WHEREAS, it has been found necessary to
አስተዲዯሩ በከተማው ውስጥ የሚስተዋሇው የመኖሪያ establish a transparent procedure to address the

ይህ ዯንብ “የአዱስ አበባ ከተማ አሰተዲዯር 1. Short Title

የመንግሥት ሠራተኞች የጋራ ሕንፃ መኖሪያ This Regulation may be cited as: “The
ቤት የህብረት ሥራ ማህበር የአዯረጃጀትና Addis Ababa City Government Civil
አፇጻጸም ዯንብ ቁጥር ፻፳፱/፪ሺ፲፬” ተብል Servants’ Condominium Cooperatives
ሉጠቀስ ይችሊሌ፡፡ Organization and Implementation
Regulation Number 129/2022.”
፪. ትርጓሜ

የቃለ አገባብ ላሊ ትርጉም የሚያሰጠው ካሌሆነ 2. Definition

በስተቀር በዚህ ዯንብ ውስጥ፡- In this Regulation, unless the context
፩. “አስተዲዯር” ማሇት የአዱስ አበባ ከተማ requires otherwise:
አስተዲዯር ነው፤
1. “Government” means the Addis Ababa
፪. “ከተማ” ማሇት የአዱስ አበባ ከተማ ነው፤
city government;
፫. “ቻርተር” ማሇት የተሻሻሇው የአዱስ አበባ
2. “City” means the Addis Ababa city;
ከተማ አስተዲዯር ቻርተር አዋጅ ቁጥር
3. “Charter” means the Addis Ababa city
፫፻፷፩/፲፱፻፺፭ (እንዯተሻሻሇ) ነው፤

፭. "ቢሮ" ማሇት የአዱስ አበባ ከተማ አስተዲዯር
4. “Proclamation” means cooperatives
የቤቶች ሌማትና አስተዲዯር ቢሮ ነው፤

፮. "ኤጀንሲ" ማሇት የአዱስ አበባ ከተማ
አስተዲዯር የኅብረት ሥራ ማኅበራት
985/2016;

ኤጀንሲ ነው፤ 5. “Bureau” means the Addis Ababa city

፯. "ጽህፇት ቤት" ማሇት የክፍሇ ከተማ ወይም government housing development and

የወረዲ የኅብረት ሥራ ማኅበራት ጽህፇት management bureau;

ቤት ነው፤ 6. “Agency” means the Addis Ababa city

፰. "የመንግስት ሠራተኛ" ማሇት በከተማው government cooperatives agency;

ቤት እና በአዯስ አበባ ከተማ አስተዲዯር at sub-city or woreda level;
ሥር ባለ የመንግሥት ሌማት ዴርጅት 8. “Civil Servant” means an individual
ውስጥ በቋሚነት ተቀጥሮ የሚሰራ ሰው who is the resident of the city and a

፱. "የኅብረት ሥራ ማኅበር" ማሇት በአዋጁ እና 9. “Cooperatives” means a condominium

በዚህ ዯንብ መሠረት የተዯራጀና የተመዘገበ cooperative that was established and

፲. "ዝግ ሂሳብ" ማሇት የመኖሪያ ቤት 10. “Closed Account” means an

ገንዘባቸዉን በማይንቀሳቀስ የቁጠባ ሂሳብ 11. “Bank” means any bank that the
ሇማስቀመጥ ወይም ላልች የባንክ cooperative societies have chosen to
አገሌግልቶችን ሇማግኘት የሚመርጡት deposit their money in a closed account
ማንኛውም ባንክ ነው፤
or to obtain other banking services;
፲፪. "የቤት ሌማት ፕሮግራም" ማሇት
12. “Housing Development Program”
በአስተዲዯሩ አስተባባሪነት የመኖሪያ ቤት
means a 10/90, 20/80, 40/60, and

13. “Developed Land” means a land with

In this Regulation, any expression in the
masculine gender shall include the feminine.
፬. የተፇጻሚነት ወሰን 4. Scope of Application
ይህ ዯንብ በከተማ አስተዲዯሩ ውስጥ ነዋሪ በሆኑ This Regulation shall be applicable to any

፭. መርሆዎች 5. Principles
በአዋጁ የተቀመጡት የህብረት ስራ ማህበራት The Regulation shall, without prejudice to
መርሆዎች እንዯተጠበቁ ሆነው ዯንቡ the principles of cooperative societies stated
የሚከተለት መርሆዎች ይኖሩታሌ፡- in the Proclamation, have the following
፩. በመኖሪያ ቤት ህብረት ስራ ማህበር principles:
የሚታቀፈ አባሊት ግዳታቸውን እስካሟለ 1. Follow a fair procedure to ensure those

6. Objectives of the Regulation

1. To find alternatives for civil servants to

፪. በጋራ ህንጻ መኖሪያ ቤት ህብረት ሥራ 2. To establish a transparent and fair

ማህበር ሇመዯራጀት ፍሊጎት ያሊቸውን registration and organization system for
those civil servants who are interested to
የመንግሥት ሠራተኞች ሉያሟለ
be included in the condominium
የሚገባቸውን ቅዴመ ሁኔታዎች፣ ኃሊፉነትና cooperatives to aware them the
ግዳታዎች እንዱያውቁ በማዴረግ ግሌጽና requirements to be fulfilled, the
responsibilities, and obligations;
ፍትሃዊ የሆነ የምዝገባና አዯረጃጀት ስርዓት
3. To establish a transparent and
ሇመዘርጋት፤ accountable procedure to indicate the
፫. በጋራ ህንጻ ሇሚሳተፈ ማህበርተኞች ግሌጽ duties and responsibilities of those
የሆነ የአዯረጃጀት ተግባርና ኃሊፉነት members that participate in the
condominium cooperatives, and create a
ሇማመሌከት እና በመሬት አቅርቦት፣ በማህበር
collaborative system with the city
አዯረጃጀት እና ላልች አስፇሊጊ በሆኑ government in land provision,
ዴጋፎች ሊይ ከአስተዲዯሩ ጋር የተቀናጀ organizing cooperatives, and on other
አሰራር በመዘርጋት ግሌጸኝነትና ተጠያቂነት
necessary supports.

ያሇው አሰራር ሇመዘርጋት ነው፡፡

Part Two
Registration, Requirements, and
ክፍሌ ሁሇት
Implementation Procedure for Membership
የማህበር አባሌነት ምዝገባ፣ መስፇርት እና የአፇፃፀም
7. Registration Requirement
ሥርዓት
Without prejudice to the membership
፯. የምዝገባ መስፇርት registration requirements specified under
cooperative societies Proclamation and
ማንኛውም የህብረት ስራ ማህበራት ተመዝጋቢ
condominium ownership Proclamation
በአዋጁ እና በጋራ ሕንፃ ባሇቤትነት አዋጅ ቁጥር
number 370/2003, any registrant shall fulfil
370/1995 የተመሇከተው የአባሌነት ምዝገባ
the following requirements for the
መስፇርት እንዯተጠበቀ ሆኖ ሇዚህ ዯንብ
implementation of this Regulation:
አፇጻጸም ሲባሌ የሚከተለት መስፇርቶችን
1. a resident of the city government and
ማሟሊት ይኖርበታሌ፡-
permanently hired as a public employee;
፩. በከተማ አስተዲዯሩ ነዋሪ የሆነ እና
2. able to bring in person a renewed
በመንግሥት ሠራተኝነት በቋሚነት ተቀጥሮ
residential ID that shows that he is the
እያገሇገሇ ያሇ፤
resident of the city government and an
፪. የአዱስ አበባ ከተማ ነዋሪ መሆኑን
ID that shows that he is a civil servant;
የሚያረጋግጥ የታዯሰ የነዋሪነት እና
3. he should not have a house or land for
የመንግሥት ሠራተኛ መሆኑን የሚግሌጽ
the construction of a house by his name
መታወቂያ በአካሌ ይዞ መቅረብ የሚችሌ፤
or his spouse’s name or did not transfer
፫. ከዚህ በፉት በአስተዲዯሩ ውስጥ በራሱም ሆነ
the thereof for a third party in the city
በትዲር ጓዯኛው ስም የመኖሪያ ቤትም ሆነ
government earlier to this;
የመኖሪያ ቤት መሥሪያ ቦታ የላሇው
ወይም ኖሮት ሇሶስተኛ ወገን ያሊስተሊሇፇ፤

፬. በመንግስት በተዘረጉት ላልች የቤት ሌማት 4. did not benefit from or register under other
ፕሮግራሞች ሊይ ተጠቃሚ ያሌሆነ ወይም housing development programs established

ያሌተመዘገበ ወይም ተመዝግቦም ከሆነ by the government or able to bring a

testimony that he has cancelled such
ምዝገባውን መሠረዙን ወይም መተውን
registration if he was registered;
ማረጋገጫ ማምጣት የሚችሌ፤
5. accept the objectives, principles, and values
፭. በአዋጁ ዴንጋጌ መሠረት የህብረት ሥራ
of the cooperative societies according to the

provisions of the Proclamation and willing
እሴቶችን ተቀብል ተመሳሳይ ፍሊጎት
to work in collaboration with those

applicants who have similar interests;
ተዯራጅቶ ሇመሥራት ፇቃዯኛ የሆነ፤ 6. interested to organize under cooperatives
፮. አስተዲዯሩ ከሉዝ ነጻ በሚያዘጋጀው መሬት with other members and build houses by his
ሊይ ከላልች አባሊት ጋር በመሆን በራሱ own financial expenses on a land prepared
የገንዘብ ወጪ በኅብረት ሥራ ማኅበር by the city government;
ተዯራጅቶ መኖሪያ ቤት ሇመገንባት ፍሊጎት 7. able to deposit the advance payment of the

remaining construction cost in accordance

with a directive to be issued by the agency;

8. willing to respect the objectives and

principles of the cooperative society and
ፇቃዯኛ የሆነ፤
accept the internal regulation of the thereof;
፰. የህብረት ስራ ማህበሩን ዓሊማና መርሆዎች 9. agreed with members to construct a
ሇማክበርና የማህበሩን መተዲዯሪያ ዯንብ condominium through the cooperative
ሇመቀበሌ ፇቃዯኛ የሆነ፤ societies in compliance with the
፱. የከተማ አስተዲዯሩ ያወጣቸውን የግንባታ construction laws of the city government;
ሕጎች በማክበር በኅብረት ሥራ ማህበሩ 10. willing to be organized as a member of the

አማካኝነት ከአባሊቱ ጋር በጋራ ህንፃ cooperative as per the kind of bedrooms,

የመኖሪያ ቤት ሇመገንባት የተስማማ፤ which is three bedrooms, two bedrooms, and

one bedroom;
፲. የማህበሩ አባሌ ሆኖ ሇመዯራጀት ሇባሇ ሶስት
11. any member should be willing to accept that
መኝታ ቤት፣ ሇባሇ ሁሇት መኝታ ቤት እና
the cooperative that he will be included and
ሇባሇ አንዴ መኝታ ቤት በሚሌ እንዯ
organized shall be assigned by lot through
መኝታ ቤቱ ዓይነት ሇመዯራጀት ፇቃዯኛ
the agency;
የሆነ፤
፲፩. ማንኛውም ተዯራጅ የሚዯራጅበት የኅብረት
ሥራ ማኅበር በኤጀንሲው አማካይነት በዕጣ
የሚዯሇዯሌ መሆኑን የሚቀበሌ፤

፲፪. በፕሮግራሙ ተካቶ ቤት የሚገነባ ቤት ፇሊጊ 12. the member who is building a house should
የህንጻ ግንባታው በጅምር ሊይ እያሇ ወይም be willing that he could not transfer the

ግንባታው ከተጠናቀቀበት ቀን ጀምሮ house to a third party through sell or gift

before five years upon the completion of the
አምስት ዓመት ከመሙሊቱ በፉት ቤቱን
construction or while the construction of the

8. Identifying Beneficiaries

፰. ተጠቃሚዎችን ስሇመሇየት The agency shall identify those who are

interested to be organized in the condominium
ኤጀንሲው የጋራ መኖሪያ ቤት ሕንፃ ማኀበር
cooperatives in the following manner:
ሇመዯራጀት የሚፇሌጉትን እንዯሚከተሇው
1. the agency shall publish a notice for civil
ይሇያሌ፡-
servants that fulfil the requirements
፩. በዚህ ዯንብ አንቀጽ ፯ መሠረት መስፇርቱን specified under Article 7 of this Regulation
ሉያሟለ የሚችለ የመንግስት ሠራተኞች to present a written testimony for being a
ከሚሠሩበት ተቋም የመንግሥት ሠራተኛ civil servant from their office and register
ስሇመሆናቸው የሚገሌጽ የጽሁፍ ማስረጃ for the program;
አቅርበው እንዱመዘገቡ በማስታወቂያ ጥሪ 2. the notice to be published as per Sub-Article

10. Type of Houses
፩. የሚገነባው ቤት አይነት በአካባቢው ሌማትና 1. The houses to be constructed shall be either

3. Notwithstanding to the provisions of Sub-

14. Organization Process

6. Any individual shall deposit the advance

፯. በባንክና በአዯራጁ መካከሌ በሚዯረግ 7. Based on an agreement between the bank

፰. የክፍሇ ከተማው ጽህፇት ቤት በዚህ አንቀፅ 8. When the sub-city office receives the

ግዳታና ኃሊፉነቶች Obligations and Responsibilities
15. Obligations and Responsibilities of the

Members of the Cooperative
ኃሊፉነት
Every member of a cooperative shall have

፬. ማንኛውም የተመዝጋቢ የማህበር አባሌ of houses in contrary to this Regulation;

በአዯረጃጀትና በአመዘጋገብ ሂዯት 4. Any member of a registered cooperative

የተከሰቱና ከዚህ ዯንብ ውጭ እየተፇጸሙ shall have the responsibility to report

፭. ማንኛውም የማህበሩ አባሌ በተመረጠው ቤት 5. Any member of the cooperative shall have

8. Any member organized under a cooperative

shall enter into an agreement that he can

completion of the construction of the

ቢኖርም አባሌ በሞት ምክንያት ሲሇይ 9. Notwithstanding to the provision stated
under Sub-Article (8) of this Article, it is

possible to transfer such rights to the lawful

፲. የቤቶቹ ግንባታ ሲጠናቀቅ በቦታው 10. When the construction of the houses is

the site and receive the house, to be

፲፩. ከአበዲሪ ባንክ ጋር በሚዯረገው የብዴር 11. Any member shall have the obligation to
pay the remaining payment timely based on

16. Obligations and Responsibilities of the

መሆናቸውን በማረጋገጥ አባሊትን በማሰባሰብ
ሇምዝገባ ዝግጁ ያዯርጋሌ፤
Cooperative
The cooperative shall have the following
obligations and responsibilities:
1. Gather and make members ready for

8. Keep evidences that show the cancellation

ተመዝጋቢዎች ከሆኑ ከምዝገባ ቋት database if he has registered in other
መሰረዛቸውን የሚያሳይ ማስረጃ ይይዛሌ፤ housing development programs;
፱. ከባንክ ጋር ስሇሚኖረው የብዴር ውሌ፣ ሇህንጻ 9. Have the responsibility to carry out matters

issues on behalf of the cooperative.
ኃሊፉነት ይኖርበታሌ፡፡
17. Responsibilities of the Agency
፲፯. የኤጀንሲው ኃሊፉነት The agency shall, without prejudice to the Addis

and registration system of housing
ስሇአመዘጋገብ ስርዓቱ በቂ መረጃ ይሰጣሌ፣
cooperatives;
፪. የአባሌነት፣ የምዝገባ፣ የመስራች ቃሇ-ጉባኤና 2. Prepare membership, registration,
ላልች አስፇሊጊ ቅጻ ቅጾችና ዯጋፉ ሰነድች establishment minute, and other
necessary forms and supplementary

ክፍሌ አምስት Miscellaneous Provisions

20. Special Conditions
ሌዩ ሌዩ ዴንጋጌዎች
1. Matters regarding relations with lender

፳. ሌዩ ሁኔታ banks, returning of loans, the type and

21. Allocating the Building and Rooms by Lot
፩. በማህበር ሇመዯራጀት በቅዴሚያ የማህበር 1. To be organized in a cooperative, allocation

22. Information Handling and Transfer System

The bureau and the agency shall organize and

23. Interdiction
፩. ኤጀንሲው ከሚያስተሊሌፇው የተዯራጆች ስም 1. It is prohibited for any individual to register

፪. በራሱ ወይም በትዲር አጋሩ ስም የመኖሪያ 2. It is prohibited to register an individual that

6. Notwithstanding to the provisions specified

24. Submittal of Complaints

6. An organ who is not satisfied with the

response given according to Sub-Article (5)
የማቅረብ መብት አሇው፤ of this Article shall have the right to submit
the matter to the relevant organ that has the
፳፭. የመተባበር ግዳታ
authority to consider the thereof.
ማንኛውም ሰው ይህን ዯንብ ሇማስፇጸም
የመተባበር ግዳታ አሇበት፡፡ 25. Duty to Cooperate
Any person shall be duty bound for the

implementation of this Regulation.
ማንኛውም ሰው ከዚህ በታች የተዯነገጉትን
ጥፊቶች ፇጽሞ ከተገኘ አግባብ ባሇው የወንጀሌ 26. Accountability
ወይም በፍትሐ ብሔር ወይም በሁሇቱም ሕጎች If any individual commits the following

፩. በዚህ ዯንብ ከተዯነገገው ውጭ በማህበር 1. Apart from the provisions specified

ተዯራጅቶ የመኖሪያ ቤት ተጠቃሚ under this Regulation, if he is organized
ሇመሆን በራሱ ወይም በትዲር ጓዯኛው ስም in a housing cooperative and has got a
በከተማው ውስጥ የመኖሪያ ቤት ወይም house or land for building a house in his
የመኖሪያ መስሪያ ቦታ እያሇው ወይም name or in his spouse’s name in the city
ከዚህ በፉት ኖሮት በሽያጭ ወይም በስጦታ or had a house and transferred his rights
ሇሶስተኛ ወገን መብቱን ያስተሊሇፇ ወይም to a third party through sale or gift or
ከዚህ ቀዯም የኮንድሚኒየም ቤት ዕጣ benefited from condominium program
ተጠቃሚ የሆነ፤ in the past;
፪. በዚህ ዯንብ በአንቀጽ ፳፫ የተከሇከለ 2. If any organ gives evidences or get
ዴርጊቶችን በመተሊሇፍ ጥቅምን ወይም registered or carries out registration
ያሊግባብ መበሌፀግን ሇራሱ ወይም ሇላሊ through fraud and deceit with the

Regulation;
፫. በራሱ ወይም በሚስቱ መኖሪያ ቤት እያሇው
3. If any person has a house in his name or
በዚህ ዯንብ መሠረት በመኖሪያ ቤት
his spouse’s name and is organized in a
ህብረት ስራ ማህበር ተዯራጅቶ ቤት
cooperative as per this Regulation and
ተጠቃሚ ከሆነ በሕግ ተጠያቂነቱ
benefited from it, he shall be forced to
እንዯተጠበቀ ሆኖ በስሙ የወሰዯውን ቦታ
return the house back in addition to
እንዱመሌስ ይዯረጋሌ፤
being held liable according to the
፬. ይህን ዯንብ የተሊሇፇ ማንኛውም የመንግስት
relevant laws;
ኃሊፉ ወይም ሠራተኛ እንዯአግባብነቱ
4. Any head of a public office or civil
አግባብ ባሇው ሕግ መሠረት እና/ወይም
servant that violates this Regulation
በዱስፕሉን ተጠያቂ ይሆናሌ፡፡
shall be held liable with the relevant
፳፯. ተፇፃሚነት ስሇማይኖራቸው ህጎች laws and/or in discipline.

ይህ ዯንብ የሚቃረን የካቢኔው ዯንብ፣ መመሪያ 27. Inapplicable Laws

ወይም የከተማው አስተዲዯር አስፇፃሚ አካሊት Any Regulation or directive issued by the
ያወጧቸው መመሪያ ወይም ሌማዲዊ አሰራር cabinet or directive or customary practices
በዚህ ዯንብ ውስጥ በተሸፇኑ ጉዲዮች ሊይ of the executive organs of the city
ተፇፃሚነት አይኖራቸውም፡፡
government which are inconsistent with this
Regulation, shall have no effect.

፳፰. መመሪያ የማውጣት ሥሌጣን

28. Power to Issue Directives
እንዯአግባብነቱ ቢሮው ወይም ኤጀንሲው ይህንን
The bureau or the agency may accordingly
ዯንብ ሇማስፇፀም የሚያስፇሌጉ መመሪያዎችን
issue directives that are necessary for the
ሉያወጡ ይችሊለ፡፡
implementation of this Regulation.
፳፱. ዯንብ የሚፀናበት ጊዜ

ይህ ዯንብ ከ ሰኔ ፮ ቀን ፪ሺ፲፬ ዓ.ም. ጀምሮ 29. Effective Date

የፀና ይሆናሌ፡፡ This Regulation shall enter into force as of

this 13th day of June 2022.
