መግቢያ
ጤና ለአንድ ህብረተሰብ የአካል፣ የአዕምሮ እና
የማህበራዊ ደህንነት መሠረት ሲሆን መድኃኒት
ደግሞ ለጤና አገልግሎቱ ስኬታማነት ወሳኝ
ድርሻ ያለው በመሆኑ እና በክልሉ ውስጥ
አስፈላጊ መድኃኒቶችና የሕክምና መሳሪያዎች
በበቂ መጠን መኖራቸውንና በአግባቡ ጥቅም ላይ
መዋላቸውን ማረጋገጥ አስፈላጊ በመሆኑ፤
Preamble
Whereas; it has been applicable to ensure the
appropriate usage and availability of enough amount
of the necessary medicine and medical equipments in
the region as health is the foundation for physical,
mental and social security of a society, and medicines
have major contribution to the success of health
service as well;

ጤና ተቋማት ለጤና አገልግሎት Whereas, it is necessary to offer the appropriate due

ከሚመደብላቸዉ በጀት መካከል ከፍተኛዉን ድርሻ
ለመድኃኒት አገልግሎት እየመደቡ ቢሆንም
የመድኃኒት አቅርቦት፣ ስርጭት፣ የመድኃኒት
አጠቃቀም እንዲሁም የመረጃ አያያዝና አጠቃቀም
ተገቢውን ትኩረት እንዲያገኝ በማስፈለጉ፤
attention for medicine supply, distribution, medicine
use as well as medicine information recording and
utilization although health institutions allocate
significant share of health service budget to
phrmcalelutical services;

የመድኃኒት አስተዳደርና አገልግሎት አሰጣጡ
ጠንካራ የሆነ ስርዓት የተከተለ ካለመሆኑ ጋር
ተያይዞ እየተከሰተ ባለው ብክነትና ምዝበራ፣ ህገ
ወጥ የመድኃኒት ዝውውር እና ኢ-ፍትሃዊ
የመድኃኒት በጀት አጠቃቀም የተነሳ
የሚደርሰውን ማህበራዊና ኢኮኖሚያዊ ችግር
ማስተካከል አስፈላጊ ሆኖ በመገኘቱ፤
Whereas; it has been found necessary to correct
social and economical impediment resulted from
misuse and fraudulent, illegal medicine transfer and
unfair pharmaceutical budget usage which come due
to rigorous pharmaceutical administration service
system not being followed
አግባብነት በሌለው የመድኃኒት አጠቃቀምና Whereas, it has been found very pivotal to eradicate
health problem as well as economic crisis that occur
አያያዝ ምክንያት በተለይም ከጸረ-ተህዋስያን
upon the people due to irrelevant pharmaceutical
መድኃኒቶች ፍቱንነት አቅም መዳከም ጋር usage and handling especial associated with the

Whereas, it is necessary to lay down a system for

የሚችለዉን ውስን ሃብት በአግባቡ፣ በተቀላጠፈና administration, special woreda, woreda as well as in

ስርዓት መዘርጋት በማስፈለጉ፤

ደህንነታቸው፣ ፈዋሽነታቸው፣ ጥራታቸው Whereas, it is found useful to assure the provision

እንደገና ለመወሰን የወጣ አዋጅ ቁጥር ፻፴፫/፪፼፫
አንቀጽ ፵፭ ንዑስ አንቀጽ ፩ በተሰጠዉ ስልጣን
Now therefore, southern Nation, Nationalities and
peoples’ Regional state has issued this regulation in
accordance with sub-article /1/ ariticle /45/ of the
proclamation No 133/2010 issued to redetermine the
power and duty of executive bodies;

መሠረት ይህን ደንብ አውጥቷል፡፡

ክፍል አንድ Part One

ጠቅላላ General

1. አጭር ርዕስ 1. Short Title

This regulation may be cited as “ Southern

2. Definition
2. ትርጓሜ
Unless the context requires otherwise, in this
የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው regulation;
ካልሆነ በስተቀር በዚህ ደንብ፡-
1. “Region” means Southern Nation,
1. "ክልል" ማለት የደቡብ ብሔሮች

ብሔረሰቦችና ሕዝቦች ክልል ነው፤
2. “Bureau” means Southern Nation,
2. "ቢሮ" ማለት የደቡብ ብሔሮች ብሔረሰቦችና Nationalities and Peoples’ Region Health
ሕዝቦች ክልል መንግስት ጤና ቢሮ ነው፤ Bureau;
3. "የጤና ተቋም" ማለት ለህብረተሰቡ የጤና
3. “Health Institution” means government
አገልግሎት የሚሰጥ ሆኖ በቢሮ ስር

5. "የጤና አገልግሎት" ማለት የሰውን ልጅ 5. “Health Service” means an act of disease
ጤንነት ለመጠበቅ የሚደረግ በሽታን prevention, diagnosis, treatment, counseling and

6. “የመድኃኒት አገልግሎት” ማለት በጤና 6. “Pharmaceutical Service” means any activity

ሽያጭን፣ ህሙማን ተኮር የመድኃኒት
አገልግሎትን፣ ዕደላን፣ የምክር service, dispensing, counseling, document
አገልግሎትን፣ ሠነድ አያያዝን፣ የመረጃ handing, information service and other related
አገልግሎትንና ሌሎች ተዛማጅ ተግባራትን service.
ያካትታል፤

7. “መድኃኒት” ማለት በሽታን ለመመርመር፣ 7. “Medicine” means any substance or a mixture of

8. “የሕክምና መገልገያ” ማለት በሽታን 8. “Medical Utility” means any utility that may be

ኬሚካሎችን የጨረር ፊልሞችንና መሰል

ይጨምራል፤

፱ “የሕክምና መሣሪያ” ማለት የሰውን በሽታ 9. “Medical Instrument” means any instrument
ለመመርመር ወይም ለማከም በውስጥ ወይም or utility that may be used on the inner or outer

part of the body medical instruments as well as

የሚውሉ የተለያዩ ማሽኖች፣ አልጋዎች፣ and emergency room;
ስትሬቸር፣ ዊልቸሮች፣ የደም ግፊት
መለኪያና የመሳሰሉ መሣሪያዎችን እና
መገልገያዎችን ያካትታል፤
፲. “የመድኃኒት ማዘዣ ወረቀት” ማለት ፈቃድ 10. “Prescription Paper” means a legal document
of instruction written by a duly licensed medical
ባለው የሕክምና ባለሙያ የሚጻፍና በመድኃኒት
professional and interpreted by a pharmacy
ባለሙያ ተተርጉሞ መድኃኒትን ከበቂ መረጃ ጋር
personnel which will serve to dispense medicines

to patients together with adequate information;
ተብሎ በተገቢው አካል ደረጃ ወጥቶለት የተዘጋጀ
ህጋዊ የማዘዣ ወረቀት ነው፡፡
11. “Medicine Accessibility” means providing

02. “የመግዢያ ዋጋ” ማለት በመድኃኒት 12. “Purchasing Price” means the price of

03. “ነጠላ መሸጫ ዋጋ” ማለት የነጠላ 13. “Unit Selling Price” means a unit price in

04. “የችርቻሮ ዋጋ” ማለት ከነጠላ 14. “Retail Price” means a price, which calculated

keeping its security and following legal supply

chain; it also includes the function that
ማስተላለፍ ሲሆን የአገልግሎት ጊዜያቸው
transferring medicines, among health institutions
በመቃረቡ ምክንያት ወይም ከፍላጎት በላይ
following legal system when medicines are not
ክምችት በመኖሩ ወይም ድንገተኛ
fully utilized within the expiry date or over
የመድኃኒት እጥረት ሲያጋጥም በጤና
stocked or there is in urge at shortage of such
ተቋማት መካከል ህጋዊ አሰራርን ተከትሎ
medicines in another institution.
መድኃኒትን አዘዋውሮ አገልግሎት ላይ
እንዲውል የማድረግ ተግባርንም
ይጨምራል፤

06. “ህገ ወጥ የመድኃኒት ዝውውር” 16. “Illegal Transfer of Medicines” means an

17. “Donated Medicines” means those medicines

19. “Credit Sales” means an act of transferring

 ፳፩ “ከክፍያ ነጻ የሆኑ መድኃኒቶች” ማለት 21. “Payment Free Medicine” means dispense of

‹ “የመድኃኒት ባለሙያ” ማለት አግባብ 22. “Pharmacy Professionals” means a

፳፯ ‘‘ህሙማን ተኮር የፋርማሲ አገልግሎት’’ 27. “Patient-centered Pharmacy Service”

ማለት ትክክለኛ የመድኃኒት አጠቃቀምን means pharmacy service section that enable

አስተዳደር ህግ መሠረት ያከናውናል፡፡
መ. በግዥ ወይም በእርዳታ የተገኘ መድኃኒት
ወደ መድኃኒት መጋዘን ከመግባቱ በፊት
የተጠየቀው የመድኃኒት ዓይነትና መጠን፣
ያልተበላሸ፣ የአገልግሎት ጊዜው ያላለፈና

Any health institution:-
ማንኛውም የጤና ተቋም፡-

 12. Medicine Storage and Handling

1. ማንኛውም ጤና ተቋም መድኃኒት 1. Any health institution shall concerning

በችርቻሮ መሸጫ ዋጋ መሰረት በሶስት ቅጅ
ተዘጋጅቶ ዋናው ለተገልጋዩ፣ የመጀመሪያዉ
ቅጅ ለገንዘብ ተቀባይ ሲሰጥ
ደግሞ ከሰነዱ ጋር መቀመጥ አለበት፡፡
4. የመድኃኒት ሽያጭ ለማከናወን የተመደበው

ሽፋን ስለመሸጥ
1. The provision under sub-article /1/ of article

፲፱. ስለ መድኃኒት አስተዛዘዝ 19.Prescribing Medicine
1. በጤና ተቋሙ የሚሰጠው ህክምና በአገር 1. Medical treatment given by health institution

፳፬. የመድኃኒት ቆጠራ 24. Inventory of Drugs

1. ማንኛውም የመንግስት ጤና ተቋም 1. Any health institution shall carry out physical

በመድኃኒትና ህክምና ኮሚቴ እና ጥራት
ኮሚቴ የጋራ ትብብር ቢያንስ በየስድስት
ወሩ ማስገምገም አለበት፡፡
2. ማንኛውም የጤና ተቋም በአጠቃላይ
በጤና ተቋሙ ውስጥ የሚከናወነውን
የመድኃኒት ቅብብሎሽ ስርዓቱን እና
አገልግሎት አሰጣጡን ቢያንስ በየሦስት
ወሩ በውስጥ ኦዲተር እና ቢያንስ
በዓመት አንድ ጊዜ በዋና ኦዲተር ወይም
ዋና ኦዲተር በሚሰይመው ኦዲተር
ኦዲት በማስደረግ ለተቋሙ የበላይ ኃላፊ
ማቅረብ አለበት፡፡
3. በዚህ አንቀጽ ንዑስ አንቀጽ (፪)
የተጠቀሰው እንደተጠበቀ ሆኖ አስፈላጊ
ሆኖ ሲገኝ ጤና ተቋሙ በማንኛውም
ጊዜ ኦዲት ማስደረግ ይችላል፡፡
1. Any health institution shall audit the
appropriateness of the overall health institution
pharmaceutical services by the joint cooperation
of the drug and therapeutic committee and quality
compliance committee at least in every six months;
2. Any health institution shall cause to audit and
submit to higher official the overall health
institution pharmaceutical supply chain system
and its operation at least in every three months
by internal auditor, and at least once in a year
by major auditor or auditor to be assigned by
auditor general;
3. Without prejudice the prescription in sub-
article /2/ of this article, the health institution
may make an audit when found necessary.

Preventing Illegal Pharmaceutical

32. Penalty
፴፪. ቅጣት
በዚህ ደንብ የተጠቀሱትን ድንጋጌዎች Any person violate the provisions under this
regulation and directive to issue the regulation
ወይም ደንቡን ለማስፈፀም የሚወጣውን
shall be penalized based on criminal law
መመሪያ የተላለፈ ማንኛውም ሰው
በወንጀል ህግ መሰረት ይቀጣል፡፡

፴፫. ተፈጻሚነት ስለማይኖራቸው ህጎች 33. Inapplicable Laws

ይህን ደንብ የሚቃረን ማናቸውም ደንብ፣ No regulation, directive or customary practice in-
consistent with this regulation shall apply
መመሪያ ወይም ልማዳዊ አሠራር
ተፈፃሚነት አይኖረውም፡፡

፴፬. መመሪያ የማውጣት ስልጣን 34. Power to Issue directive

ቢሮው ይህን ደንብ ለማስፈፀም መመሪያ The bureau may issue directive to implement
this regulation
ሊያወጣ ይችላል፡፡
35. Effective date
፴፭. ደንቡ የሚጸናበት ጊዜ
ይህ ደንብ በደቡብ ነጋሪት ጋዜጣ ታትሞ This regulation shall come in to force as of the
data of its official publication on debub negarit
ከወጣበት ቀን ጀምሮ የጸና ይሆናል፡፡ gazeta.
