ሥነ-ሥርዓት አዋጅ ቁጥር
Whereas, for implementation of the amended pardon
፩፻፶፯/፪ሺ፯ን ለማስፈፀም የሚያስችል አደረጃጀት እና አሰራር
granting proclamation no. 157/2007 it has become
በግልፅና በዝርዝር የሚደነግግ የይቅርታ አሰጣጥ ደንብ ማውጣት
necessary to enact clear and detail structure and
በማስፈለጉ፤
operation of procedure of pardon Granting Regulation;
ይቅርታ የማያሰጡ ወይም የሚያስከለክሉ ወንጀሎች እና ሁኔታዎች
Whereas, it has become necessary to make the standards of
በዝርዝር በመደንገግ የይቅርታ አሰጣጥ መሥፈርቶች የበለጠ ግልፅ
pardon Granting more clear by providing the details of

Now, therefore, the council of southern nations,
ምክር ቤት የክልሉ የአስፈጻሚ አካላትን ስልጣንና ተግባር Nationalities and peoples’ government, in accordance with
እንደገና ለመወሰን በወጣው አዋጅ ቁጥር ፩፻፷፩/፪ሺ ô Article 45 redefined of powers and duties of the Executive
organs of southern nations, Nationalities and peoples’
አንቀጽ ፵፭ እና በተሻሻለው የክልሉ የይቅርታ አሰጣጥ government proclamation No 161/2015 and Article 3 of the
ሥነ-ሥርዓት አዋጅ ቁጥር ፩፻፶፯/፪ሺ፯ አንቀፅ ፳፰ ንዑስ amended procedure of pardon granting proclamation no.
157/2007 hereby issued this Regulation.
አንቀፅ ፫ በተሰጠው ስልጣን መሰረት ይህን ደንብ አውጥቷል፡፡

ጠቅላላ

 1. አጭርርዕስ

ይህ ደንብ “የደቡብ ብሔሮች፣ ብሔረሰቦችና ሕዝቦች ክልል

መንግስት የይቅርታ አሰጣጥ ሥነ-
ሥነ-ሥርዓት ደንብ ቁጥር
PART ONE
፩፻፵፩//፪ሺ ô ”ተብሎ ሊጠቀስ ይችላል፡፡
GENERAL
1. SHORT TITLE
2. ትርጓሜ
This regulation may be cited as "Southern

፩፻፶፯/፪ሺ፯ ትርጉም የተሰጣቸው በዚህ ደንብ ውስጥ
141/2008." 
ጥቅም ላይ የዋሉ ቃላትና ሃረጎች በአዋጁ የተሰጣቸውን
ትርጉም ይይዛሉ፡፡ ከዚህ በተጨማሪም በዚህ ደንብ ውስጥ፡-

ሀ) “ጽሕፈት ቤት” ማለት በአዋጁ በአንቀፅ ፲፪ የተደራጀው 2. Definitions 

የደቡብ ብሔሮች፣ ብሔረሰቦች ሕዝቦች
መንግሥት  የይቅርታ ቦርድ ጽሕፈት ቤት ነው፡፡
ለ)    “የሕግ ታራሚ” ማለት ሥልጣን ባለው የክልሉ ፍርድ ቤት
በተከሰሰበት ወንጀል  የመጨረሻ የቅጣት ውሣኔ አግኝቶ
በክልሉ እና ከክልሉ ውጪ በሚገኝ ማረሚያ ተቋም ውስጥ
ሆኖ የተወሰነበትን ቅጣት   በመፈፀም ላይ የሚገኝ የሕግ
ታራሚ ነው፡፡
ሐ)   “የይቅርታ ጥያቄ” ማለት አንድ ፍርድ በሙሉ ወይም
በከፊል ቀሪ እንዲሆን ወይም የቅጣቱ አፈፃፀምና ዓይነት
በቀላል ሁኔታ እንዲፈፀም የሚቀርብ ጥያቄ   ነው፡፡
መ) “ሕገ-ወጥ የሰዎች ዝውውር ወንጀል” ማለት ሕገ-ወጥ
የሰዎች ዝውውር እና ስደተኞችን በሕገወጥ መንገድ ድንበር ማሻገር
ወንጀልን ለመከላከልና ለመቆጣጠር በወጣው አዋጅ ቁጥር ፱፻፱/፪ሺ፯
በአንቀፅ ð፣ ñ እና ò የተጠቀሱትን ድርጊቶች ያካትታል፡፡
Words and Phrases used in this regulation are
ክልል
defined according to Southern Nations,
Nationalities and Peoples Regional State of
amended procedure of pardon granting
proclamation no 157/2007. In addition, in this
regulation: 
a) "Office" means Southern Nations, Nationalities
and Peoples Regional State of Board of
pardon established according to Article 12 of
the proclamation.
B) "Prisoner" means a person that had the final
decision on punishment of criminal case by
competent regional court and carrying out
sentence within or out of the region of prison
administration.

ክፍል ሁለት

ይቅታ ስለማያሰጡ ወንጀሎች እና ሁኔታዎች

c) "Petition for pardon" means an application
submitted that a sentence be remitted in whole

d) "Illegal human trafficking crime” means an

proclamation No. 909/2015.
ለ/ ጠለፋ፤
ሐ/ ግብረ-ሰዶም፤
መ/ ከባድ ውንብድና ሆኖ ከ፭ ዓመት በላይ ቅጣት part two 
የተወሰነበት፤ Non- pardonable crimes and conditions
ሠ/ የግፍ ወይም የጭካኔ አገዳደል፤
ረ/ የሙስና ወንጀሎች በሙሉ፣ 3. non- pardonable crimes or conditions 
ሰ/ በሕገ-ወጥ የሰዎች ዝውውር ወንጀል የተቀጣ፣
ሸ/ ሀሰተኛ ሠነድ በማዘጋጀት ወይም መገልገል ወንጀል 1) The following crimes and conditions are non-
የተቀጣ፣ pardonable. 
ቀ/ በክልሉ መንግስት ገቢዎች ወይም የገንዘብ ጥቅሞች a) rape, 
ወይም በልማት አውታሮች ላይ ወንጀል ፈፅሞ የተቀጣ፣ b ) abduction, 
በ/ ይቅርታ ካገኘ በኋላ በድጋሚ ወንጀል ሰርቶ ወደ ማረሚያ ተቋም የገባ c / homosexual, 
ታራሚ፤
d/ a prisoner who committed aggravated robbery
ተ/ በዓቃቤ ሕግ ይግባኝ ወይም የሰበር አቤቱታ ያቀረበበት የህግ ታራሚ፣
crime punished above 5 years
ቸ/ ከማረሚያ ቤት ሊያመለጥ የሞከረ ወይም ያመለጠ ወይም በከባድ
ዲስፕሊን ጥፋት የተቀጣ ታራሚ፤
e/ Aggravated homicide, 
f / all corruption, 
፪ 2. በዚህ አንቀፅ ንዑስ አንቀጽ ፩ ከ“ሀ” እስከ “ቸ”
” የተገለፀው ቢኖርም g / sentenced by human trafficking, 
ከሚከተሉት ምክንያቶች መካከል አንዱ ተሟልቶ ከተገኘ ታራሚው
h / forgery or use forged instruments,
የፈጸመው ወንጀል ይቅርታ የሚያሰጠው ይሆናል፣
ሀ)    በኤች አይቪ፣ በካንሰር፣ በስኳር እና በሌሎች በሐኪሞች
ድጋፍና የተለየ እንክብካቤ ሊድን የማይችል መሆኑ i/ crimes against revenue or financial benefits of the
በሐኪሞች ቦርድ ተረጋግጦ ተቀባይነቱ region or crimes on public infrastructures, 
ሲታመንበት፣የአካል ጉዳተኛ ሆኖ በሕመሙ ምክንያት
ያለሰው ድጋፍ መንቀሳቀስ የማይችል ሆኖ ከተገኘ j. a person who granted pardon found convicted on
የማረሚያ ተቋሙን ወይም የሌሎችን ሰዎች ተደጋጋሚ another crime.
እርዳታ የሚፈልግ የሕግ ታራሚ ከተወሰነበት ቅጣት k/ a prisoner against whom prosecutor filed an appeal or
አንድ ሶሰተኛውን በማረሚያ ቤት ካሳለፈ፤ cassation complaint.

 ለ)  ህፃን ልጅ ይዛ ማረሚያ ቤት የገባች እናት ከተወሰነባት ቅጣት አንድ l/ a prisoner who has been attempted to escape or
ሶስተኛውን ከታሰረች፤
escaped from prisoner administration or punished on
ሐ) ዕድሜው ፷ ዓመት እና በላይ የሆነ የሕግ ታራሚ ከተወሰነበት ቅጣት
grave disciplinary infringement
አንድ ሶስተኛውን ከታሰረ፤
፫ 3. በዚህ አንቀጽ ንዑስ አንቀጽ ፩ የተደነገገው እንደተጠበቀ ሆኖ
2/ Notwithstanding sub article 1 from "a" to "l" of this
የህግ ታራሚው ይቅርታ የሚደረግለት፤
prisoner, who fulfills one of the following reasons

ሀ. ለአፈጻጸም አስቸጋሪ ሆኖ ካልተገኘ በስተቀር ከተጐጂው shall be granted pardon:

ወይም ተጐጂው በአካባቢው ወይም በሕይወት ከሌለ
ከተጐጂው ቤተሰብ ጋር የዕርቅ ስምምነት መፈፀሙን
a) prisoner who has served one third of his
ወይም ለመፈጸም መሞከሩን የሚያስረዳ ማስረጃ
imprisonment term and has a certificate of medical
ሲያቀርብ፤
board that verifies as he has been affected by HIV,
cancer, diabetes and other diseases ,which cannot
ለ. የገንዘብ መቀጮ የተፈረደበት የህግ ታራሚ ከሆነ የመክፈል
cured by medical treatment or a disabled prisoner
አቅም እንደሌለው ከሚኖርበት ቀበሌ በሚገኘው
who continuously requires the prison administration
ማህበራዊ ፍርድ ቤት የተረጋገጠ ሕጋዊ ማስረጃ ማቅረብ
help for his or her movement and who has served
የሚችል ካልሆነ በስተቀር መቀጮውን ለመንግስት የከፈለ
one third penalty of imprisonment .
ሲሆን ነው፡፡
b) aWomen prisoner who had a child in prison
፬ 4) በዚህ አንቀጽ ንዑስ አንቀጽ ፩፣ ፪ እና ፫ የተደነገገው
ቢኖርም ለክልሉ ሰላም፣ ልማት እና ለሕግ የበላይነት administration has undergone one third penalty of
መስፈን ጠቃሚና አስፈላጊ መሆኑ ከታመነበት imprisonment,
በቦርዱ አቅራቢነት ርዕሰ መስተዳደሩ በሕገ-መንግስቱ c) a prisoner who had attained the age of 60 years and
አንቀጽ ÷ô በሰው ልጅ ስብዕና ላይ የሚፈፀሙ above and undergone one third penalty of
ወንጀሎች ተብለው ከተዘረዘሩት ውጪ imprisonment,
በማንኛቸውም ጊዜ ይቅርታ ሊያደርግ ይችላል፡፡
3) without prejudice of sub article 1 of this article

ክፍል ሦስት prisoners can be granted pardon when:

አደረጃጀት እና አሰራር a) Unless proceeding of management was difficult,
a prisoner shall provide evidence of agreement
4. መቋቋም or trying to commit to agreement of
፩ በዞን፣ በሀዋሣ ከተማ አስተዳደር እና በልዩ ወረዳ ተጠሪነቱ reconciliation with victim of crime or where the
ለቦርዱ የሆነ የሕግ ታራሚዎች የይቅርታ ጥያቄ መልማይ victim of crime was died or not living in the
ኮሚቴ (ከዚህ በኋላ “ኮሚቴ” እየተባለ የሚጠራ) በዚህ area with the family of the victim.
ደንብ መሠረት ተቋቁሟል፡፡

፪ ማረሚያ ተቋም በሚገኝበት አካባቢ የሚገኝ ፍትህ መምሪያ
ወይም ጽሕፈት ቤት የይቅርታ ሥራውን በተደራቢነት
የሚሰራ አንድ ዐቃቤ ህግ እንዲመደብ ያደርጋል፡፡
5. የኮሚቴው አወቃቀር
ኮሚቴው የሚከተሉት አባላት ይኖሩታል፡-
፩ የዞን ፍትሕ መምሪያ፣ የልዩ ወረዳ ፍትህ ጽሕፈት ቤት ወይም
ሀዋሣ ከተማ ፍትህ
ኃላፊ……………………………... ሰብሳቢ
፪የማረሚያተቋምኃላፊ…….................... ም/ሰብሳቢ
፫ የዞን፣ልዩ ወረዳ ወይም ከተማ አስተዳደር ጽሕፈት ቤት ኃላፊ

፬ የዞን፣ልዩ ወረዳ ወይም ከተማ ጤና መምሪያ ወይም ጽሕፈት
ቤት ኃላፊ………………. አባል
፭ የዞን፣የልዩ ወረዳ ወይም ከተማ የፀጥታና አስተዳደር መምሪያ
ወይም ጽሕፈት ቤት ኃላፊ……………………አባል

b) unless otherwise a prisoner who was punished
with fine be provide an evidence from social
court about his inability, he has to pay a fine to
the government.
መምሪያ 4) Notwithstanding sub Article 1, 2, and 3 of this
Article, the chief executive of the region, upon
recommendation of the board, may grant pardon to
the crimes when it was believed necessary and
important to promote regional peace, development
and the rule of law subject to list of crimes against
humanity which provided under Article 28 of the
Constitution
PART THREE
STRUCTURE AND OPERATION
4) Establishment

The committee shall have the following members:

1) Zone Department of Justice, Office of Justice
በልዩ ወረዳ በሚገኝ ማረሚያ ተቋም ይሆናል፡፡ ኮሚቴው
special woreda , Hawasa City Department of

 እንዳስፈላጊነቱ እየተገናኘ ስራውን ሊያከናውን ይችላል፣ Justice.......................... Chair person
7. የኮሚቴው የስብሰባ ሥነ-ሥርዓት

2) Head, prisons administration....... deputy chairperson

፩ ከኮሚቴው አባላት ከግማሽ በላይ ከተገኙ ምልዓተ ጉባዔ
ይሆናል፡፡ 3) Head or representative of Head, zone, special woreda

፪ ኮሚቴው ውሳኔውን በአብላጫ ድምጽ ያሣልፋል፤ ድምጹ or city government office ..................member

በእኩል በተከፈለ ጊዜ የኮሚቴው ሰብሣቢ የተቀበለው

ሃሣብ የኮሚቴው የውሣኔ ሃሣብ ይሆናል፣ የአነስተኛ 4) Head, zone, a special woreda or city health
ድምጽ ሃሣብም በሪፖርት መልክ ይቀርባል፣ department or office .............................. member

የይቅርታ ተጠቃሚ የሚሆኑ የሕግ ታራሚዎችን በጥንቃቄ

ይመለምላል፤ ይቅርታ ማግኘት የሚገባቸውን ታራሚዎች

ዝርዝር አግባብነት ካለው መረጃ ጋር ለቦርዱ ያቀርባል፡፡
3. ይቅርታ የሚደረግላቸውን የሕግ ታራሚዎች የኋላ ታሪክ 6. the committee meeting

ማሻሻል ማሳየታቸውንና መታረማቸውን ያረጋግጣል፤ Administration, or special district of prisons
4. ለፍትሐዊ አሠራርና ውሣኔ አሰጣጥ ከሚመለከታቸው Administration office. Where necessary the committee
ባለድርሻ አካላትና ከሕብረተሰቡ ጋር የመረጃ ልውውጥ may be contacting to accomplish the work, 
ያደርጋል፤ 7. The Committee’s Meeting Procedure
5. ሁሉም የኮሚቴ አባላት በሕግ ታራሚዎች ዝርዝር መረጃ 1) There shall be a quorum when more than half of the

3. Ensure improvement of ethics and correction of

2. የኮሚቴውን ስብሰባ ቃለ ጉባዔ ይይዛል፣

ርዕሰ መስተዳድር
Any committee or prosecutor assigned to work on

pardon or any other person who gives evidences from

the court, police or prisons shall be held liable in

accordance with the relevant laws when inappropriately

led pardon granting implementation to produce unfair

advantage for himself or for someone else contrary to

this Regulation and directive issued for the

implementation of this Regulation.

13. Duty to Cooperate

Any person shall have the duty to cooperate; when
requested to do so, in providing evidence, information
or opinion required in the course of granting pardon in
accordance with this Regulation.
14. Inapplicable Laws

Any regulation, directive or customary practice

inconsistent with this Regulation shall be inapplicable
on matters covered by this Regulation.

15. Power to Issue Directive

The Board may issue directives necessary for the
implementation of this Regulation.

16. Effective Date
This Regulation shall come in to effect starting the approval
in the Executive Council from the date December 14/2015
