የሕገ-መንግስትና የፌደራሊዝም አስተምህሮ ማዕከልን A PROCLAMATION TO ESTABLISH CONSTITUTIONAL

ለማቋቋም የወጣ አዋጅ AND FEDERALISM INDOCTRINATION CENTER

የሕገ-መንግስትና ፌደራሊዝም አስተምህሮ ላይ የሚታዩ WHEREAS, it has been found important to put in place a

የሕዝብ ተወካዮች ምክር ቤት በኢትዮጵያ ፌደራላዊ NOW, THERE FORE, by the power given to the House

ዲሞክራሲያዊ ሪፐብሊክ ሕገ-መንግስት አንቀጽ ፶፭ (፩) of Peoples Representatives of Federal Democratic Republic
of Ethiopia as per Article 55 (1) of the Constitution ,it is here
በተሠጠው ሥልጣን መሠረት ይህን አዋጅ አውጥቷል:-

PART ONE
ጠቅላላ ድንጋጌዎች
GENERAL PROVISIONS
፩. አጭር ርዕስ 1. Short Title

ይህ አዋጅ “የሕገ-መንግስትና ፌደራሊዝም አስተምህሮ This Proclamation may be cited as the “Constitutional

፪. ትርጓሜ 2. Definition

የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ In this Proclamation unless the context otherwise
requires:-
በስተቀር በዚህ አዋጅ ውስጥ፡-
1/ “Center of Excellence” includes Educational
፩/ “የልህቀት ማእከላት” የሕገመንግሥትና
Institutions, Media and Art Center, Public and Civil
በፌደራሊዝም አስተምህሮ ሂደቱን በሚያሳልጡት
Service Institutions, Justice and Security Organs,
ላይ ከፍተኛ ሚና ያላቸው እንደ ትምህርት
and Professional and Mass Based Associations that
ተቋማት፣ የሚዲያና ስነጥበብ አካላት፣ የፐብሊክና
have significant role to facilitate the indoctrination
የሲቪል ሰርቪስ ተቋማት፣ የፍትህና የጸጥታ አካላት
process of the Constitution and Federalism;
እና የሙያና የብዙኃን ማህበራትን ያካትታል፤

፪/ “ባለድርሻ አካላት” ማለት በሕገ መንግስትና 2/ “Stakeholders” include Organs having role in

ፌደራሊዝም አስተምህሮ ረገድ ሚና ያላቸውን Indoctrination of Constitution and Federalism in

አካላት ያጠቃልላል፤ their duties;

፫/ “ምክር ቤት” ማለት የኢትዮጵያ ፌደራላዊ 3/ “House” mean House of Federation of Federal
ዲሞክራሲያዊ ሪፐብሊክ የፌደሬሽን ምክር ቤት Democratic Republic of Ethiopia.

ነው፡፡

፬/ ማንኛውም በወንድ ጾታ የተገለጸው ሴትንም 4/ Any expression in the Masculine gender includes the

ይጨምራል፡፡ Feminine.

PART TWO
ክፍል ሁለት
ESTABLISHMENT OF THE CENTER, OBJECTIVE,
የማዕከሉ መቋቋም፣ ዓላማ፣ ስልጣንና ተግባር
POWER AND FUNCTION
፫. መቋቋም
3. Establishment
፩/ የሕገ መንግስትና ፌደራሊዝም አስተምህሮ ማዕከል 1/ The Constitution and Federalism Indoctrination
(ከዚህ በኋላ “ማዕከል” እየተባለ የሚጠራው) የሕግ Center, (hereinafter called the “Center”) is hereby

ሰውነት ያለው ራሱን የቻለ የፌደራል መንግስት established as an independent Federal Government

መስሪያ ቤት ሆኖ በዚህ አዋጅ ተቋቁሟል። Organ having its own legal personality.

፪/ ማዕከሉ ለኢትዮጵያ ፌደራላዊ ዴሞክራሲያዊ 2/ The Center shall be accountable to the House of
ሪፐብሊክ ፌደሬሽን ምክር ቤት (ከዚህ በኋላ “ምክር Federation of the Federal Democratic Republic
ቤት” እየተባለ ለሚጠራው) ተጠሪ ይሆናል፡፡ Ethiopia (hereinafter called the “House”).

፫/ የማዕከሉ ዋና መስሪያ ቤት አዲስ አበባ ሆኖ 3/ The Center shall have its head office in Addis Ababa

እንደአስፈላጊነቱ በክልሎች እና በከተማ አስተዳደሮች and may open branch offices at Regions and City

፬. ዓላማ 4. Objective

የማዕከሉ ዓላማ ንቃተ ሕገ-መንግስቱ ያደገና The Objective of the Center shall be to create

ሁለንተናዊ ተሳትፎ የሚያደርግ ሕገመንግሥታዊ constitutional society that comprehensively engages in

ማህበረሰብ መገንባት ይሆናል፡፡ the dynamic of the country by ensuring comprehensive

awareness of the constitution.

፭. የማዕከሉ ሥልጣንና ተግባራት 5. Powers and Functions of the Center

ማዕከሉ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፡- The Center shall have the following powers and
functions:-

፩/ የሕገመንግስትና ፌደራሊዝም አስተምህሮ 1/ Introduce system that would assist the

ተግባራዊነትን የሚያግዙ የአሠራር ሥርዓቶችን implementation of the Constitution and Federalism

ይዘረጋል፤ Indoctrination;

፪/ የሕገመንግስትና ፌደራሊዝም አስተምህሮ ስራዎችን 2/ Provide training to trainers of the organs and

ለሚያከናውኑ አካላት የአሰልጣኞች ስልጠና entities that are mandated to provided training on
Constitution and Federalism and follow-up their
ይሰጣል፣ አፈፃፀማቸውን ይከታተላል፤
implementation;

፫/ ከባለድርሻ አካላት ጋር በመቀናጀት ለተለያዩ 3/ Coordinate with the stake holders and provide

የህብረተሰብ ክፍሎች ንቃተ ሕገመንግሥትና different trainings on Federalism and Constitution

ፌደራሊዝምን የሚያጎለብቱ ስልጠናዎችን ይሰጣል፤ that would enhance the awareness of various parts
of the society and arrange consultation forum;
የምክክር መድረኮችን ያዘጋጃል፤
4/ Design programs and project that ensures the
፬/ የሕገመንግስትና ፌደራሊዝም አስተምህሮ ውጤታማ
effectiveness of the Indoctrination on the
ለማድረግ የሚያስችል መርሐ ግብርና ፕሮጀክቶች
Constitution and Federalism, and prepare training
ይቀርፃል፣ የስልጠና ሞጁል ያዘጋጃል፤
modules;

፭/ ንቃተ ሕገመንግሥትና ፌደራሊዝምን የሚያሳድጉ 5/ Publish and disseminate various publications that
would enhance awareness on Constitution and
የተለያዩ የህትመት ውጤቶችን በማዘጋጀት
Federalism;
ያሰራጫል፤

፮/ በሕገመንግሥትና ፌደራሊዝም አስተምህሮ ዙሪያ 6/ Conduct research and studies on the area of
Constitution and Federalism Indoctrination and
የጥናትና ምርምር ስራዎችን ያካሂዳል፣ የተሻሉ
formulate and promote best practices;
ተሞክሮዎችን በመቀመር እንዲስፋፉ ያደርጋል፤

፯/ አገራዊ የሕገመንግሥትና አስተምህሮ የጋራ 7/ Organize national forum on the Indoctrination of

መድረክ በማዘጋጀት አፈጻጸምን ይገመግማል፣ Constitution and Federalism and conduct

የልምድ ልውውጥ ያካሂዳል፣ የወደፊት አቅጣጫ assessment of their performance, experience

ያመላክታል፤ sharing, and indicate future directions;

፰/ አዳዲስና ዘመናዊ የሕገመንግስትና ፌደራሊዝም 8/ Devise new and updated indoctrination methods
አስተምህሮ ዘዴዎችን ይቀይሳል፤ on federalism and constitution;

፱/ የንብረት ባለቤት ይሆናል፣ ውል ይዋዋላል፣ በስሙ 9/ Own property, enter into contract, and sue and be
sued on its own name;
ይከሳል፣ ይከሰሳል፤

፲/ የተቋቋመበትን ዓላማ ለማስፈጸም የሚያስፈልጉ 10/ Undertake other activities necessary for the
ሌሎች ተግባራትን ያከናውናል፡፡ attainment of its objectives

ክፍል ሦስት PART THRE

የማዕከሉ አደረጃጀት ORGANIZATION OF THE CENTER
፮. የማዕከሉ አቋም
6. Organization of the Center
ማዕከሉ፡-
The Center shall have:
፩/ አማካሪ ኮሚቴ (ከዚህ በኋላ “ኮሚቴ”) እየተባለ 1/ An Advisory Committee (here in after called the

፪/ የፌደሬሽን ምክር ቤት አባል ያልሆነና በመስኩ በቂ 2/ One Director General and Deputy Director
ሙያዊ ብቃት ያለው ሆኖ በምክር ቤቱ አፈ-ጉባኤ General recommended by the Speaker of the

አቅራቢነት በምክር ቤቱ የሚሾም አንድ ዋና House and appointed by the House who shall not

knowledge in the field;
፫/ አስፈላጊ ሠራተኞች ይኖሩታል፡፡
3/ The necessary staffs.

፯. የኮሚቴ አባላት 7. Members of the Committee

ኮሚቴው የሚከተሉት አባላት ይኖሩታል፡- The Committee shall have the following members:
1/ The Speaker of the House……….…….Chairperson;
፩/ የምክር ቤቱ አፈ ጉባኤ ………….………..ሰብሳቢ፤

፪/ የምክር ቤቱ ምክትል አፈ ጉባኤ…………..ምክትል 2/ The Deputy Speaker of the House ………………..

ሰብሳቢ፤ ………………………...……...….Vice Chairperson;

፫/ የምክር ቤቱ የቋሚ ኮሚቴ ሰብሳቢዎች……..አባላት፤ 3/ Chairpersons of the standing committees of the

፬/ የምክር ቤቱ የቋሚ ኮሚቴ ፀሐፊዎች……..አባላት፤ 4/ Secretaries of the standing committees of the

House…………………...……..………….members;

፭/ በዋና ዳይሬክተሩ አቅራቢነት በምክር ቤቱ አፈ 5/ Three professional of the field to be recommended

by the Director General and be assigned by the
ጉባኤ የሚሰየሙ ሦስት የዘርፉ ምሁራን

፰. የኮሚቴው ተግባርና ኃላፊነት 8. Function and Duty of the Committee

ኮሚቴው የሚከተሉት ተግባራትና ኃላፊነቶች The Committee shall have the following function and
ይኖሩታል፡- duties:

፩/ ማዕከሉን በፖሊሲ ጉዳዮች እና በሚያዘጋጃቸው 1/ Provide advice to the Center on policy matters and

መመሪያዎች ላይ ምክረ ሀሳብ ይሰጣል፤ Directives prepared;

፪/ በማዕከሉ ድርጅታዊ መዋቅር እና የደመወዝ ስኬል 2/ Provide advice on studies related to structure and
ጥናት ላይ ምክረ ሀሳብ ይሰጣል፤ salary scale of the Center ;

፫/ የማዕከሉን ዓመታዊ የሥራ ፕሮግራም እና በጀት 3/ Review and approve annual work programs and

ገምግሞ ያፀድቃል፡፡ budget of the Center;

፬/ ማዕከሉ በተፈቀደለት በጀት እና ዓመታዊ የሥራ 4/ Follow up and support the Center to comply with

ፕሮግራም መሰረት ተግባራትን ስለማከናወኑ annual work program and approved budget;

ድጋፍና ክትትል ያደርጋል፤

፭/ የማዕከሉን ጠቅላላ የስራ አፈፃፀም ሪፖርት 5/ Review and give direction on performance report of

ገምግሞ አቅጣጫ ያስቀምጣል፡፡ the Center.

፱. የኮሚቴው ስብሰባ 9. Meeting of the Committee

፩/ ኮሚቴው በዓመት ሁለት ጊዜ መደበኛ ስብሰባ 1/ The Committee shall hold bi-annual regular

ያካሂዳል፡፡ ሆኖም እንደአስፈላጊነቱ አስቸኳይ meetings. However it may conduct extra ordinary

ስብሰባዎችን ሊያካሂድ ይችላል፡፡ meetings as may be necessary.

፪/ ከግማሽ በላይ የሚሆኑ የኮሚቴ አባላት በስብሰባው

2/ There shall be quorum when half of the members of
ውስጥ ከተገኙ ምልዓተ ጉባኤ ይሆናል፡፡ the Committee are present at a meeting.
፫/ የኮሚቴው ምክረ ሀሳብ በድምጽ ብልጫ ያልፋል፤ 3/ The Committee shall pass its advice with majority
ድምጽ እኩል ለእኩል የተከፈለ እንደሆነ ሰብሳቢው vote; in case of ties the Chairperson shall have

፬/ የዚህ አንቀጽ ድንጋጌዎች እንደተጠበቁ ሆነው 4/ Without prejudice to the provision of this Article the

ደንብ ሊያወጣ ይችላል፡፡

፲. የዋና ዳይሬክተሩ ሥልጣንና ተግባራት 10. Power and Functions of the Director General

፩/ ዋና ዳይሬክተሩ የማዕከሉ ዋና ስራ አስፈፃሚ 1/ The Director General shall be the chief executive
officer of the Center and shall organize, manage

and administer operation of the Center.

፪/ የዚህ አንቀጽ ንዑስ አንቀጽ (፩) አጠቃላይ ድንጋጌ 2/ without prejudice to the generality of sub-article
እንደተጠበቀ ሆኖ ዋና ዳይሬክተሩ፡- (1) of this Article, the Director General shall:

ሀ) በዚህ አዋጅ በአንቀጽ ፭ የተመለከቱ የማዕከሉን a) Exercise the power and functions of the Center
stipulated under Article 5 of this Proclamation;
ሥልጣንና ተግባራት ሥራ ላይ ያውላል፤
b) Employ and administer Employees of the Center
ለ) የማዕከሉን ሠራተኞች የፌደራል ሲቪል ሰርቪስ
in accordance with basic principles of the
ሕግን አጠቃላይ መርሆችን መሰረት በማድረግ
Federal Civil Service Laws;
ይቀጥራል፣ ያስተዳድራል፤

c) Implement Directives of the Center up on

ሐ) የማዕከሉን የአስተዳደር መመሪያዎች ሲፀድቁ
approval;
ተግባራዊ ያደርጋል፤

መ) የማዕከሉን ዓመታዊ የሥራ ፕሮግራም እና d) Prepare and submit annual work program and
በጀት አዘጋጅቶ ለኮሚቴው ያቀርባል፤ budget of the Center to the Committee and

በመንግሥት ሲጸድቅም በስራ ላይ ያውላል፤ implement same up on approval by the

Government;

ሠ) ለማዕከሉ በተፈቀደለት በጀት እና ዓመታዊ e) Effect expenditure based on the annual work
የሥራ ፕሮግራም መሰረት የፋይናስ ሕግን program and approved budget of the Center in
ተከትሎ ገንዘብ ወጪ ያደርጋል፤ compliance with financial law;

ረ) የማዕከሉን ጠቅላላ የስራ አፈፃፀም ሪፖርት f) Prepare performance report of the Center and up
ያዘጋጃል፣ በኮሚቴው ተገምግሞ ከጸደቀ በኋላ on review and approval by the Committee,
ለምክር ቤቱ ያቀርባል፤ submit same to the House.

፫/ ዋና ዳይሬክተሩ ለማዕከሉ የሥራ ቅልጥፍና 3/ The Director General may delegate part of his
በሚያስፈልግ መጠን ሥልጣንና ተግባሩን በከፊል powers and function to the Deputy Director General
ለማዕከሉ ምክትል ዋና ዳይሬክተር እና ሌሎች or to the other officials and employees of the Center

የሥራ ኃላፊዎች ወይም ሠራተኞች በውክልና for efficient and effective performance of the

፲፩. የምክትል ዋና ዳሬክተር ሥልጣንና ተግባር 11. Power and Function of the Deputy Director
General

ምክትል ዋና ዳይሬክተሩ ተጠሪነቱ ለማዕከሉ ዋና The Deputy Director General shall be accountable

1/ Act on behalf of the Director General in his

፪/ ከዋና ዳይሬክተሩ ተለይተው የሚሰጡትን ሌሎች 2/ Perform other activities specifically referred to

፲፪. በጀት 12. Budget

የማዕከሉ በጀት ከሚከተሉት ምንጮች ይሆናል፡- The Budget of the Center shall be from the following
sources:
፩/ ከመንግስት የሚመደብ በጀት፤ 1/ The Budget allocated by the Government;

፪/ ከስጦታ እና ከእርዳታ፤ 2/ From gifts and donations ;

፫/ ከማንኛውም ሌላ ህጋዊ ምንጭ ይሆናል፡፡ 3/ from any other legal sources.

፲፫. የሒሳብ መዛግብት 13. Books of Accounts

፩/ ማዕከሉ የተሟላና እና ትክክለኛ የሆኑ የሂሳብ 1/ The Center shall keep accurate and complete
books of account.
መዛግብት ይይዛል፡፡

፪/ የማዕከሉ የሂሳብ መዛግብትና ገንዘብ ነክ ሰነዶች 2/ The books of accounts and financial documents of
በፌደራል ዋና ኦዲተር ወይም እርሱ the Center shall be audited annually by the

him.

PART FOUR
ልዩ ልዩ ድንጋጌዎች
MISCELLANEOUS PROVISIONS
፲፬. ባለድርሻ አካላት 14. Stakeholders

ባለድርሻ አካላት በሚያከናውኗቸው ስራዎች ውስጥ Stakeholders shall incorporate in their activities
የሕገመንግሥትና ፌደራሊዝም የአስተምህሮ Constitution and Federalism trainings enhance the
ተግባራትን የማካተት፣ ለአመራሮችና ሰራተኞች management and employees on Constitution and
የሕገመንግሥትና ፌደራሊዝም ግንዛቤያቸውን Federalism awareness, introduce systems to this

15. Plenum

1/ The Center shall organize joint plenum with Center

መመሪያ ሊያወጣ ይችላል፡፡ necessary for the implementation of this
Proclamation.

፲፯. አዋጁ የሚፀናበት ጊዜ 17. Effective Date

ይህ አዋጅ በፌደራል ነጋሪት ጋዜጣ ታትሞ This Proclamation shall enter into force on the date

ከወጣበት ቀን ጀምሮ የፀና ይሆናል፡፡ of its publication in the Federal Negarit Gazetee
