አሰጣጥ ሥርዓት ደንብ ቁጥር ፻፲፰/፪ሺ፯ Service Delivery System Regulation No 118/2014

መግቢያ
ጤና ለአንድ ህብረተሰብ የአካል፣ የአዕምሮ እና
የማህበራዊ ደህንነት መሠረት ሲሆን መድኃኒት ደግሞ
ለጤና አገልግሎቱ ስኬታማነት ወሳኝ ድርሻ ያለው
በመሆኑ እና በክልሉ ውስጥ አስፈላጊ መድኃኒቶችና
የሕክምና መሳሪያዎች በበቂ መጠን መኖራቸውንና
በአግባቡ ጥቅም ላይ መዋላቸውን ማረጋገጥ አስፈላጊ
በመሆኑ፤
ጤና ተቋማት ለጤና አገልግሎት ከሚመደብላቸዉ በጀት
መካከል ከፍተኛዉን ድርሻ ለመድኃኒት አገልግሎት
እየመደቡ ቢሆንም የመድኃኒት አቅርቦት፣ ስርጭት፣
የመድኃኒት አጠቃቀም እንዲሁም የመረጃ አያያዝና
አጠቃቀም ተገቢውን ትኩረት እንዲያገኝ በማስፈለጉ፤
የመድኃኒት አስተዳደርና አገልግሎት አሰጣጡ ጠንካራ
የሆነ ስርዓት የተከተለ ካለመሆኑ ጋር ተያይዞ እየተከሰተ
ባለው ብክነትና ምዝበራ፣ ህገ ወጥ የመድኃኒት ዝውውር
እና ኢ-ፍትሃዊ የመድኃኒት በጀት አጠቃቀም የተነሳ
የሚደርሰውን ማህበራዊና ኢኮኖሚያዊ
ማስተካከል አስፈላጊ ሆኖ በመገኘቱ፤
Preamble
Whereas; it has been applicable to ensure the
appropriate usage and availability of enough amount
of the necessary medicine and medical equipments in
the region as health is the foundation for physical,
mental and social security of a society, and medicines
have major contribution to the success of health
service as well;
Whereas, it is necessary to offer the appropriate due
attention for medicine supply, distribution, medicine
use as well as medicine information recording and
utilization although health institutions allocate
significant share of health service budget to
phrmcalelutical services;
Whereas; it has been found necessary to correct

social and economical impediment resulted from
misuse and fraudulent, illegal medicine transfer and
unfair pharmaceutical budget usage which come due
to rigorous pharmaceutical administration service
system not being followed
አግባብነት በሌለው የመድኃኒት አጠቃቀምና አያያዝ
ምክንያት በተለይም ከጸረ-ተህዋስያን መድኃኒቶች
ፍቱንነት አቅም መዳከም ጋር ተያይዞ በህዝብ ላይ
እየደረሰ ያለውን የጤና ችግር እና የኢኮኖሚ ኪሳራ
መከላከል ወሳኝ ሆኖ በመገኘቱ፣

ጤና ተቋማት ለመድኃኒት አስተዳደር የሚጠቀሙባቸው

የመንግስት የፋይናንስ ሰነዶች የመድኃኒት ቅብብሎሹን
እና አገልግሎት አሰጣጡን ግልጽነትና ተጠያቂነት ያለው
እንዲሆን እና ኦዲት ለማድረግ እንዲያመች እንዲሁም
የጤና ተቋማትን የገንዘብ አቅም ማሳደግ አስፈላጊ
በመሆኑ፣

በቢሮዉ፣ በዞን፣ በከተማ አስተዳደር፣ በልዩ ወረዳና ወረዳ

እንዲሁም በጤና ተቋማት የመድኃኒት ክፍሎች
አደረጃጀት፣ የመረጃ አያያዝ፣ የሰዉ ኃይል አመዳደብና
አጠቃቀም፣ አመራርና የአገልግሎት አሰጣጥ የተገልጋዩን
ፍላጎት በሚያረካ እና ለመስኩ ሊዉል የሚችለዉን
ውስን ሃብት በአግባቡ፣ በተቀላጠፈና ዉጤታማ በሆነ
መንገድ መጠቀም የሚያስችል ስርዓት መዘርጋት
በማስፈለጉ፤

ደህንነታቸው፣ ፈዋሽነታቸው፣ ጥራታቸው በተገቢው

አካል የተረጋገጠ እና የህብረተሰቡን የመግዛት አቅም
ያገናዘበ መሰረታዊ መድኃኒቶችን በተመጣጣኝ ዋጋና
ቀጣይነት ባለዉ መልኩ ለተጠቃሚዉ ህብረተሰብ
ግልጽነትና ተጠያቂነት በሰፈነበት ስርዓት መቅረባቸዉን
ማረጋገጥ አስፈላጊ በመሆኑ፤

የደቡብ ብሔሮች፣ ብሔረሰቦችና ሕዝቦች ክልል

መንግሥት የአስፈፃሚ አካላትን ሥልጣንና ተግባር እንደገና
Whereas, it has been found very pivotal to eradicate
health problem as well as economic crisis that ለመወሰን

ክፍል አንድ
 5. "የጤና አገልግሎት" ማለት የሰውን ልጅ ጤንነት
ለመጠበቅ የሚደረግ በሽታን የመከላከል፣
Now therefore, southern Nation, Nationalities and
peoples’ Regional state has issued this regulation inየመመርመር፣ የማከም፣ የመምከር፣ የመድኃኒት
accordance with sub-article /1/ ariticle /45/ of theአገልግሎት የመስጠት ተግባር ነው፤
proclamation No 133/2010 issued to redetermine the
power and duty of executive bodies; 6. “የመድኃኒት አገልግሎት” ማለት በጤና ተቋማት
ውስጥ ፈቃድ ባለው የመድኃኒት ባለሙያ
የሚከናውን የእለት ተእለት የሥራ እንቅስቃሴ
ሲሆን አቅርቦትን፣ ክምችትን፣ ስርጭትን፣
Part One 3 ቅመማን፣ ሽያጭን፣ ህሙማን ተኮር የመድኃኒት

General አገልግሎትን፣ ዕደላን፣ የምክር አገልግሎትን፣

 1. Short Title

፱ “የሕክምና መሣሪያ” ማለት የሰውን በሽታ

ለመመርመር ወይም ለማከም በውስጥ ወይም
5. “Health Service” means an act of diseaseበውጭ አካል ላይ ጥቅም ላይ የሚውል
prevention, diagnosis, treatment, counseling andማንኛውም መሣሪያ ወይም መገልገያ ሲሆን
የተለያዩ የመመርመሪያ የላብራቶሪ፣ የቀዶ
delivering of pharmaceutical service for the wellህክምና መሣሪያዎች፣ እንዲሁም ለላብራቶሪ፣
being of human health. ለራጅ እና ለድንገተኛ ክፍል አገልግሎት የሚውሉ
የተለያዩ ማሽኖች፣ አልጋዎች፣ ስትሬቸር፣
ዊልቸሮች፣ የደም ግፊት መለኪያና የመሳሰሉ
መሣሪያዎችን እና መገልገያዎችን ያካትታል፤
. “የመድኃኒት ማዘዣ ወረቀት” ማለት ፈቃድ ባለው
6. “Pharmaceutical Service” means any ፲activity
of a day to day nature carried out by a pharmacy
የሕክምና ባለሙያ የሚጻፍና በመድኃኒት ባለሙያ
personnel up on the consent of health institution
ተተርጉሞ መድኃኒትን ከበቂ መረጃ ጋር ለህሙማን
and may include supply, storage, distribution.

ለማደል የሚያገለግልና ለዚሁ ዓላማ ተብሎ በተገቢው
formulation, sale, patient base pharmaceutical
አካል ደረጃ ወጥቶለት የተዘጋጀ ህጋዊ የማዘዣ ወረቀት
 03. “ነጠላ መሸጫ ዋጋ” ማለት የነጠላ ወይም
የአንድ እሽግ የመድኃኒት የመግዣ ዋጋና
9. “Medical Instrument” means any instrument
ለትራንስፖርትና መሰል ወጪዎች ዋጋ ላይ
or utility that may be used on the inner or outer
ሥራውን ለማቀላጠፍ የሚረዳ ከ 30 በመቶ
part of the body medical instruments as well as
ያልበለጠ የትርፍ ምጣኔ በመጨመር ጤና
those various machines, beds, stretcher,
ተቋሙ መድኃኒቶችን የሚሸጥበት ዋጋ ነው፤
wheelchair, BP apparatus and other familiar
04. “የችርቻሮ ዋጋ” ማለት ከነጠላ የመድኃኒት
instruments and utilities used in laboratory, x-ray
ዋጋ በመነሳት የሚሰላ ሲሆን መድኃኒቱን ጤና
and emergency room;
ተቋሙ በሽያጭ ለተጠቃሚው
የሚያስተላልፍበት ሲሆን ከነጠላ ዋጋ ጋር እኩል

10. “Prescription Paper” means a legal document ወይም ሊያንስ የሚችል የመጠን መለኪያ
ዋጋ ነዉ፤

ማለት የተፈቀደ መድኃኒትን በተፈቀደለት

 06. “ህገ ወጥ የመድኃኒት ዝውውር” ማለት
13. “Unit Selling Price” means a unit price in መድኃኒትን ባልተፈቀደለት ሰው ወይም
which the health institution sales medicines to ካልተፈቀደ ምንጭ ወይም የሙያ ደረጃው
the customers by adding not more than 30% በማይመጥን ሰው ወይም ደህንነቱ
profit margin on purchase price and transport ባልተጠበቀ አያያዝ ወይም በማንኛውም
and other related expense of one unit or pack of ከህግ በሚጻረር አኳኋን ህብረተሰቡን
medicine; በሚጎዳ መልኩ ያልተገባ ጥቅምን ለማግኘት
የሚደረግ ህገወጥ የመድኃኒት ቅብብሎሽ
ነው፤
07. “የዕርዳታ መድኃኒት” ማለት ከተቋሙ
14. “Retail Price” means a price, which calculated በጀት ውጭ የሆኑና ከተለያዩ ድርጅቶች በነፃ
by taking a unit price as a bench-mark, of a ለጤና ተቋሙ የሚለገስ መድኃኒት ነው፤

08. “የእጅ በእጅ ሽያጭ” ማለት መድኃኒቶችን
the drug to the consumer by sale, the amount of በተቀመጠላቸው የነጠላ ወይንም የችርቻሮ

for a unit price hereof; 6 በማስፈፀም ለተጠቃሚው የማስተላለፍ

 09. “የዱቤ ሽያጭ” ማለት በሽያጭ

፳፩ “ከክፍያ ነጻ የሆኑ መድኃኒቶች” ማለት

16. “Illegal Transfer of Medicines” means an በዕርዳታ የተገኙ ወይም በበጀት የተገዙ
መድኃኒቶች ሆነው መንግሥት በነፃ
illegal medicine transfer that to carry out through
እንዲስተናገዱ ለወሰናቸው የህክምና
unlicensed person or source, or unprofessional አገልግሎት ዓይነቶች ያለክፍያ
person, or not well handled medicine, or harming ለተጠቃሚው የሚታደሉ መድኃኒቶች
ናቸው፤

17. “Donated Medicines” means those medicines
፳፫ “የመድኃኒት የምርት መለያ ቁጥር” ማለት
which are outside the budget of the institution
በአንድ የምርት ሂደት ወቅት የተመረቱ
and have been denoted free by different
መድኃኒቶችን ለመለየት በአምራቹ ድርጅት
organizations to health institution;
የሚሰጥ በማሸጊያው ላይ እና በግዥ ወይም
18. “Cash Sale” means the act of transferring በእርዳታ ዝርዝር ሠነዱ ላይ በግልጽ የሚፃፍ

 ፳፮ “የተስተካከለ ሽያጭ” ማለት በቀን ሽያጭ

21. “Payment Free Medicine” means dispense ofአማካይነት ከተሰበሰበው ገንዘብ ውስጥ
በማስበለጥም ሆነ በማሳነስ የተሸጡትን
those medicing obtained from donation or by
government budget to patients without any መድኃኒቶች በመመርመር፣ የአገልግሎት ዋጋን
ሳይጨምር፣ በቀን የተሸጠው የመድኃኒቱ
payment where the government has decided to be
delivered free; ትክክለኛ ዋጋ ለብቻ ተለይቶ የሚገኝ ሽያጭ
ነው፡፡
፳፯ ‘‘ህሙማን ተኮር የፋርማሲ አገልግሎት’’
ማለት ትክክለኛ የመድኃኒት አጠቃቀምን
22. “Pharmacy Professionals” means ለማረጋገጥ
a ፋርማሲስቶች በአስተኝቶ ማከም፣
በተመላላሽ ህክምና አሰጣጥና የክትትል ሂደቱ
professional trained in the field of pharmacy and
licensed at each level by appropriate organላይ to ቀጥተኛ ተሳታፊ በመሆን፣ ህሙማኑ
carry out his duty as pharmacist, druggist ካላስፈላጊ የመድኃኒት ወጪ እና ፈውስን
or
ከማግኘት አንጻር የላቀ ተጠቃሚ እዲሆኑና
pharmacy technician;

መከላከል ከሚቻል የመድኃኒት ጉዳት በጸዳ
መልኩ የሚፈለገውን የህክምና ውጤት
23. “Drug Production Identification Code” means
ለማግኘት የሚያስችል የፋርማሲ አገልግሎት
a number assigned to identify each batch ዘርፍ

 ፴ “ጥቅም ላይ የማይውሉ መድኃኒቶች” ማለት
የተበከሉ፣ በተገቢው ሁኔታ ያልተቀመጡ፣
26. “Adjusted Sale” means the correct value of
አላግባብ የተከፈቱ፣ የቀዝቃዛ ሰንሰለት
medicines sold per day which shall be
ያልጠበቁ፣ በተገቢው አካል ጥቅም ላይ
identified by auditing the overages and
እንዳይውሉ የተከለከሉ፣ የአገልግሎት ዘመን
shortages of total daily collected sales and by
ማብቂያ ያለፈባቸው እና በሌሎች ምክንያቶች
excluding the total daily service fees; የይዘት ለውጥ ያስከተሉና ለሰው ጤና አደገኛ
የሆኑ መድኃኒቶች ናቸው፤
፴፩. “የፅንስ ስም” ማለት ከአገር አገር ወይም ከፋብሪካ
ፋብሪካ የማይለዋወጥ በመድኃኒቱ ንጥረ ነገር
27. “Patient-centered Pharmacy Service”
ላይ ተመስርቶ የወጣ የመድኃኒት መለያ ስም
means pharmacy service section that enable ነው፡፡
፴፪ “የመድኃኒት ሂሣብ ሠራተኛ” ማለት በአካውንቲንግ

The regulation shall have the following

concerning medicine service; provideበጋራ የመስራት፣ መድኃኒቶችን በጋራ የመረከብ፣
feedback; የማስተዳደር እና የመንከባከብ የጋራ ኃላፊነትና

ተቋሙ የገባውን ጠቅላላ የመድኃኒት ዋጋ
24. Inventory of Drugs በመደመር፣ ከዚሁ ላይ በወሩ ውስጥ
የተሸጠውን ድምር የመድኃኒት ዋጋ እና ጥቅም
1. Any health institution shall carry out physical ላይ የማይውሉ መድኃኒቶችን በመለየት፣
ከወጭ ቀሪ ያለውን መድኃኒት ለጤና ተቋሙ

25. System of Financial Reporting እና የማስተካከያ እርምጃ መውሰድ አለበት፡፡

1. Any medicines dispensed according to their

type (sale ,credit or free) to patients shall be
reported in accordance with daily sales
summary form prepared by the finance and
economic development bureau;

 2. Any pharmacy accountant shall report ፳፯. the ጥቅም ላይ የማይውሉ መድኃኒቶችን ሪፖርት
transaction balance to the head of health ስለማድረግ
1. ማንኛውም የተቋሙ የስራ ክፍል በሌሎች ህጎች

26. Reporting Service Delivery ማድረግ አለበት፡፡
2. በዚህ አንቀጽ ንዑስ አንቀፅ (፩) የተጠቀሱትን

ከሌሎች አገልግሎት ከሚሰጡ መድኃኒቶች

3. Any pharmacy accountant shall have the
responsibility to keep records of the number of
patients and the type of service delivered by
him in the health institution and report same at
the end of the month,
4. Any health institution shall report concerning
the overall activities of the pharmacy
department based on the format that prepared
by the bureau,
5. Any health institution shall review monthly,
quarterly and annual reports regarding
pharmaceutical services, and take supportive
and corrective measures.

27. Reporting Unfit for Use Medicine
፳፰. ኦዲት ስለማስደረግ

28. Auditing
መድኃኒቶች ህጋዊ የግዥ ደረሰኝ እና በእርዳታ

1. Any health institution shall audit the ለሚያገኛቸው የሰጪው ደረሰኝ ወይም

appropriateness of the overall health institution የመድኃኒቱን ማንነት እና ምንጩን የሚገልጹ

pharmaceutical services by the joint cooperation የማስጫኛ ሰነዶችን መቀበል አለበት፡፡

29. Prevention Illegal Medicines Transfer
ግልጽ ማድረግ አለበት፡፡

1. Any health institution shall ensure that of a

medicine found through donation or bought

Miscellaneous Provision

31. Duty to Cooperative

Any person shall have the duty to cooperate on

the performance of this regulation

32. Penalty

Any person violate the provisions under this

regulation and directive to issue the regulation
shall be penalized based on criminal law

33. Inapplicable Laws

No regulation, directive or customary practice in-

consistent with this regulation shall apply

34. Power to Issue directive
The bureau may issue directive to implement
this regulation

35. Effective date

This regulation shall come in to force as of the
data of its official publication on debub negarit
gazeta.
