Constitution of FTUB

Preamble

FTUB exist to unite the workers organized in the free and democratic trade
Unions of Burma and to afford a means of consolation and collaboration
between them in furtherance of the aims here set out.

After 1988 people movement, the political parties can set-up with many
restriction but Trade Unions not included. To establish free trade unions in
Burma and defend their rights is one of our prime duties.

Freedom of Association is essential rights to trade Unions. To implement


the freedom of association, Democracy mean as principle. Therefore we
strongly commit to restore Democracy.

Principles

Believing that freedom of thought, expression and association must be


translated into actual conditions affecting the lives of workers and their
relations with their employers, public or private, and with the state the
FTUB proclaims the right of individuals.

• to social justice and the opportunity to lead a full and decent life;
• to work and choice of employment.
• to security of that employment and of the income deriving from it;
• to adequate protection of their lives and health in all occupations;
• to have no restriction on establishment of Trade Union and freedom of
join to others and international
• to mutual protection of their interests, though forming and joining trade
unions which shell be free bargaining instruments and which derive
their authority from their members; and
• to maintain democracy

As an organization fervently upholding the principle of democracy and


FTUB shall be independent in every respect of governments state institutions,
political parties Religious organizations and employers’ organizations.

The FTUB declares its aims to be:

1. To maintain and developed and promoting the interests of working


people throughout the world and of enhancing the dignity of labor.
2. To further the establishment, maintenance and development of free
trade unions in Burma.
3. To weld international trade union solidarity.
4. To undertake and coordinate the defense of the free trade unions against
any campaign aiming at their destruction or at the restriction of their
rights or at the infiltration and subjugation of labor organizations by
totalitarian or other anti-labor forces;
5. To protect, maintain and promote Democracy and Basic human rights.
6. To strive for the establishment of full employment; the elimination of
adverse discrimination on grounds of race, sex, nationality ,age or creed;
the improvement of working conditions; and the rising of standard of
living of people of the whole country.
7. To protect, maintain and expand the system of free labor and to eliminate
forced labor every where;
8. To ensure the integration of women into trade union organization
9. To carry out a program of trade union and worker’s education as a means
of promoting better understanding of the tasks of the free trade union
movement every where;
10. To engage in and faster publicity work which will increase the knowledge
and understanding of National and International problems comforting
the workers, so as to enable them to make their struggle more efficacious
and so as to realized the widest support for the FTUB activities;
11. To maintain and developed a powerful and effective National
organization in world wide and region, composed of free and democratic
trade unions, independent of any external domination and pledged to
the task of promoting the interests of working people throughout the
world and of enhancing the dignity of labor

12. The FTUB recognized the full autonomy of member organizations


subject to such obligations arising from membership as specified under
Chapter III.

Trade Unions, workers unions, Farmer’s organization join as members join
to Federation on their own independent decision.

Article 6. The Supreme Authority

In the determination of the program and policy of the organization and in


the interpretation of this Constitution, the supreme authority shall be the
Congress.

Article 7. Hierarchy

The Congress , The policy Board, the Executive committee, the secretariat
and the Board of Auditors are the Governing Bodies of FTUB.

Article 8. Composition of the Congress

a) the ordinary Policy Board members


b) delegates from each member organization (president or CEC
member)
c) the secretariats, youth and women committee member nominated
by GS and approved by CEC
d) Observer: The Central Executive Committee may invite observers
on proposal of the GS.
e) Guests: The Central Executive Committee may invite guests on the
proposal of GS.

Article 9. Term of the Congress

The regular Congress shall be convened at least once every five years. Its
date and place shall be fixed by executive board on the basic of proposals
made by affiliated organizations, and shall be communicate to affiliated
organizations not later then 6 months prior to the Congress.

Article 10. Function of the Congress

1) Reports and approve on activities of the federation.


2) Reports and approve on activities of affiliated unions, youth and woman
committee
3) Report and approve on finical of the Federation and department.
4) Proposal for the activities of the federation during the period to follow;
5) To decide FTUB policy.
6) Decide on the congress rules of procedure as submitted by Congress
committees on the proposal of the GS
7) Proposal for the amendment of the Constitution;
8) Decide on exclusion on the proposal of PB.
9) Consider and ratify membership applications.
10) Adopt the budget for the coming term of office.
11) Elect a Credential Committee to determine voting rights and examine
the eligibility of nominees.
12) Elected a Resolution Committee to prepare resolution and policy
statements for decision by Congress.

Article 11. Special Session (or) Extraordinary Congress

a) A Special Congress shall be call on the authority of PB or 50 % of


previous delegates .
b) In such a case the PB shall decide the procedure for establishing
the agenda and for the consideration of proposals from affiliated
organizations, whenever it is not practical to apply the normal procedure
as laid down in this Constitution.
c) The delegates at the Special Session (Extraordinary Congress) are those
who were elected for the previous ordinary Congress.

Chapter III

Membership, Right and Responsibility

Article 12. Membership

All bona-fied trade unions, worker organizations and institution of worker’s


accepting the aims and constitution of federation shall be eligible for
member.

Article 13. Independency

The autonomy of affiliated organizations is guaranteed.

Article14. Continue membership

Continued membership shall be conditional up on fulfillment of the


obligations laid down in constitution.

Article 15. Apply for membership

All bona-fied trade unions, worker organizations and institution of worker’s


submit a application with their constitution and other document which
adopted by previous congress.

Article 16. Ratification

The Policy Board shall have power to decide on applications for affiliation,
subject to the provisions of paragraph above, and shall report its decision to
congress for ratification.

Article 17. Responsibility of affiliated

a) to keep its constituent bodies fully informed of the work and


progress of federation;
b) to keep the federation informed of major developments with in its
own state

c) pay membership fee after the its provisional acceptance by the


Executive Board.
d) Send delegate to Congress

Article 18. Rights of member affiliated

Organizations and Institutions with full membership have


a) full voting rights nomination and candidate
b) the right to make proposal in the FTUB structure, the right to
participate in all FTUB activities
c) and the right to be kept continuously informed about the various
FTUB activities.

Article 19. Associated member

To become an associated member an organization or institution shall


a) Support the fundamental principal of the FTUB as well as its work;
b) be unanimously proposed for membership by the Executive
Committee.
c) pay the membership fee as decided by General Congress.

organizations and institutions with associated membership have


a) the right to make proposals in FTUB structures;
b) they have the right to be kept continuously informed about the
various activities and to participate in these activities.

Article-20 Observer

On the proposal of the FTUB secretariat, the Policy Board may grant
observer status to organizations and Institutions wishing to co-operate with
FTUB.

Article 21 Observer status

Organization with observer status have:


a) no voting rights and
b) no right to make proposals in FTUB structures,
c) They are invited to participate in various FTUB activities at the
discretion of the Executive Board
d) and pay voluntary contributions to the FTUB work.

Article 22. Resignation

Member organization, which want to resign from Federation needs to


made 3 month prior notice to CEC.

CEC has authority to temporary resignation by approval of PB and report


to nearest congress.

Article 23. Expulsion

Affiliated union or institution is alleged as against the constitution and


worker’ solidarity PB must form an independent committee to enquire
about the matter and if the allegation proved by facts, PB has authority
to stop the membership of those union or institution and report to nearest
congress for approval.

Congress Delegate

Article 24. Determination of congress Delegate

the ordinary Policy Board members the secretariats,


youth and women committee member nominated by GS and approved by
CEC

Article 25. Representation

a) The Congress is composed of delegates of affiliated organizations, on


the following basic;

i)- representation of trade union centers;

up to 100 members ....................... 1 delegate


between 101 and 250members..... 2 delegates
between 251 and 500members..... 3 delegates
over 500 members......................... 4 delegates

ii)- representation of individual trade unions

up to 100 members........................ 1 delegate


between 101 and 250members..... 2 delegates
over 250 members......................... 3 delegates

Article 26. Representation on more than one region

A delegate may represent several affiliated organizations from one area


provided he or she is duly accredited by those organizations. The delegate
shall have the right to one vote if the aggregate number of members so

represented is 100 or less, and two votes if the aggregate number of members
so represented is more than 100.

Article 27. Gender representation

Affiliated organizations shall select their delegates taking into account their
membership composition. Any organization having more than 1000 women
members should nominate at least one woman delegate.

Article 28. Observers of Congress

Observers from organizations, either governmental or non-governmental,


with which the federation maintains friendly relations, may be invited by
PB to attend Congress. They will be allowed to speak at the invitation of
President.

Article 29. Expense of delegate

The expenses of delegations and observers attending the Congress shall be


borne by their respective organizations.

Article 30. Policy Board (PB)

The Congress elects 15 members of Policy Board.

members nominated by respective Migrant worker Sectors.

b) There shall be elected by Congress an Executive Board having (2)

members nominated by Youth Committee.

d) The Congress will decide Sector, Region and candidate according to


situation.

Article 33. Nominate and Candidate

All affiliated organizations represented at the Congress shall have the right
to participate in the arrangement for considering nomination for membership
of PB from their particular field/area as par article 32.

Article 34. Election for Policy Board

The Congress Elect the Policy Board from respected delegates of above
mentioned Sector, Region and Fields.

Article 35. Term and meeting period of PB

Policy Board term is 5 years or accordance with Congress term. PB will


made meeting every year.

Article 36. Central Executive Committee (CEC)

The Congress elect 5 delegates from the Policy Board to form CEC.

Article 37. The structure of forming CEC

CEC will be formed by:

i) President
ii) Vice President
iii) General Secretary
iv) Assistant General Secretary
v) Treasurer

Chapter VI

Policy Board – Authority and regulation

Article 38. Competence

a) The PB shall have authority to act on behalf of the Federation. It shall


be responsible for directing the activities of Federation and giving effect
to the decisions and recommendations of the Congress.
b) The PB shall carry out the duties entrusted to it by this constitution.
c) The PB shall establish the annual budget and adopt the annual financial
report of the Federation.
d) The PB shall Discuss and provisionally approve reports, accounts and
auditors’ reports for proceeding year.
e) Approve the use of Federation’s fund.
f) Determined the remuneration of Federation’s elected Secretariat
officers.
g) Hold supplementary elections for the remainder of Congress period in
the event of the withdrawal of any elected person and officer.
h) determined the remuneration of Audit Committee and EB.
i) Appointed district secretaries and determined their expenses.
j) Approve the admission of new members and decide in matters relating
to the exclusion of members.
k) Levy supplementary dues.
l) Deal with other Brotherhood International Organizations.

Article 39. PB meeting

a) The PB shall meet not less than (annual a year). The date of meeting
shall be notified to affiliate organizations at the same time as to the
members by General Secretary with President approval.
b) For the proper conduct of its meetings, the PB shall adopt its own
Standing Orders, with out prejudice to obligations arising from this
Constitution.
c) Meeting will be eligible by attending two third of PB members.
Electronic Communication is eligible for meeting.

Article 40. President

a) The President shall chair all meetings of EB, The Sub Committees
and the Congress and shall have right to attend all other meetings of
Federation.
b) The President shall have full voting rights at meetings of the governing
of Federation.
c) The President shall use the authority to have cooperation and coordination
in function of Federation.

Article 41. Vice president

i) Shall help President duties


ii) Shall represent as President
iii) Shell represent as President when president resign or
incompetence.

Article 42. General Secretary

i) The GS shall take responsibility to implement the Policy the


activity conducted by the Congress
ii) The GS shall take responsibility to hole the regular CEC
meetings
iii) The GS Shall take resposibilty of:
iv) i- the administration of Federation;
v) ii- maintaining contacts with affiliated organizations;
vi) iii- collecting material for the subjects which are to be
discussed by the committees of Federation; and
iv- the issue of such publication of a regular or special character
as may be determined by Federation
v- Budget Separation, permission and approving in accordance
with congress decisions
vi- implement program which adopt by congress
vii) The GS will prepare and send the CEC and PB meeting decision
to respected member not more then one month.
viii) GS shall take responsibilities of Secretariat.

Article 43. Assistant General Secretary

a) The AGS shall assist to GS responsibilities


b) The AGS shall represent GS responsibility when GS vacant or
incompetent
c) The AGS shall implement the task handed over by GS

Article 44. The Secretariat

a) GS shall appoint the members of secretariat with approval of EB.


b) Secretariat composes of GS, AGS and Secretaries.
c)Authority of Secretariat may:
i) Manage the day-to-day affairs of Federation in conformity ii) with
the Constitution and decisions of Congress.
iii) Appoint staff and determined their terms of remuneration and
employment.
iv) To adopt the annual budgets.
v) Administer the funds of Federation in conformity with the decisions
of Congress and make grants not determined by Congress.
vi)To fix travel expenses per-diem and loss of pay of work.
Ensure that member’s organizations follow the guidelines laid down
for the activities of Free Trade Unions and organizations.
vii) Assist the unions for proper working and negotiation relating to
wages and working conditions.
viii) Approved the budgets of district offices and attend to the
engagement of staff.
ix) Suspend elected officers and discharge staff in accordance with
the rules and regulations.
x) Decide in other matters appertaining to the Federation, not
specifically with in the spheres of authority of Congress.
d) Secretariat shall attend to CEC and PB meeting by invitation of GS or
representing the reports.
e) Secretariat shall be selected as congress delegate by representing their
department/region with PB approval.

Chapter VII

Auditing

Article 45. Auditors

The Congress shall elect three Auditors, who shall be not be in PB and hold
annual audit of the accounts of Federation.

Article 46. Chief Auditor

a) PB shall select and appoint one of auditors as a Chief of Committee of


Audit (CCA).

Article 47. Audit Team procedure

Auditors shall carry out their task critically and in due conformity with
good auditing practice and also in accordance with instructions draw up by
the Committee of Audit and approved by the EB.

Article 48. Replacement

In the event of the office of one of the auditors becoming vacant between
two Congress, the PB shall have the authority to fill the vacancy.

Article 49. Expenses

The expense of the auditors in performance of their duties in the Federation


shall be borne by Federation up to an account determined by the PB.

Article 50. Responsibility and Duty

a) The Auditors shall submit their reports to PB and to Congress


and after endorsement by one of their bodies, the report shall be
circulated to affiliate organizations.
b) The Auditor’s reports on the audit each year.
c) Federation’s Auditing Office audits the accounts of Federation
district offices. further, the office may take on other tasks at the
decision of EB on each occasion.

Chapter VIII

Finance

Article 51. Collection of Finance

a) The activities of the Federation shall be financed out of income deriving


from;
i) regular affiliation fees.
ii) special levies;
iii) Voluntary Contributions
b) Annual affiliation fees payable by affiliated unions and organizations.
c) The Congress may decide to empower the EB to Levy affiliated
organizations to an account to be fixed by Congress which shall also
decide the nature, duration and purpose of such levies.
d) The Congress or EB may decide to organize fund-raising campaigns
based on voluntary contribution towards a well-defined program.
Funds thus collected shall not be used for other purposes, unless the
contributors so agree.

Article 52. Storage of Finance

a) Financial will be put in Financial Department under control of


Treasurer with PB resposibilty.
b) Financial will be keep in Bank or Administrative office – Financial
Department with PB approval.

Article 53. Budget Separation

Budget separation will be done by plenary instruction by PB meeting.

Article 54. Reports on Finance / Expenditure and Account

The Finance/ Expenditure and Accounting report shall be done and report
by rules and procedure as conducted by Congress.

Chapter IX

Generals

Article 55. Rules and Regulation

The CEC has authority to made rules and regulation for Administration and
Activities with approval of PB for temporarily and get decision approval
by next congress.

Article 56. Allie organizations

The CEC has authority to made MOU or Declaration or Statement or Sign


pack to implement the program and action plan which adopted by congress
and made approval by PB.

Article 57. Transition period


The Secretariats lead by GS has rights to made proposal for transitional
period to congress by approval of PB and implement by decision of the
Congress.

Article 58. Amendment of Constitution

The constitution of FTUB shall be amendment by:


a) Proposal made by one third of PB
b) Proposal made by CEC which supported by half member of PB
c) Proposal made by GS and Secretariats by approval of CEC
:are approved by simple majority of Congress vote.

Article 59. number of Delegate for congress

The GS and Secretariats can made proposal to determine the number of


delegate for congress with approval of CEC.

Article 60. number of Policy Board Member

Number of Policy Board member shall be decided by the Congress.

Article 61. Replacement

a) The PB shall made replacement for CEC vacant according to rules


and regulation, not in congress period.
b) The replacement of PB member shall be done by:
The respected union shall send replacement, in resignation/
dismissal and withdraw.

Article 62. Activity Enforcement and Expend

The GS shall made proposal to Enforcement and expend the program and
implement the activity of Federation with approval of PB.

Article 63. The Patrons

The Congress shall nominate and Select the Patrons of FTUB.

Article 64. Competence

The Patrons Shall be:


a) Represent the federation by request of CEC.
b) Participate in PB and CEC meetings
c) Discuss in PB and CEC meetings.
d) No voting rights in meetings
e) Suggestions shall be respect

Article 65. Advisory Committee

The Advisory Committee shall be proposed by CEC and can be appointed


by PB.

The procedure, rules and regulation of advisory committee shall done by


CEC.
