Về di sản thừa kế chuyển thành tài sản thuộc quyền sở hữu, quyền sử dụng
hợp pháp của cá nhân
Được Hội đồng Thẩm phán Tòa án nhân dân tối cao thông qua ngày 17 tháng
10 năm 2018 và được công bố theo Quyết định số 269/QĐ-CA ngày 06 tháng 11
năm 2018 của Chánh án Tòa án nhân dân tối cao.

Quyết định giám đốc thẩm số 27/2015/DS-GĐT ngày 16-10-2015 của Hội
đồng Thẩm phán Tòa án nhân dân tối cao về vụ án dân sự “Tranh chấp thừa kế quyền
sử dụng đất” tại thành phố Hà Nội giữa nguyên đơn là bà Phạm Thị H, bà Phạm Thị
H1, bà Phạm Thị H2 với bị đơn là ông Phạm Văn H3; người có quyền lợi, nghĩa vụ
liên quan gồm 12 người.

Khái quát nội dung án lệ:
Nhà, đất là tài sản chung của vợ chồng mà một người chết trước. Người còn
lại và các thừa kế của người chết trước đã thống nhất phân chia nhà, đất. Thỏa thuận
phân chia không vi phạm quyền lợi của bất cứ thừa kế nào.
Việc phân chia nhà, đất đã được thực hiện trên thực tế và đã được điều chỉnh
trên sổ sách giấy tờ về đất đai. Sau khi người còn lại chết mới phát sinh tranh chấp.
Trường hợp này, phải xác định nhà, đất đó đã chuyển thành quyền sở hữu,
quyền sử dụng hợp pháp của các cá nhân. Những người này chỉ có quyền khởi kiện
đòi lại nhà, đất được chia đang bị người khác chiếm hữu, sử dụng bất hợp pháp mà
không có quyền yêu cầu chia di sản thừa kế là nhà, đất.
Các điều 219, 223, 226 Bộ luật Dân sự năm 2005 (tương ứng với các điều
213, 218, 220 Bộ luật Dân sự năm 2015).

thành quyền sử dụng đất hợp pháp của các cá nhân. Vì vậy, bà H, bà H1, bà H2 chỉ
có quyền khởi kiện đòi lại 44,4m2 đất thuộc quyền sử dụng hợp pháp do được chia
từ năm 1991; tài sản là di sản thừa kế của cha mẹ không còn nên không có cơ sở
chấp nhận yêu cầu chia di sản của cụ H, cụ V nữa.”
BÌNH LUẬN
2. Vợ chồng cùng nhau tạo lập, phát triển khối tài sản chung bằng công sức
của mỗi người; có quyền ngang nhau trong việc chiếm hữu, sử dụng, định đoạt tài
sản chung.
3. Vợ chồng cùng bàn bạc, thoả thuận hoặc ủy quyền cho nhau chiếm hữu, sử
dụng, định đoạt tài sản chung.
4. Tài sản chung của vợ chồng có thể phân chia theo thoả thuận hoặc theo
quyết định của Toà án.”
1. Mỗi chủ sở hữu chung theo phần có quyền định đoạt phần quyền sở hữu
của mình theo thoả thuận hoặc theo quy định của pháp luật.
2. Việc định đoạt tài sản chung hợp nhất được thực hiện theo thoả thuận của
các chủ sở hữu chung hoặc theo quy định của pháp luật.

3. Trong trường hợp một chủ sở hữu chung bán phần quyền sở hữu của mình
thì chủ sở hữu chung khác được quyền ưu tiên mua. Trong thời hạn ba tháng đối với
tài sản chung là bất động sản, một tháng đối với tài sản chung là động sản, kể từ
ngày các chủ sở hữu chung khác nhận được thông báo về việc bán và các điều kiện
bán mà không có chủ sở hữu chung nào mua thì chủ sở hữu đó được quyền bán cho
người khác.
Trong trường hợp bán phần quyền sở hữu mà có sự vi phạm về quyền ưu tiên
mua thì trong thời hạn ba tháng, kể từ ngày phát hiện có sự vi phạm về quyền ưu
tiên mua, chủ sở hữu chung theo phần trong số các chủ sở hữu chung có quyền yêu
cầu Toà án chuyển sang cho mình quyền và nghĩa vụ của người mua; bên có lỗi gây
thiệt hại phải bồi thường thiệt hại.
4. Trong trường hợp một trong các chủ sở hữu chung từ bỏ phần quyền sở
hữu của mình hoặc khi người này chết mà không có người thừa kế thì phần quyền
sở hữu đó thuộc Nhà nước, trừ trường hợp sở hữu chung của cộng đồng thì thuộc
sở hữu chung của các chủ sở hữu chung còn lại.”
Sở hữu chung chấm dứt trong các trường hợp sau đây:

Thực tế có nhiều trường hợp nhà, đất do vợ chồng tạo lập trong thời kỳ hôn
nhân, là tài sản chung của vợ chồng mà một người chết trước không để lại di chúc
định đoạt phần tài sản của mình trong khối tài sản chung. Theo quy định của pháp
luật, phần tài sản của người vợ hoặc chồng đã chết trong khối tài sản chung của vợ
chồng trở thành di sản5 và được giải quyết chia thừa kế cho các thừa kế của người
đó. Trường hợp người chết không đểlại di chúc hoặc di chúc không hợp pháp thì
chia thừa kế theo pháp luật6.
Tuy nhiên, trong thực tiễn đời sống xã hội ở Việt Nam, nơi có truyền thống
văn hóa “Trọng đạo”, “Trọng hiếu”,“Trọng tình”, nhiều trường hợp sau khi người
vợ hoặc chồng chết, các thừa kế của người đó (chồng/vợ, con của người đó) không
đặt ra yêu cầu chia thừa kế ngay đối với tài sản do người chết để lại; người chồng
hoặc vợ còn sống tiếp tục quản lý, sử dụng tài sản, sau đó đứng ra phân chia toàn bộ
nhà, đất là tài sản chung của vợ chồng cho các con, với sự đồng ý của những người
này. Việc phân chia nhà, đất được thực hiện trên thực tế, được điều chỉnh trên sổ
sách giấy tờ về đất đai; người được phân chia nhận nhà, đất và quản lý, sử dụng, cho
thuê, cho mượn hoặc chuyển nhượng cho người khác. Có trường hợp sau khi được
phân chia đất, người được phân chia do không có điều kiện trực tiếp quản lý, sử dụng
nên đã giao cho anh, chị, em của mình (cũng là người được cha/mẹ phân chia đất)
thực hiện việc trông nom, quản lý hộ mình; sau một thời gian, họ quay về đòi lại đất
nhưng không được trả nên đã khởi kiện yêu cầu trả lại phần đất đã được chia hoặc chia
thừa kế quyền sử dụng đất của cha mẹ để lại.
Với các tình tiết nêu trên, có quan điểm cho rằng việc người chồng hoặc vợ
còn sống đứng ra phân chia nhà, đất là tài sản chung của vợ chồng cho các con là
không hợp pháp về phần định đoạt tài sản do người vợ hoặc chồng đã chết để lại.

Trường hợp người chết không để lại di chúc thì phần tài sản do người chết để lại
phải được chia thừa kế theo pháp luật, các thừa kế phải được hưởng phần di sản bằng
nhau, cho dù chia bằng hiện vật hay bằng giá trị. Việc người chồng hoặc vợcòn sống
phân chia toàn bộ nhà, đất cho các con, mặc dù những người thừa kế đồng thuận về
việc chia tài sản, là định đoạt vượt quá phần quyền tài sản của họ trong khối tài sản
chung nên thỏa thuận phân chia nhà, đất vô hiệu về phần phân chia tài sản do người
chết để lại. Trường hợp có yêu cầu chia thừa kế thì Tòa án phải thụ lý, giải quyết vụ
án tranh chấp di sản thừa kế.
Quan điểm khác lại cho rằng, khi người chồng hoặc vợ còn sống phân chia
toàn bộ nhà, đất là tài sản chung của vợ chồng cho các con, những người thừa kế của
người để lại di sản đều thống nhất phân chia; trong phần tài sản mỗi người được
nhận có phần là di sản thừa kế, có phần là tài sản được cha, mẹ còn sống tặng cho;
việc phân chia này tuy không tách bạch đâu là phần chia thừa kế, đâu là phần tặng
cho nhưng đều đảm bảo quyền lợi của các con; những người được phân chia đã nhận
nhà, đất trên thực tế, đăng ký kê khai và được đứng tên trên các giấy tờ về nhà, đất
thì phải xác định nhà, đất đó đã chuyển thành tài sản thuộc quyền sở hữu, quyền sử
dụng hợp pháp của các cá nhân, không còn là di sản để chia thừa kế (trường hợp
chưa được cấp giấy chứng nhận quyền sử dụng đất). Những người này chỉ có quyền
khởi kiện đòi lại nhà, đất được chia đang bị người khác chiếm hữu, sử dụng bất hợp
pháp mà không có quyền yêu cầu chia di sản thừa kế là nhà, đất.
Để hướng dẫn áp dụng thống nhất pháp luật, bảo đảm những vụ việc có tình
huống pháp lý tương tự như trên phải được giải quyết như nhau, Tòa án nhân dân tối
cao đã lựa chọn, công bố Án lệ số 24/2018/AL về di sản thừa kế chuyển thành tài
sản thuộc quyền sở hữu, quyền sử dụng hợp pháp của cá nhân. Án lệ này được phát
triển từ Quyết định giám đốc thẩm số 27/2015/DS-GĐT ngày 16-10-2015 của Hội
đồng Thẩm phán Tòa án nhân dân tối cao về vụ án dân sự “Tranh chấp thừa kế quyền

sử dụng đất” tại thành phố Hà Nội giữa nguyên đơn là bà Phạm Thị H, bà Phạm Thị
H1, bà Phạm Thị H2 với bị đơn là ông Phạm Văn H3; người có quyền lợi, nghĩa vụ
liên quan gồm 12 người.
- Thứ nhất, việc người chồng hoặc vợ còn sống và các con thống nhất phân
chia toàn bộ nhà, đất của vợ chồng cho các con, tức là phân chia cả phần tài sản do

người chết để lại và phần tài sản của người còn sống trong khối tài sản chung thì
việc phân chia này có hợp pháp hay không? Nhà, đất sau khi phân chia có còn là di
sản hay không?
- Thứ hai, người đã được phân chia nhà, đất có quyền yêu cầu chia di sản thừa
kế của cha, mẹ để lại hay không? Trường hợp nhà, đất mà họ được chia bị người
khác (cũng là người được phân chia nhà, đất) chiếm hữu, sử dụng bất hợp pháp mà
họ có yêu cầu được trả lại thì quan hệ pháp luật có tranh chấp được Tòa án thụ lý,
giải quyết là gì?
Về vấn đề pháp lý thứ nhất, tại Quyết định giám đốc thẩm số 27/2015/DS-
GĐT, Hội đồng Thẩm phán Tòa án nhân dân tối cao đã lập luận rằng“…nhà đất của
cụ V, cụ H đã được cụ V và các thừa kế của cụ H thống nhất phân chia tài sản chung
xong từ năm 1991 và đủ cơ sở xác định phần đất 110m2 trong đó phần bà H, bà H1
và bà H2 là 44,4m2. Việc phân chia đã được thực hiện trên thực tế và đã được điều
chỉnh trên sổ sách giấy tờ về đất đai; thỏa thuận phân chia không vi phạm quyền lợi
của bất cứ thừa kế nào, không ai tranh chấp nên có cơ sở xác định nhà, đất không
còn là di sản thừa kế của cụ V, cụ H nữa mà đã chuyển thành quyền sử dụng đất hợp
pháp của các cá nhân”. Lập luận này trong quyết định giám đốc thẩm đã được Hội
đồng Thẩm phán Tòa án nhân dân tối cao lựa chọn, phát triển thành Án lệ số
24/2018/AL.
Án lệ đã đưa ra những điều kiện cần và đủ để xác định trường hợp nào thì di
sản thừa kế chuyển thành tài sản thuộc quyền sở hữu, quyền sử dụng hợp pháp của
cá nhân. Theo đó, việc người chồng hoặc vợ còn sống cùng với các thừa kế của
người chết trước thống nhất phân chia toàn bộ nhà, đất của vợ chồng là hợp pháp
khi có đủ các điều kiện sau:
(1) Các bên thỏa thuận thống nhất phân chia nhà, đất;

(2)Thỏa thuận phân chia không vi phạm quyền lợi của bất cứ thừa kế nào,
không có ai tranh chấp;
(3) Việc phân chia đã được thực hiện trên thực tế và được điều chỉnh trên sổ
sách giấy tờ về đất đai.
Các điều kiện nêu trên chính là điều kiện đảm bảo thỏa thuận phân chia thể
hiện đúng ý chí của các bên, bảo đảm quyền và lợi ích hợp pháp của các bên theo
quy định của pháp luật, phù hợp với nguyên tắc tự do, tự nguyện cam kết, thỏa thuận
trong giao dịch dân sự. Về mặt thủ tục, việc chuyển dịch về quyền tài sản thuộc diện
phải đăng ký quyền sở hữu, quyền sử dụng được cơ quan Nhà nước có thẩm quyền
ghi nhận. Án lệ đã khẳng định đối với trường hợp này, nhà, đất không còn là di sản
thừa kế mà đã chuyển thành tài sản thuộc quyền sở hữu, quyền sử dụng hợp pháp
của các cá nhân.
Án lệ số 24/2018/AL được tạo lập nhằm hướng dẫn các Tòa án giải quyết các
tranh chấp liên quan đến nhà, đất là tài sản chung của vợ chồng mà một người chết
trước, người còn lại và các thừa kế của người chết trước tự thỏa thuận thống nhất

phân chia nhà, đất. Theo đó, nếu thỏa thuận phân chia không vi phạm quyền lợi của
bất cứ thừa kế nào, việc phân chia nhà, đất đã được thực hiện trên thực tế và đã được
điều chỉnh trên sổ sách giấy tờ về đất đai (thể hiện trên Bản đồ địa chính, sổ mục kê,
sổ đăng ký ruộng đất… mà chưa được cấp Giấy chứng nhận quyền sử dụng đất), sau
khi người còn lại chết mới phát sinh tranh chấp thì khi giải quyết vụ án, Tòa án phải
xác định nhà, đất đó đã chuyển thành tài sản thuộc quyền sở hữu, quyền sử dụng hợp
pháp của các cá nhân; những người này chỉ có quyền khởi kiện đòi lại nhà, đất được
chia đang bị người khác chiếm hữu, sử dụng bất hợp pháp mà không có quyền yêu
cầu chia di sản thừa kế là nhà, đất. Án lệ được áp dụng khi vụ việc có đầy đủ các
tình tiết pháp lý như đã nêu ở trên.
Trong Án lệ này, tài sản chung của vợ chồng là nhà, đất. Vậy, trường hợp tài
sản chung của vợ chồng là tài sản khác (không phải là nhà đất) mà một người chết
trước không để lại di chúc, người còn lại và các thừa kế của người chết trước đã
thống nhất phân chia tài sản đó, thỏa thuận phân chia đã được thực hiện trên thực tế,
không vi phạm quyền lợi của bất cứ thừa kế nào thì Tòa án cũng có thể nghiên cứu,
xem xét vận dụng án lệ này để giải quyết.

Regarding estates becoming property under the legitimate ownership and use
rights of individuals
The Cassation Decision No. 27/2015/ DS-GĐT dated 16 October 2015 of the
Justices Council of the Supreme People's Court concerning a civil case "dispute over
inheritance of land use rights" in Hanoi City between Ms. Pham Thi H, Ms. Pham
Thi H1, Ms. Pham Thi H2 (plaintiffs) and Mr. Pham Van H3 (defendant); 12 persons
have related interests and obligations.
- Precedent situation:
House and land are spousal common property between husband and wife, but
one of them passed away first. The other and the heirs of the former have agreed to
distribute the house and land. The distribution agreement did not violate the rights

of any heir.
The distribution of the house and land has been carried out and the ownership
status of that property has been adjusted in the administrative records. After the
remainder died, disputes concerning the property arose.
- Legal solution:
In this case, it is necessary to determine that such house and land have became
the property under the legitimate ownership of the concerned individuals. Those
persons only have the right to initiate lawsuits to recover their part of house and land,
which are illegally possessed and/or used by other people, but do not have the right
to initiate lawsuits over the distribution of the house and land as estates.
Articles 219, 223, 226 of the Civil Code 2005 (corresponding to Articles 213,
218, 220 of the Civil Code 2015).

COMMENTARY
2. Husband and wife who jointly establish and develop the common property
through theefforts of each shall have equal rights in the possession, use and
disposition of such property.
3. Husband and wife shall discuss, agree or authorize each other to the
possession, use anddisposition of the common property.

provided for by law.
In cases where the sale of ownership right shares violates the pre-emptive
right to purchase, anyof the co-owners of the property under common ownership by
shares shall, within three monthsfrom the date of detecting the violation of the pre-
emptive right to purchase, have the right torequest the Court to transfer to him/her
the rights and obligations of the purchaser; the party atfault in causing damage must
pay compensation therefor.

2. One of the co-owners is entitled to the entire common property;
In fact, there are many cases where husband and wife during their marriage
own property together as spousal common property, but one of them dies first and
does not leave a will to determine his share of the common property. According to
the law, the share of deceased husband or wife in the common property becomes an
estate11 and is distributed among his/her heirs. In cases where the decedent does not
leave a will or the will is unlawful, the estate shall be distributed according to the
law.12
However, in the practice of the social life in Vietnam, where there is a cultural
tradition of “emphasizing the morality, filial piety and love”, there are many cases
where heirs (husband/wife, children of decedents) do not make a request for
distribution of estates immediately after the death of their family member. The
surviving husband or wife continues to manage and use the property, and then
distributes the entire house and land, which are the spousal common property, to
their children based on their consensus. The distribution of land and house is
conducted and the ownership status of such property is adjusted in the administrative
records; sharers may receive their own parts of the house and land to manage, use,
lease, lend or transfer to others. In some cases, after the distribution, the sharer may
ask his or her sibling (who is also the other sharer of the land distributed by their
parent) to look after and manage the land on one’s behalf; however, after a while, he

or she may return to take the land back but gets refused, which leads to a lawsuit to
reclaim his or her distributed part of the land or claim for distribution of his or her
parents' land as their estates.
With the above-mentioned facts, there is a view that it is illegal for the
surviving wife or husband to distribute the house and land, which are the spousal
common property, including the decedent’s part to their children. In case the
decedent does not leave a will, the part of the property left by the decedent must be
inherited according to law, and the heirs must enjoy an equal share of the estate,
regardless of whether it is distributed in kind or in money. The distribution of the
entire house and land by the surviving husband or wife, even if the heirs reach an
agreement on that distribution, is a disposition beyond his or her share of ownership
rights with respect to the common property. Therefore, the agreement on such
distribution of houses and land is invalid as far as the decedent’s property is
concerned. In case there is a claim for distribution of the inheritance, the court shall
accept and settle it as an inheritance dispute.
The other view is that if the surviving husband or wife distribute the entire
house and land, which are the spousal common property, to their children and all
heirs agree to the distribution, the part of the property that each person receives
consists of both the inheritance and the gift by the surviving father or mother.
Although such distribution does not clarify which is the inheritance share and which
is the gift, it still ensures the interests of the children. The sharers have actually
received their respective parts of the house and land, and completed the registration
and declaration procedure for having their names on the property certificates; thus,
it is necessary to determine that the house and land have become the property under
the legitimate ownership and use rights of individuals and are no longer subject to
inheritance distribution. Those sharers only have the right to initiate lawsuits to

reclaim the part of house and land as distributed, which are illegally possessed or
used by other people, but do not have the right to claim for distribution of the house
and land as estates.
For the purpose of guiding lower courts to uniformly apply the law and
ensuring that cases with the similar facts as shown above shall be resolved similarly,
the Supreme People's Court has decided to publish Precedent No. 24/2018/AL on
estates becoming property under the legitimate ownership and use rights of
individuals. This Precedent is developed from the Cassation Decision No.
27/2015/DS-GĐT dated 16 October 2015 of the Justices Council of the Supreme
People's Court on a civil case "dispute over inheritance of land use rights" in Hanoi
City between Ms. Pham Thi H, Ms. Pham Thi H1, Ms. Pham Thi H2 (plaintiffs) and
Mr. Pham Van H3 (defendant); 12 persons have related interests and obligations.
In the case that became the basis for Precedent No. 24/2018/AL, Mr. Pham
Van H (died in 1978) and his wife - Ngo Thi V (died in 1994), have 07 children
named Pham Thi H, Pham Thi H1, Pham Thi H2, Pham Van H3, Pham Van Đ (died
in 1998), Pham Van T, Pham Van Q (died in 2000). Mr. H and his wife had created
a common property, which is a cottage on a land with an area size of 464m2 in Q
town, Ha Tay province (now belonging to Hanoi city). After Mr. H's death, Mrs. V
held a meeting with the attendance of her children to entirely distribute the land
among them. No one had any objection about it and all of them agreed to implement
this distribution. With respect to the land distributed to Mr. D (94 m2), Mr. Q (78
m2), Mr. T (189 m2), they all received the land and registered to have their name on
the certificates or transferred the land to a third party (registered for adjustment in
administrative records), and there has been no disputes to date. For the remaining
110 m2 of land, Mr. V distributed it to Mr. H3 and Ms. H, H1, H2, in which Ms. H,

H1, H2 share 44.4m2. At the time of the distribution, Ms. H, H1, H2 were living
elsewhere and they did not see the need to use that plot so Mr. H3 have been
managing it. In 2004, Ms. H, H1, H2 needed to build a house on the plot of land but
Mr. H3 refused to acknowledge that such plot belongs to his three sisters and did not
agree to return the land to them. Thus, Ms. H, H1, H2 initiated a lawsuit requesting
the Court to force Mr. H3 to return 44.4m2 of the land distributed to them; they then
changed their statement to claim for distribution of the 110m2 of land, which Mr.
H3 is managing, as their parents’ estate.
- First, whether it is lawful for a surviving husband or wife and the children
to agree to entirely distribute the house and land belonging to spousal common
property, i.e. including parts of the property of both surviving person and decedent.
Is the house or land still an estate after being distributed?
- Second, whether the person, who has a share of the land and house that has
been distributed, still has the right to claim for distribution of the inheritance of his
or her parents? In case where the part of house and land that has been distributed to
a person is illegally possessed and used by another person (who is also the sharer)
and he or she initiate a lawsuit to recover the land in question, what should that
disputing relationship be categorized by the Court for acceptance and settlement?
For the first question, in the Cassation Decision No. 27/2015/DS-GĐT, the
Justices Council states that: “The common house and land of Mrs. V and Mr. H [who
are spouse] was distributed as the common property based on the agreement among
Mr. V and Mrs. H’s heirs in 1991. There exists enough grounds to define the 110m2
land area, in which the part distributed to Mrs. H, Ms. H1 and Ms. H2 is totally
44.4m2. The distribution was conducted in fact and the ownership status of the land
and house was adjusted in the administrative records; the distribution agreement

does not violate the rights of any heir, no one dispute about that, thus there are
grounds to determine that the house and land are no longer the estate of Mr. V and
Mrs. H but become the legistimate land use right of individuals”. This statement of
the Cassation Decision have been selected by the Justices Council to develop into
the Precedent No. 24/2018/AL.
(1) All parties reach an agreement for distribution of the house and land;
(2) The distribution agreement does not violate rights of any heir, no one has
raised an objection;
(3) The distribution was factually conducted and the ownership status of the
land and house was adjusted in the administrative records.
Those conditions ensure that the distribution agreement accurately reflects the
will of the parties, safeguard the legitimate rights and interests of the parties under
the law, in accordance with the principle of free and voluntary commitment and
agreement in civil transactions. Regarding administrative procedure, this transfer of
property rights must be subjected to ownership registration recognized by competent
State agencies. The Precedent thus affirms that in this situation, house and land is no
longer estates, but has become property under the legitimate ownership and use
rights of individuals.
For the second question, the Precedent states that “…Mrs. H, Ms. H1 and Ms.
H2 only have the right to initiate lawsuits to reclaim the part of 44,4m2 of the house

and land under their legistimate use rights as distributed in 1991; the inheritance
does no longer exist so that there is not ground to accept their claim for distribution
of the estates of Mrs. H and Mr. V.” The precedent indicates the line to uniformly
apply the procedure law; accordingly, in cases where the estate had become the
property under legistimate ownership and use rights of individuals, the sharers only
have the right to initiate lawsuits to reclaim the part of house and land as distributed,
which are illegally possessed or used by other people, but do not have the right to
claim for distribution of the house and land as inheritance.
In this precedent, the spousal common property between husband and wife are
land and house. In the case where the spousal common property is different kind of
assets (other than land or house), if one them dies first and does not leave a will, the
other and the heirs of the former then agreed to distribute that property, the

distribution agreement is already implemented in fact and does not violate the rights
of any heir, the Court may consider to apply this precedent for the settlement.
