ተግባር ለመወሰን በወጣው አዋጅ ቁጥር ፩ሺ፻፺፯/፪ሺ፲፩ of Powers and Duties of the Executive Organs of
the Federal Democratic Republic of Ethiopia
አንቀጽ ፴፬ መሰረት ይህን ደንብ አውጥቷል፡፡

፩.አጭር ርዕስ
1. ShortTitle
ይህ ደንብ “የመከላከያ ሠራዊት ፋውንዴሽንን እንደገና
This Regulation may be cited as the “Army

፪.ትርጓሜ
2. Definitions
የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ In this Regulation, unless the context requires
በስተቀር በዚህ ደንብ ውስጥ፦ otherwise:
፩/“በክብር የተሰናበተ አባል” ማለት በዲሲፕሊን ወይም 1/ "Ex-members of the army” means
those who are discharged from the
በወንጀል ጥፋት ከተሰናበተ በስተቀር በማንኛውም
regular army service in any condition
ሁኔታ የተሰናበተ የሠራዊት አባል ነው፡፡ other than disciplinary or criminal
offence.
፪/“አገልግሎት” ማለት በፋውንዴሽኑ ስር በሚተዳደሩ
2/ "Service" means a service supplied by
ተቋማት አማካኝነት የሚሰጥ ልዩ ልዩ the organizations that is provided by
ማህበራዊ፤ኢኮኖሚያዊ፤ስፖርታዊ፤ መዝናኛ፣ እና the army Foundation like social,
የመሳሰለ አቅርቦት ወይም አገልግሎት ነው፡፡ economic, sports and recreations.

፫/”ምርት” ማለት በፋውንዴሽኑ ስር በሚተዳደሩ 3/ "Product” means any material that is

፬/”ቤተሰብ” ማለት የፋውንዴሽኑ አባል ባል ወይም 4/ "Family" means the husband, wife
ሚስት እና ከአስራ ስምንት ዓመት በታች የሆኑ and children under eighteen Years of
the members of Army Foundation.
ልጆች ናቸው፡፡
፭/’’ሚኒስቴር ወይም ሚኒስትር’’ ማለት የመከላከያ 5/ Ministry or Minister means Ministry
ሚኒስቴር ወይም ሚኒስትር ነው፡፡ or Minister of National Defense.
6/ Any expression in the Masculine
፮/በዚህ ደንብ ውስጥ በወንድ ጾታ የተደነገገው
gender includes the Feminine.
የሴትንም ጾታ ያካትታል፡፡
፫.መቋቋም
3. Establishment
፩/የመከላከያ ሠራዊት ፋውንዴሽን (ከዚህ በኋላ 1/ Army Foundation (hereinafter the
"Foundation") is hereby re - established
“ፋውንዴሽን” እየተባለ የሚጠራ) የህግ ሰውነት
as an Autonomous Institution having its

፬.ዋና መስሪያ ቤት
4. Head Office
የፋውንዴሽኑ ዋና መስሪያ ቤት በአዲስ አበባ ሆኖ The Foundation shall have its Head office in

፭. ዓላማዎች 5. Objectives of the Foundation

ፋውንዴሽኑ የሚከተሉት ዓላማዎች ይኖሩታል፦ The Foundation shall have the following
objectives:
፩/የሠራዊት አባላትን ኑሮ ለማሻሻል፣ የሚረዱ 1/ Provide service and facilities required to
meet the needs of members of the army
ተግባራት ማከናወን፤
and to improve their quality of life;
፪/ የሚኒስቴሩን ገፅታና ሳቢነት ማጎልበት፣ 2/ Improve the image and Attractiveness of
the Ministry;
፫/የሠራዊቱን ሞራል ለመጠበቅና፣ ለማጎልበት 3/ Carry out activities intended to maintain
የሚያግዙ ልዩ ልዩ ተግባራት ማከናወን፤ and enhance high standard of morale for
the army by providing service and
፬/የሠራዊቱን የግዳጅ አፈፃፀም ብቃት በማረጋገጥና
facilities;
በመጠበቅ ረገድ የላቀ አስተዋጽኦ ማበርከት፤ 4/ Contribute to ensure and maintain the
army to carry out task or mission;
፭/የፋውንዴሽኑን አባላት ግንኙነትና የትብብር
5/ Strengthen the Unity and interaction
አድማስ ማስፋት፣ members of the Foundation.
፮.አባልነት 6. Membership
፩/ የፋውንዴሽኑ አባል መሆን የሚችሉት የሚከተሉት 1/ Membership of the Foundation shall be
ናቸው፡- open to:
a) Regular army members;
ሀ) በስራ ላይ ያለ የመከላከያ ሠራዊት አባል፤
b) Ex- members of the army who are
ለ) ከመከላከያ ሠራዊት በክብር የተሰናበተ አባል፣ honorably discharged;
ሐ) ቋሚ የፋውንዴሽኑ ሲቪል ሰራተኛ፣ c) Permanent Civil Servants of the
Foundation;
መ) የመከላከያ ሠራዊት እና የሚኒስቴሩ የቋሚ
d) Families of members of the defense
ሲቪል ሰራተኛ ቤተሰብ፣ force and permanent Civil Servants;
ሠ)ፋውንዴሽኑ አባል እንዲሆኑ የሚፈቅድላቸው e) Other category of persons as
ሌሎች የህብረተሰብ ክፍሎች፡፡
prescribed by the Foundation;
f) Rights and Obligations shall be

፯∙ተግባራትና የህግ ችሎታ 7. Functions and Legal Capacity

ፋውንዴሽኑ የሚከተሉት ተግባራትና ችሎታ The Foundation shall have the Functions and
Legal capacity to:
ይኖሩታል፡-
፩/ ለፋውንዴሽኑ አባላት የተመረጡ ምርቶችና 1/ Supply or make to be supplied selective
products and services to the army
አገልግሎቶችን ማቅረብ፣ ወይም እንዲቀርቡ
members;
ማድረግ፤

፪/ የሠራዊት አባላት እና ቋሚ ሲቪል ሰራተኞች 2/ Undertake activities that make the Army
የመኖሪያ ቤት ባለቤት ለማድረግ የሚያስችሉ members and Permanent Civil Servants
owners of residence house;
ተግባራት ማከናወን፣

፫/ የብድርና ቁጠባ ማህበር በማቋቋም በአነስተኛ 3/ Provide saving and loan service on
concessionary interest rates by
ወለድ የብድር አገልግሎት መስጠት፣
establishing saving and loan association;
፬/ ለፋውንዴሽኑ አባላት ማህበራዊ አገልግሎቶችን፣ 4/ Provide social services, sport and other
የስፖርት ማዘውተሪያ፣ የመዝናኛ እና recreational services to the army members
የመሳሰሉትን አገልግሎቶች መስጠት፣ of the Foundation;

፭/ የኢትዮጵያን የፋይናንስ ህጎችና ጥናትን መሰረት 5/ Based on assessment and in accordance

በማድረግ ዓላማውን ለማሳካት በሚያስችሉ with Ethiopian financial laws, engage in
different investment opportunities
የባንክ ስራን ጨምሮ በተለያዩ የኢንቨስትመንት
necessary for the attainment of its
መስኮች መሳተፍ፣ objectives, including banking sector;
፮/ ከሠራዊቱ በክብር የተሰናበቱ አባላትን መልሶ
6/ Engage in supportive activities for the re-
ለማቋቋም የሚደግፉ ሥራዎች ማከናወን፤ establishment of ex-members of the army;

፯/ የፋውንዴሽኑን የፋይናንስ አቅም የሚያጎለብቱ 7/ Engage in different fund raising activities

ልዩ ልዩ የገንዘብ ማሰባሰቢያ ስራዎችን that can Strengthen the financial capacity
of the Foundation;
ማከናወን፣
፰/ በሰላም አስከባሪነት ለማገልገል ወደ ሌሎች 8/ Facilitate the opening of Foreign Currency
saving account at domestic Commercial
አገራት ለሚሄዱ የሠራዊቱ አባላት በአገር ውስጥ
Banks for army members engaged in
የውጪ ምንዛሪ የባንክ ሂሳብ እንዲኖራቸው peace keeping service abroad;

፱/ የንብረት ባለቤት መሆን፣ ውል መዋዋል፣ በስሙ 9/ Own property, enter in to contracts, sue
መክሰስና መከሰስ፣ and be sued in its own name;

፲/ ዓላማውን ለማሳካት የሚረዱ ሌሎችን ተዛማጅ 10/ Engage in any related activities necessary
for the attainment of its objectives.
ስራዎችን ማከናወን፡፡
፰∙አደረጃጀት 8. Organization
ፋውንዴሽኑ፡- The Foundation shall have:
፩/ ቦርድ፣ 1. A Board,
፪/ ዋና የስራ አስፈፃሚ እና ምክትል ዋና ስራ 2/ An Executive Director; Deputy Chief
አስፈፃሚዎች እና ፣ Executive Officers; and
፫/ አስፈላጊው ሰራተኞች ይኖሩታል፡፡ 3/ The Necessary staff.

፱.የቦርዱ አባላት
9. Members of the Board
፩/ የፋውንዴሽኑ ቦርድ አባላት ከመከላከያና አግባብ
1/ Members of the Board including the
ካላቸው አካላት ተውጣጥተው በሚኒስቴሩ
Chairperson shall be appointed by the
ይሰየማሉ፡፡ ቁጥራቸውም ከአምስት (፭) እስከ Ministry to be drawn from the defense and

The Board members shall serve for two

፲፩.የቦርዱ ሥልጣንና ተግባር
11. Powers and Duties of the Board
የፋውንዴሽኑ ቦርድ የሚከተሉት ሥልጣንና ተግባራት The Board shall have the following Powers
ይኖሩታል፡- and Duties:

፩/ የዚህን ደንብ አፈፃፀም በሚገባ ይከታተላል፤ 1/ Follow up and ensure the proper

፪/ የፋውንዴሽኑን የስራ እንቅስቃሴና እድገት

2/ Give the overall directions to the

፫/ የፋውንዴሽኑን ዓመታዊ በጀትና የስራ እቅድ Foundation;

ያፀድቃል አፈፃፀሙን ይከታተላል፣ 3/ Approve annual budgets and programs

of the Foundation;

፬/ የፋውንዴሽኑ የአሰራር መመርያ ያወጣል 4/ Issue Directives for army Foundation and
፣ያፀድቃል፡፡ approve it;
5/ Approve annual financial reports of the
፭/ የፋውንዴሽኑን ዓመታዊ የሂሳብ ሪፖርት እና Foundation and voidable properties and
የሚወገዱ ንብረቶችን ያፀድቃል ፣የውጪ ኦዲተር appoint external auditors;
ይሾማል፣
6/ Approve any loan ;
፮/ ፋውንዴሽኑ የሚያደርጋቸውን ማንኛውንም አይነት
ብድሮች ያፀድቃል፣ 7/ Approve the investment possibilities by
፯/ፋውንዴሽኑ የሚያቀርበውን የኢንቨስትመንት considering the objectives of the army
Foundation;
ፍላጎት ከዓላማው አንፃር መርምሮ ያፀድቃል፣
12. Meeting of the Board
፲፪.የቦርዱ ስብሰባዎች 1/ The Board shall hold its regular meetings
፩/ የቦርዱ መደበኛ ስብሰባ በየሶስት ወሩ አንድ once every three months; provided,
ጊዜ ይደረጋል ፣ሆኖም በሰብሳቢው ሲጠራ however, that extraordinary meeting of the
board may be held at any time when called
በማናቸውም ጊዜ አስቸኳይ ስብሰባ ሊደረግ
by the Chair Person.
ይችላል፡፡
፪/ በቦርዱ ስብሰባ ላይ ከቦርዱ አባላት ከግማሽ 2/ The presence of the majority of the
members at a meeting of the Board shall
በላይ ከተገኙ ምልዓተ-ጉባዔ ይሆናል፡፡
constitute a quorum.
፫/ የቦርዱ ውሳኔ የሚተላለፈው በስብሰባው ከተገኙ
አባላት አብላጫ ድምፅ ሲደገፍ ይሆናል፡፡ 3/ Any decision of the Board shall be passed
by a majority of votes of members present at
ሆኖም ድምፅ እኩል በእኩል የተከፈለ እንደሆነ
a meeting; in case of a tie, the Chairperson
ሰብሳቢው ወሳኝ ድምፅ ይኖረዋል፡፡ shall have a casting vote.
፲፫.የፋዉንዴሽኑ የሥራ አስፈጻሚ ስልጣንና ተግባር 13. Powers and Duties of the Executive
Director
፩/ከቦርዱ በሚሰጠው አጠቃላይ አቅጣጫ 1/ The Executive Director shall plan, direct

Foundation based on the general direction

ለ) አግባብ ባለው ሕግና ቦርዱ በሚያፀድቀው b) Employ, terminate and administer the

the approved budget and work program

ሠ) ከሶስተኛ ወገኖች ጋር በሚደረጉ e) Represent the Foundation in all its
dealing with third parties;
ግንኙነቶች ሁሉ ፋውንዴሽኑን ይወክላል፣
ረ) የፋውንዴሽኑ ገቢ በወቅቱ መሰብሰቡንና f) Follow up the timely collection of
accrued revenues of the Foundation and
በፋውንዴሽኑ የባንክ ሂሳብ ገቢ መደረጉን
deposit same in the Foundation's bank
ያረጋግጣል፣ account;
ሰ) ስለፋውንዴሽኑ ዓላማና ስለሚሰጣቸው g) Ensure the undertaking of public relation
activities to popularize the objectives
አገልግሎቶች ለማስተዋወቅ የሕዝብ
and services of the Foundation;
ግንኙነት ስራዎች መከናወናቸውን
ያረጋግጣል፣
h) Ensure that the meeting of the board are

፪/ለፋውንዴሽኑ ስራ ቅልጥፍና በሚያስፈልግ መጠን 2/ The Executive Director may delegate part of
ስልጣንና ተግባሩን በከፊል አግባብነት ላላቸው his Powers and Duties to other Officers and
Staff of the Agency to the extent necessary
የፋውንዴሽኑ ኃላፊዎች እና ሰራተኞች በውክልና

፲፬∙የፋውንዴሽኑ የገቢ ምንጭ 14. Sources of Income of the Foundation
1. The foundation shall have the following
፩/ ፋውንዴሽኑ የሚከተሉት የገቢ ምንጮች
source of income:
ይኖሩታል፡-
a) Membership Fees;
ሀ) ከአባላት የሚሰበሰብ መዋጮ፣
b) Income generated from the supply of
ለ) ፋውንዴሽኑ ከሚያቀርባቸው ምርቶችና products and services of the
አገልግሎቶች የሚገኝ ገቢ፣ Foundation;
ሐ) ከፋውንዴሽኑ ኢንቨስትመንቶች የሚገኘው
c) Income generated from investments of
ገቢ፣ the foundation;
መ) አግባብነት ባለው ሕግ መሰረት ሚኒስቴሩ d) Subsidy funds allocated by the

income in accordance with relevant

ሠ) ከተለያዩ ምንጮች የሚገኝ ማናቸውም ስጦታ e) Donations and assistance secured from

ረ) ከመንግስት የሚገኝ ድጋፍ፤
f) Support from Government;
ሰ) ፋውንዴሽኑ ከሚያከናውናቸው የገቢ g) Income generated from Telethons
ማሰባሰቢያ ፕሮግራሞች የሚገኝ ገቢ፤ undertaken by the Foundation;
ሸ) ከፋዉንዴሽኑ ቁጠባና ብድር የሚገኝ ገቢ፣ h) Income from saving and loan of the
Foundation;
፪/ በዚህ አንቀፅ ንዑስ አንቀፅ (፩) ከተመለከቱት 2. The funds collected from the sources
ምንጮች የሚሰበሰበው ገቢ በፋውንዴሽኑ ስም specified under sub-article (1) of this article
በተከፈተ የባንክ ሂሳብ ተቀማጭ ተደርጎ shall be deposited in a bank account
opened in the name of the Foundation and
ለፋውንዴሽኑ ዓላማ ማስፈፀሚያ ይውላል፡፡
shall be utilized to finance the operations of
the Foundation.
፲፭. የሚኒስቴሩ ሥልጣንና ተግባር 15. Power and Duties of the Ministry:
ፋዉንዴሽኑን በሚመለከት ሚኒስቴሩ የሚከተሉት The Ministry shall have the following Powers
ስልጣንና ተግባር ይኖረዋል፡፡
and Duties in relation to the Foundation:

1/ Follow up, ensure and supervise the

፪/ ሰብሳቢዉን ጨምሮ የፋውንዴሽኑ ቦርድ 2/ Appoint the Foundation's Board members

አባላትን ይሰይማል፣ including the Chair Person;

፫/ የፋውንዴሽኑን ዋና ስራ አስፈጻሚ ይሾማል፤ 3/ Appointing and dismiss the Foundation's

chief Executive Director;
ያሰናብታል፣
፬/ ለዋና ስራ አስፈጻሚ ዳይሬክተር ተጠሪ በሆኑ 4/ Approve the assignment of Officers to
የስራ መደቦች ላይ የሚመደቡትን የስራ posts directly accountable to the
Executive Director of the Foundation.
ኃላፊዎች ምደባ እና ስንብት ያጸድቃል፡፡
፲፮.የበጀት ዓመት 16. Fiscal Year
የፋውንዴሽኑ የበጀት ዓመት በየዓመቱ ሐምሌ ፩
The Fiscal Year of the Foundation shall begin
on the 1st Day of Hamle of each Year and end
ቀን ጀምሮ በሚቀጥለው ዓመት ሰኔ ፴ ቀን on the 30th Day of Sene of the following

፲፯.የሂሳብ መዛግብት
17. Books of Accounts
፩/ ፋውንዴሽኑ የተሟሉና ትክክለኛ የሆኑ የሂሳብ 1/ The Foundation shall keep accurate and

፲፰.የኃላፊነት መጠን 18. Extent of Liability
ፋውንዴሽኑ ካለው ጠቅላላ ንብረት በላይ በዕዳ
The Foundation shall not be liable beyond its
total assets.
ተጠያቂ አይሆንም፡፡
19. Duration of the Foundation
፲፱. ፋውንዴሽኑ የሚቆይበት ጊዜ The Foundation is established for an indefinite
ፋውንዴሽኑ ላልተወሰነ ጊዜ ይቆያል፡፡ duration.

፳.የተሻሩና ተፈፃሚነት የማይኖራቸው ሕጎች 20. Repealed and Inapplicable Laws

፩/የመከላከያ ፋዉንዴሽን ደንብ ቁጥር 1/ Defense Foundation Establishment
Regulation No. 179/2002 E.C is hereby
፩፻፸፱/፪ሺ፪ ዓ.ም በዚህ ደንብ ተሽሯል፡፡
repealed;

፪/ከዚህ ደንብ ጋር የሚቃረን ማንኛውም መመሪያ 2/ All Directives and Customary Practices
which are inconsistent with this Regulation
ወይም የአሰራር ልምድ በዚህ ደንብ በተሸፈኑ
shall not apply on matters under this
ጉዳዮች ላይ ተፈፃሚነት አይኖረውም፡፡ Regulation.

፳፩.ደንቡ የሚፀናበት ጊዜ 21. Effective Date

ይህ ደንብ በፌደራል ነጋሪት ጋዜጣ ታትሞ ከወጣበት This Ṛegulation shall enter in to force on the
ቀን ጀምሮ የፀና ይሆናል፡፡ date of publication in the Federal Negarit
Gazette.
