business, with or without electronic delivery • Sales or licensing of on-line entertainment, such as access to computer games, gambling and pornography • Sales or licensing of access to on-line databases and on-line commercial software • Advertising products, providing information about product developments, and providing technical support for products. Theo Ủy ban châu Âu: "Thương mại điện tử có thể định nghĩa chung là sự mua bán, trao đổi hàng hóa hay dịch vụ giữa các doanh nghiệp, gia đình, cá nhân, tổ chức tư nhân bằng các giao dịch điện tử thông qua mạng Internet hay các mạng máy tính trung gian (thông tin liên lạc trực tuyến). Thật ngữ bao gồm việc đặt hàng và dịch thông qua mạng máy tính, nhưng thanh toán và quá trình vận chuyển hàng hay dịch vụ cuối cùng có thể thực hiện trực tuyến hoặc bằng phương pháp thủ công." Thương mại điện tử hiện đại thường sử dụng mạng World Wide Web là một điểm ít nhất phải có trong chu trình giao dịch, mặc dù nó có thể bao gồm một phạm vi lớn hơn về mặt công nghệ như email, các thiết bị di động cũng như điện thoại. Thương mại điện tử thông thường được xem ở các khía cạnh của kinh doanh điện tử ( e-business). A foreign corporation or other taxpayer typically is
not taxable by a country on a source basis unless it has minimum presence in that country. A country must decide whether an electronic presence of one type or another is sufficient to constitute a fixed place of business under various circumstances E-COMMERCE AND NEXUS
Issues arise as to whether various e-commerce
activities in a country constitute a PE for treaty purposes and, if they do, whether they are within the scope of the exemptions for auxiliary activities. If the web site of a taxpayer is treated as a PE, then the sales income derived from sales made through that web site would be attributable to the PE. If a server or other computer equipment of a taxpayer is held to constitute a PE, then that portion of the profits attributable to the operations of the server or equipment would be taxable in the source country. CHARACTERIZATION OF INCOME FROM E-COMMERCE
Most e-commerce income characterized as business
income would not be taxable in the source country. Income characterized as royalty income is taxable under Article 12 of the OECD Model Treaty – royalty income is exempt from tax in the source state. CHARACTERIZATION OF INCOME FROM E-COMMERCE
Income derived from sales over the Internet of
tangible personal property would be business income; Royalties paid for access over the internet to a database containing proprietary information would be royalty income.
