በአማራ ብሔራዊ ክልላዊ መንግስት የምግብ፣ A COUNCIL OF REGIONAL
የመድኃኒትና የጤና እንክብካቤ አስተዳደርና ቁጥጥርን GOVERNMENT REGULATION ISSUED TO
ለመወሰን የወጣ ክልል መስተዳድር ምክር ቤት ደንብ DETEMINE THE ADMINISTRATION
AND CONTROL OF FOOD, MEDICINE
AND HEALTH CARE IN THE AMHARA
NATIONAL REGIONAL STATE
ደህንነቱና ጥራቱ ባልተጠበቀ ምግብ ምክንያት WHEREAS, it is necessary to prevent risks which

ክብካቤ አስተዳደርና ቁጥጥር አዋጅ ቁጥር 661/2002 ዓ/ም Executive Organs’ Re-establishment and
አንቀጽ 55 ንዑስ አንቀጽ (2) ድንጋጌዎች ሥር በተሰጠዉ ስልጣን Determination of their Powers and Duties
መሠረት ይህንን ደንብ አውጥቷል፡፡ Proclamation No. 176/2010 and Art. 55 Sub-Art. 2
of the F.D.R.E’s Food, Medicine and Health Care
Administration and Control Proclamation No.
661/2009, hereby issues this regulation.

ጠቅላላ GENERAL

1. አጭር ርዕስ 1. Short Title


ይህ ደንብ "የመድኃኒትና የጤና እንክብካቤ አስተዳደርና This regulating may be cited as “The Food,

2. ትርጓሜ 2. Definitions
1. የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆን 1. Unless the context requires otherwise, in

ሀ. "አዋጅ" ማለት በፌዴራሉ መንግሥት የወጣው A. “Proclamation” shall mean the Food,

ረ. “የአልኮል መጠጥ” ማለት በማናቸዉም መጠን ቢሆን F. “Liquor” shall mean a drink which possesses

ሰ. “የምግብ ንግድ” ማለት ምግብንና የምግብ ጥሬ እቃዎችን G. "Food Trade'' shall mean the production,

ሸ. “የመድሃኒት ንግድ ስራ“ ማለት መድሃኒቶችን ለትርፍ H. “Medicinal trade Activity” shall mean the

ቀ. “የባህላዊ ሕክምና አዋቂ” ማለት ባህላዊ ሕክምና I. “traditional practitioner” means a person

ተ. “አደገኛ ኬሚካል” ማለት በጥንቃቄ ካልተያዘ ወይም K. “Dangerous Chemical” shall mean any

አ. “ለይቶ ማቆየት” ማለት በተላላፊ በሽታ የተያዙ ሰዎች P. “Isolation” shall mean causing those persons

to perform such activities;

ኸ. “የጤና አገልግሎት” ማለት የጤና ባለሙያው R. “Health Service” shall mean any type of

ዠ. “ተቋም” ማለት ማናቸዉም የጤና ተቋም፣ ጤና-ነክ V. “Institution” shall mean any health

የ. “የምግብ ተቋም” ማለት በምግብ ንግድ ስራ ላይ W. “Food Establishment” shall mean any

ደ. “ምግብ አዘጋጅ” ማለት በምግብ ንግድ ስራ ውስጥ X. “Cook” shall mean any person who has,

መከልከል ነው፡፡

ገ. “እገዳ” ማለት የቁጥጥር ስራ በሚካሄድባቸው ጉዳዮች Z. “Suspension” shall mean an administrative

ጰ. “ተቆጣጣሪ” ማለት በዚህ ደንብ መሠረት የቁጥጥር CC. “Inspector” shall mean any professional

ወረቀት”፣ “አስመስሎ ማቅረብ”፣ “ቆሸሻ”፣
“poor environmental sanitation”, “health
“የአካባቢ ጤና አጠባበቅ ጉድለት”፣ “የጤና ባለሙያ”፣
professional”, “medicinal professional”,
“የመድሀኒት ባለሙያ”፣ “ባህላዊ ህክምና”፣ “የሙያ
“traditional medication”, “licence”, “health

CONTROL
4. ጠቅላላ 4. General

13. ስለአልኮል መጠጦች ሽያጭ 13. Sale of Liquor


1. ማንኛውም ሰው አግባብ ባለው አካል የወጣውን ደረጃ 1. Any person may not produce, prepare, store
ሣያሟላና ንጽህናውን ባልጠበቀ ሁኔታ የአልኮል or sell alcoholic drinks without fulfilling the

15. ምግብን eKS ያዝና ስለማስወገድ 15. Seizure and Disposal of Food

1. ቢሮው በዚህ ደንብ መሠረት አንድን ምግብ K=ይዝ 1. The Bureau may, pursuant to this regulation, be
ወይም እንዲወገድ ሊያደርግ ¾T>‹K¨<' able to seize or cause the disposal of a food
item where it is ascertained that:

ሀ) ቀድሞውኑ በገበያ ላይ እንዲዉል ያልተፈቀደ፤ A. it has not been allowed into the market in
the first place;

ለ) በማስመሰል ተዘጋጅቶ የቀረበ፤ B. it is provided for use having been


prepared in counterfeiting;

ሐ) የአገልግሎት ጊዜዉ ያለፈ ወይም የጥራት C. it has expired or found out to be as not
ደረጃውን የማያሟላ ሆኖ ከተገኘ፤ having fulfilled its quality standard;

መ) የመልካም አመራረት አሰራርን ሳይጠብቅ D. it has been manufactured without

ሠ) የምግብ ንግድ ሥራን ለማካሄድ የብቃት ማረጋገጫ E. it has been produced, stored, distributed,

16. eK መድኃኒት ችርቻሮ ንግድ ድርጂቶች 16. Medicine Retailer Business


Organizations
1. ማናቸዉም የመድኃኒት ችርቻሮ ንግድ ድርጅት 1. Any medicine retail business organization
›ÑMÓKAƒ SeÖ ት ከመጀመሩ uòƒ ከቢሮዉ ¾wnƒ shall request for and obtain a certificate of
T[ÒÑÝ Ue¡` ¨[kƒ መጠየቅና ማግኘት ›Kuƒ፡፡ competence from the Bureau before it shall
commenced delivering such service.

2. ማንኛውም ሰው በቢሮዉ ከተፈቀደለት ቦታ፣ ባለሙያ 2. No person may render a service of

1. ከባለሥልጣኑ የተሰጠ ፈቃድ ሳይኖር በክልሉ ውስጥ 1. It is prohibited to conduct clinical practice

18. eK መርዞችና Ú[` ›õLm SÉ ኃ’>ቶች 18. Poisons and Radio Active Medicines
1. ከባለሥልጣኑ ፈቃድ ሳይኖር በክልሉ ውስጥ በሚገኙ 1. It is prohibited to produce, import, handle,

1. ቢሮው የናርኮቲክና ሳይኮትሮፒክ መድሀኒቶች ጥቅም 1. The Bureau shall supervise those narcotic

1. ባህላዊ የሕክምና ተቋም ለማቋቋም የሚፈልግ 1. Any person desiring to establish an

21. ስለ ተደጋጋፊና አማራጭ መድሀኒቶች 21. Complementary and Alternative

3. ŸSÉH’>ƒ Ò` ቀጥታ Ó”–<’ƒ ያለዉ ማንኛውም የጤና 3. Any health professional directly related to

›eSM¡„ ¾T>ÁÒØS¨<” ‹Ó` ቢኖር ወዲያዉኑ problems, if any, to the body concerned with
KT>SKŸ}¨< ›ካ M T ሳ¨p ›Kuƒ፡፡ regard to the safety, efficacy and quality of the
medicine thereof.

23. መድኃኒትን eKS ያዝና ስለማስወገድ 23. Seizure and Disposal of Medicine
1. ቢሮዉ የትኛውንም መድኃኒት K=ይዝና እንዲወገድ 1. The Bureau may be able to seize and cause the

prepared in counterfeiting;

ሐ) ¾›ÑMÓKAƒ ጊዜዉ ያለፈ ወይም የጥራት ደረጃውን C. it has expired or is found out to be as having
የማያሟላ ሆኖ ሲገኝ፤ not met its quality standard thereof;

መ) የመድኃኒት ንግድ ሥራን ለማካሄድ የብቃት D. it is stored, distributed, made ready for

purpose of authorized medical practice;

ረ) ከደረጃ በላይ ሆኖ የተገኘ ሲሆን፣ F. it is found to be beyond and above the


standard;

ሰ) ለህብረተሰቡ ጤና ጎጂ ነገሮች መኖራቸው ወይም ሌሎች G. it is disclosed as having contained


ተመሳሳይ ደረጃዎችን የማያሟላ መሆኑ ሲረጋገጥ substances harmful to the health of the
ወይም፣ community or failed to comply with ther
similar requirements; or

ሸ) ያለ ኢንቮይስ የተገዛ ሲሆን፡፡ H. it has been procured without an invoice.

2. በዚህ አንቀጽ ንዑስ አንቀጽ (1) (ረ) መሰረት የተያዘው 2. Where the medicine seized pursuant to Sub.Art.
መድኃኒት ከደረጃ በላይ ሆኖ የተገኘ እንደሆነ ጥራቱ፣ (1), (F) of this Article hereof is found to be

የትምባሆ ዝግጅትን ስለመቆጣጠር CONTROL OF TOBACCO PRODUCTS

24. ፈቃድ ስለማስፈለጉ 24. Requirement of a Permit


1. ማናቸዉንም ¾ƒUvJ ዝግጅት በጅምላም ሆነ 1. It shall be in a business organization that has

26. eK ትምባሆ ዝግጅት ማሸጊያና ገላጭ ጽሁፍ 26. Tobacco Product Packaging and
Labelling
1. በ ƒUvJ ዝግጅት ‹`‰a ”ÓÉ ሥራ ላይ የተሰማራ 1. Any person engaging in an activity of

c¨< ¾ƒUvJ ዝግጅቱ ’ÖL û ኬ ƒ# ጥቅል ማሸጊያ tobacco products shall ensure that the single

28. ማጨስ ስለሚከለከልባቸው ቦታዎች 28. Smoking-Banned Places


1. ሕዝብ በሚሰበሰብበት ወይም በሚገለገልበት 1. It is prohibited to smoke tobacco in any place
በማናቸውም ቦታ ትንባሆ ማጨስ ክልክል ነው፡፡ used for public gatherings or rendering
services.

2. “ሕዝብ የሚሰበሰብበት ወይም የሚገለገልበት ቦታ” 2. The phrase referred to as “Place used for Public

the followings:

ሀ. የጤና ተቋማት፤ A. health institutions;

ለ. ትምህርት ቤቶች፤ B. schools;

ሐ. የህዝብ ማጓጓዣዎች፣እና C. public transport facilities; and

መ. አግባብ ያለዉ አካል እንዳይጨስባቸዉ D. Other places to be determined as not open


የሚወሰንባቸው ሌሎች ስፍራዎች:: for smoking by the pertinent organ.

3. የዚህ አንቀጽ ንዑስ አንቀጽ 1 ድንጋጌ ቢኖርም 3. Notwithstanding the provision of Sub. Art. (1)
ሕዝብ የሚሰበሰብባቸው ወይም የሚገለገልባቸው of this Article hereof, the Bureau may set aside

CONTROL OF HYGINE,

29. ስለአደገኛ ኬሚካል 29. Dangerous Chemical


1. ማንኛውም አደገኛ ኬሚካል በክልሉ ውስጥ 1. Where any dangerous chemical is transported,

1. ማንኛውም ሰው ደረቅ፣ ፍሳሽ ወይም ሌላ ዓይነት 1. No person may transport, collect or dispose

3. ከኢንዱስትሪ ተቋማት ወይም ከሌሎች የሥራ ቦታዎች 3. Any type of gas, chemical vapour, fumes,

Facilities
1. ማኛኛውም መኖሪያ ቤት ንጽህናው የተጠበቀ እና በቂ 1. Any residential house shall be furnished with

40. ስለሙያ ስራ ፈቃድ አስፈላጊነት 40. Requirement of Professional Licence

as “The Council”/ is hereby established under this
regulation.

51. ስለጉባኤው አባላት ጥንቅር 51. Composition of Members of the


Council
ጉባኤው የሚከተሉት አባላት ይኖሩታል፤ The council shall have the following members:

52. የጉባዔው ሥልጣንና ተግባር 52. Powers and Duties of the Council
ጉባዔው በዚህ ደንብ መሠረት የሚከተሉት ስልጣና ተግባራት The council shall, pursuant to this regulation,
ይኖሩታል፡- have the following powers and duties:

1. የጤና ባለሙያዎችን የሙያ ፈቃድና ምዝገባ 1. Assist the Bureau with regard to the

2. ከጤና ባለሙያዎች የሥነ-ምግባር ግድፈት ጋር 2. Receive and examine complaints having to do

ሥነ-ስርዓት Procedure of the Council


1. የጉባኤው መደበኛ ስብሰባ በየሁለት ወሩ የሚያካሂድ 1. The ordinary meeting of the council shall be

1. ማንኛውም የህ¡U“ vKS<Á ምስጢራ© ህ¡U“ SeÖƒ 1. Any medical practitioner shall not provide
¾KuƒU፡፡ for secret medication.

2. ማንኛውም ¾Ö?“ vKS<Á የጤና ›ÑMÓKAƒ 2. Where any health professional engages in
uT>cØuƒ Ñ>²? ለዚሁ የሚገለገልበት የህክምና መሳሪያ the provision health of services, the medical

3. ለዚህ አንቀጽ አፈጻጸም ሲባል “ምeጢ^© I¡U“” TKƒ 3. For the implementation of this Article,
ŸK?KA‹ c‹ ¾T>Åup“ uØmƒ c‹ w‰ የሚታወቅ “Secret Medication” shall mean a medicine
ሆኖ uiታ” KTÇ” ¨ÃU ¾Ö?“ ‹Ó`” KSp[õ ¨ÃU or medication which has been concealed

to cure diseases, alleviate health problem or
mitigate illness.

60. ስለማስተዋወቅ 60. Advertisement


1. T”—¨<U ¾Ö?“ vKS<Á ›Óvw vK¨< ¾S”ÓYƒ 1. No health professional may advertise the

thereof.

5. T”—¨<U ¾Ö?“ vKS<Á የሚገልጸው የሙያ 5. The professional advertisement task which

Bureau.

2. T”—¨<U ¾Ö?“ vKS<Á በግል ሊያገኘው 2. No health professional may, having due
¾T>‹K¨<” ØpU ከግምት ¨<eØ uTeÑvƒ regard to the possibility of obtaining

1. ማንኛውም የጤና ባለሙያ ተገልጋዩን የሚመለከቱ 1. Where any health professional provides

ጽሁፍ ሆኖ በዚሁ ላይ ሙሉ ስሙንና ፊርማውን ማስፈር other data pertaining to the service seeking

2. ማንኛውም የጤና ባለሙያ ጥያቄ ሲቀርብለት 2. Any health professional shall, upon request,

2. የዚህ አንቀጽ ንዑስ አንቀጽ (1) ድንጋጌ ቢኖርም 2. Notwithstanding the provision of Sub-Ar.(1)
ማንኛውም የጤና ባለሙያ አግባብ ባለው ሕግ መሰረት of this Article hereof, any health professional
በሚከተሉት ሁኔታዎች ብቻ የሰውነት አካላትን ሊወስድ may take away or provide support for the

the relevant laws only on the following

ሀ/ በሕይወት ካለ ሰው ለንቅለ ተከላ ዓላማ፣ ወይም A. From a human being alive for the purpose
of transplantation; or

ለ/ ከሞተ ሰው ለምርምር፣ ለትምህርት ወይም ለንቅለ B. From the dead person for the purposes of
ተከላ ዓላማ፡፡ research, education or transplantation.

69. ስለ ሞትና አስከሬን ምርመራ 69. Death and Examination of Corpses


1. ሞትን ሊያረጋግጥ የሚችለው ይህንኑ እንዲያከናውን 1. Death may be verified by a health

ማንኛውም የጤና ባለሙያ በጤና ተቋም ውስጥ ከታካሚ ጋር Any health professional shall fully register

71. ሪፖርት ስለማድረግ 71. Reporting


1. ማንኛዉም የጤና ባለሙያ ከዚህ በታች የተመለከቱትን 1. Any health professional ought to report to the

herebelow:
ሀ/ እክል ገጥሞታል ብሎ ያመነበትን የሌላ የጤና ባለሙያ A. the problem of another health professional
ችግር፤ whom he has believed to be in difficulty;
ለ/ በይፋ እንዲያውቅ የተደረገ ከሆነና በተጠረጠረበት B. his own difficulty where he has explicitly
ወይም በተረጋገጠበት እክል ምክንያት ተገቢውን been made explicitly aware of such

INSTITUTIONS

72. ለተቋማት ስለሚሰጥ የ wnƒ ማረጋገጫ Ue¡` ¨[kƒ 72. Certificate of Competence to be Issued
the Institutions
1. አንድን ተቋም ለመመሥረት የሚፈልግ ማንኛውም ሰው 1. Any person desiring to establish an institution
ከቢሮዉ የብቃት ማረጋገጫ ምስክር ወረቀት ማግኘት shall obtain a certificate of competence from
