ በነጋሪት ጋዜጣ ታትሞ ከወጣበት ዕለት

This Proclamation shall enter into force from
ጀምሮ የፀና ይሆናል፡፡
the date of its publication in the Negarit
Gazette.
