የኢት ዮጵያ ሀገራዊ ምክክር ኮ ሚሽን ማቋ ቋሚያ አዋጅ A PROCLAMATION TO ESTABLISH

THE ETHIOPIAN NATIONAL
DIALOGUE COMMISSION

በኢትዮጵያ በሚገኙ የተሇያዩ የፖሇቲካ እና WHEREAS, there are difference of

የሃሳብ መሪዎች እንዱሁም የኅብረተሰብ ክፌል ች opinions and disagreements among various

እጅግ መሠረታዊ በሆኑ ሀገራዊ ጉዲዮች ሊይ WHEREAS, enormously conducting
አካታች ሀገራዊ ምክክሮችን ማካሄዴ የተሻሇ ሀገራዊ inclusive National Dialogues is important to
መግባባትን ሇመገንባት ፤ በሂዯትም የመተማመንን እና bolster national consensus along the way a

ሀገራዊ ምክክሮች ተቀባይነት እና ተዓማኒነት WHEREAS, the legitimacy and credibility

አንደ ምክክሮቹን የሚያመቻቸውና የሚመራው አካሌ upon among others the capability and

በኢትዮጵያ ፋዯራሊዊ ዱሞክራስያዊ ሪፐብሉክ ሕገ NOW, THEREFORE, in accordance with
መንግስት አንቀጽ ፶፭ (፩) መሠረት የሚከተሇው Article 55(1) of the Constitution of the Federal

ክፌሌ አንዴ PART ONE
ጠቅሊሊ ዴንጋጌዎች GENERAL
፩ . አጭር ርዕስ 1. Short Title
ይህ አዋጅ “የኢትዮጵያ ሀገራዊ ምክክር ኮሚሽን This Proclamation may be cited as the
ማቋቋሚያ አዋጅ ቁጥር ፩ሺ፪፻፷፭/፪ሺ፲፬” ተብል “The Ethiopian National Dialogue
ሉጠቀስ ይችሊሌ። Commission Establishment Proclamation
No. 1265 /2021”
፪ . ት ርጓሜ 2. Definition
የቃለ አገባብ ላሊ ት ርጉም የሚያሰጠው ካሌሆነ In this Proclamation, unless the context
በስተቀር በዙህ አዋጅ ውስጥ፡- otherwise requires:
፩/ “የኮ ሚሽኑ ምክር ቤት” ማሇት ሁለንም የሀገራዊ 1/ “The Council of the Commission”
ምክክር ኮሚሽነሮችን በአባሌነት ያቀፇ means a Council constituted by all the

Dialogue Commission;
፪/ “ኮሚሽነር” ማሇት በዙህ አዋጅ አን ቀጽ ፲፪ 2/ “Comissioner” means the

፫/ “ሀገራዊ ምክክር” ማሇት በዙህ አዋጅና 3/ “National Dialogue” means

የኮሚሽነሮ ች ምክር ቤት በሚያወጣው consultation of different bodies
መመሪያ መሰረት በሚሇዩ አጀንዲዎች ሊይ facilitated by the Council of
በተሇያዩ አካሊት ውይይት እንዱዯረግባቸው Commissions at the Federal and
የኮሚሽኑ ምክር ቤት በፋዯራሌና በክሌል ች Regional level on the Agendas identify
የሚያመቻቻቸው ውይይቶች ናቸው፤ in accordance with this Proclamation
and the Directives to be issued by the
Council of Commissions;

፬/ “ክሌሌ” ማሇት በኢትዮጵያ ፋዯራሊዊ 4/ “Region” means any Region established

ዱሞክራሲያዊ ሪፐብሉክ ሕገ መንግስት as per Article 47 of the Constitution of
አንቀጽ ፵፯ መሠረት የተቋቋመ ክሌሌ ሲሆን ፤ the Federal Democratic Republic of
የአዱስ አበባንና የዴሬዲዋ ከተማ Ethiopia and includes Addis Ababa
አስተዲዯሮችን ይጨምራሌ፤ and Dire Dawa City Administrations;
፭/ “አወያይ” ማሇት በፋዯራሌና በክሌሌ የሚካሄደ 5/ “Panellist” means a person who
ሀገራዊ የምክክር መዴረኮችን እንዱመራ appointed by the Council of
በኮሚሽነሮ ች ምክር ቤት የሚመዯብ Commissions to lead National
ማንኛውም ሰው ነው፤ Dialogue forums held in Federal and
Regional level;
፮/ “ሰው” ማሇት የተፇጥሮ ሰው ወይም በህግ 6/ “Person” means any natural person or
የሰውነት መብት የተሰጠው አካሌ ነው፤ juridicial person;
፯/ ማንኛውም በወንዴ ፆታ የተዯነገገው የሴትንም 7/ Any expression in the masculine gender
ፆታ ይጨምራሌ። includes the feminine.
፫. የሀገራዊ ምክክሩ መርሆዎች 3. Principles of the National Dialogue
፩/ ሀገራዊ ምክክሩ እና አጠቃሊይ የኮሚሽኑ 1/ The National Dialogue and the general
ሥራዎች የሚመራባቸው መርሆዎች works of the Commission shall be
የሚከተለት ናቸው፡- directed by the following principles:
ሀ) አካታችነት፤ a) inclusivity;
ሇ) ግሌፅነት፤ b) transparency;
ሐ) ተዓማኒነት፤ c) credibility;
መ) መቻቻሌ እና መከባበር፤ d) tolerance and mutual respect;
ሠ) ምክንያታዊነት፤ e) rationality;

ረ) የምክረ ሃሳቦች ተግባራዊነት እና አውዴ f) implementation and context

ተኮርነት፤ sensitivity;

ሰ) ገሇሌተኛ አመቻችነት፤ g) impartial facilitator;

ሸ) የአጀንዲዎች ጥሌቀት እና አግባብነት፤ h) depth and relevance of Agendas;

ቀ) ዱሞክራሲ እና የሕግ የበሊይነት፤ i) democracy and rule of law;
በ) ብሔራዊ ጥቅም፤ j) national interest;
ተ) ሀገራዊ ባህሊዊ እውቀቶችን ና እሴቶችን k) using national traditional
መጠቀም። knowledge and values.
፪/ የኮሚሽኑ ምክር ቤት አስፇሊጊ ናቸው በማሇት 2/ The Council of the Commission may
የሚያምንባቸውን መርሆዎች በተጨማሪነት include additional principles it deems

ክፌሌ ሁ ሇት PART TWO

ስሇኮ ሚሽኑ መቋቋም፣ ዓሊማ፣ አዯረጃጀት ፣ ተግ ባር እና ESTABLIS HMENT OF THE COMMISSION,

OBJECTIVE, STRUCTURE, DUTIES AND
ኃሊፉነ ቶች
RESPONSIBILITIES

፬. መቋ ቋ ም
4. Establishment
፩/ የኢትዮጵያ ሀገራዊ ምክክር ኮሚሽን (ከዙህ 1/ The Ethiopian National Dialogue
በኋሊ “ኮሚሽን ” እየተባሇ የሚጠራ) ከፖሇቲካ Commission (hereinafter “the
Commission”), an impartial and
ወገንተኝነት፣ ከማንኛውም የመንግ ሥት ወይም
independent organ of the Federal
ላሊ አካሌ ተጽዕኖ ነፃ የሆነ ራሱን የቻሇ የሕግ Government with its own legal
ሰውነት ያሇው አካሌ ሆኖ በዙህ አዋጅ personality has been hereby
established by this Proclamation.
ተቋቁሟሌ።
፪/ የኮሚሽኑ ተጠሪነት ሇሕዜብ ተወካዮች ምክር 2/ The Commission shall be accountable to

፭. ዋና መሥሪያ ቤት 5. Head Quarter
የኮሚሽኑ ዋና መሥሪያ ቤት በአዱስ አበባ ሆኖ The head quarters of the Commission shall

፮ . የኮ ሚሽኑ ዓሊማ 6. Objectives of the Commission

ኮሚሽኑ የሚከተለት መሠረታዊ ዓሊማዎች The Commission shall have the following

/ በተሇያዩ የኅብረተሰብ ክፌል ች መካከሌ 1/ Facilitate consultation between the

/ የሚካሄደት ሀገራዊ ምክክሮ ች አካታች፣ ብቃት 2/ Implement an effective National

ባሇውና ገሇሌተኛ በሆነ አካሌ የሚመሩ፣ Dialogue process by ensuring that
የአሇመግ ባባት መንስዔዎችን በትክክሌ National Dialogues are inclusive, lead
በሚዲስስ አጀንዲ የሚያተኩሩ፣ ግሌፅ በሆነ by a competent and impartial body,
የአሠራር ሥርዓት የሚመሩ እና የምክክሮቹን with a clear focus on the cause of
ውጤቶች ሇማስፇፀም የሚያስችሌ ዕቅዴ disagreements, guided by transparent

ሀገራዊ የምክክር ሂዯት ተግባራዊ ማዴረግ፤ the results of the consultations;

/ የሚካሄደት ሀገራዊ ምክክሮች በተሇያዩ 3/ Establish a system of deliberations that

/ ከምክክሮቹ የተገኙ የመፌትሔ ምክረ ሃሳቦች 4/ Support the implementation of the

እና የማኅበራዊ መዯሊዴሌ ማመቻቸት፤ can be solved in a sustainable manner,
ensuring lasting peace;
/ ሇአገራዊ መግባባት እና ጠንካራ ቅቡሌነት 7/ Lay a firm foundation for national
ያሇው ሀገረ መንግሥት ሇመገንባት ጽኑ consensus and the building of a State

. የኮ ሚሽኑ አዯረጃጀት 7. Organization

ኮሚሽኑ፡- The Commission shall have:
/ የኮሚሽኑ ምክር ቤት፤ 1/ A Council of Commissioners;
/ ዋና ኮሚሽነር፤ 2/ A chief Commissioner;

/ ምክትሌ ዋና ኮሚሸነር፤ 3/ A deputy chief Commissioner;

/ ጽህፇት ቤት፤ 4/ A Secretariat;

/ እንዯአስፇሊጊነቱ ኮሚቴዎች፤ እና 5/ Committees as may be necessary and

/ አስፇሊጊ ሠራተኞች፤ 6/ Necessary staff.

ይኖሩታሌ።
፰. የኮ ሚሽኑ የሥራ ዗መን 8. Term of the Commission
፩/ የኮሚሽኑ የሥራ ዗መን ሦስት (፫) ዓመት ነው። 1/ The term of the Commission shall be
three (3) years.
፪/ አስፇሊጊ ሆኖ ሲገኝ የኮሚሽኑ የሥራ ዗መን 2/ If necessary, the term of the
በሕዜብ ተወካዮች ምክር ቤት ሉራ዗ም Commission may be extended by the

፫/ የኮሚሽኑ የሥራ ዗መን የሚቆጠረው በዙህ አዋጅ 3/ The term of the Commission shall

፱. የኮ ሚሽኑ ተግ ባርና ኃሊፉነቶች 9. Duties and Responsibilities of the
Commission

ኮሚሽኑ የሚከተለት ተግባር እና ኃሊፉነቶች The Commission shall have the following
ይኖሩታሌ፡- duties and responsibilities:

፩/ ምክክሮችን የሚያመቻቹና የሚያስፇፅሙ፣ 1/ It shall establish Committees and teams

የተሇያዩ ጥናቶችን የሚያካሂደ እና ምክረ of experts that will facilitate and
ሃሳቦችን የሚያመነጩ ኮሚቴዎችን እና implement dialogues, conduct studies
የባሇሙያ ቡዴኖችን ያቋቁማሌ፤ and generate recommendations;
፪/ ከዙህ በፉት በመንግሥታዊም ሆነ መንግሥታዊ 2/ It shall study national dialogue
ባሌሆኑ ተቋማት የተዯረጉ ሀገራዊ የምክክር processes that had been carried out by
ሂዯቶችን እና የተገኙ ውጤቶችን ያጠናሌ፣ governmental or non-governmental

፫/ በተሇያዩ የፖሇቲካ እና የሃሳብ መሪዎች 3/ It shall identify differences among

እንዱሁም የህብረተሰብ ክፌልች መካከሌ different political and opinion leaders

ያመቻቻሌ፣ ምክክሮ ችን እና ውይይቶችን

ያሳሌጣሌ፤
፭/ ከመሊ ሀገሪቱ የተሇያዩ የኅብረተሰብ ክፌል ችን 5/ It shall organize and convene dialogue
እና አካሊትን የሚወክለ ተሳታፉዎች forums at the Federal and Regional
የሚሳተፈባቸው፣ ሀገራዊ መግባባት ሇማምጣት levels that would bring about national
የሚያስችለ የተሇያዩ የምክክር ስብሰባዎችን consensus with the participation of
በፋዯራሌ እና በክሌልች ዯረጃ እንዱካሄደ representatives of various segments of
ያመቻቻሌ፤ society drawn from the entire country;

፮/ በሀገራዊ የምክክር ጉባዔ ሊይ የሚሳተፈ 6/ It shall identify and enable participants

፱/ የጽህፇት ቤቱን የውስጥ የአሠራር ሥርዓት፣ 9/ It shall enact and implement internal
የምክክር አጀንዲዎች ወይም አርዕስት Regulations and Directives pertaining
የሚመረጡበትን የሚመሇከት፣ በሀገራዊ to the secretariat internal working
ውይይቶች ሊይ የሚሳተፈ አካሊት የሚሇዩበትን procedures, the selection of topics or
ሥርዓት ሇመ዗ርጋት ና መሰሌ ተግባራትን Agenda for the dialogue and selection
ሇማከናወን የሚያስችለ ውስጠ ዯንቦችን እና of participants to take part in National

፲፩/ መንግሥት ከሀገራዊ ውይይቶች የሚገኙ ምክረ 11/ Provide support to the government in
ሃሳቦችን በተግ ባር ሊይ ሇማዋሌ እንዱችሌ the preparation of a clear and concrete
ግሌፅ እና ተጨባጭ የሆነ ዕቅዴ እንዱያ዗ጋጅ plan that would enable it to implement
አስፇሊጊውን እገዚ ያዯርጋሌ፤ the recommendations arising out of the
national dialogue;
፲፪/ የምክረ ሃሳቦቹን አፇፃፀም ሇመከታተሌ 12/ It shall devise a system to monitor the

፲፫/ ዓሊማውን ሇማስፇፀም የሚያስፇሌጉ ላል ች 13/ It shall carry out other activities

፲. የኮ ሚሽኑ ምክር ቤት ስብሰባ 10. Meeting of the Council of the

Commission

፩/ የኮሚሽኑ ምክር ቤት በውስጥ አሠራር ዯንቡ 1/ The regular meetings of the

መሠረት መዯበኛ ስብሰባ ያካሂዲሌ፤ ሆኖም Commission shall be held in

one (50+1) of the Commissioners are
present;
፫/ የኮሚሽኑ ውሳኔ በኮሚሽኑ ምክር ቤት አባሊት 3/ The decisions of the Commission shall
በስምምነት ይሆናሌ፤ ሆኖም ግን በስምምነት be held by agreement of the members
ሇመወሰን መግባባት ሊይ ካሌተዯረሰ ውሳኔው of the Council of the Commission;
በኮሚሽኑ ምክር ቤት ሊይ በተገኙ ኮሚሽነሮች However, if no agreement is reached
በአብሊጫ ዴምጽ ያሌፊሌ፤ the decisions shall be passed by a
majority vote of Commissioners
present;
፬/ በኮሚሽኑ ውሳኔ አሰጣጥ ሊይ ዴምፅ እኩሌ 4/ In the event of a tie, the chair of the
ሇእኩሌ ከተከፇሇ የሰብሳቢው ዴምፅ ወሳኝነት meeting shall have the casting vote;
ይኖረዋሌ፤
፭/ የዙህ አንቀጽ ዴንጋጌዎች እንዯተጠበቁ ሆነው 5/ without prejudice to the provisions of
የኮሚሽኑ ምክር ቤት የራሱን የስብሰባ ሥነ - this Article, the Commission may adopt
ሥርዓት መመሪያ ሉያወጣ ይችሊሌ። its own rules of procedure for its own

ክፌሌ ሶ ስት PART THREE

ስሇ ኮ ሚሽነ ሮ ች THE COMMISSIONERS
፲፩ . ስሇኮሚሽነሮች 11. The Commissioners

፩/ ኮሚሽኑ አሥራ አንዴ (፲፩ ) ኮሚሽነሮች 1/ The Commission shall have eleven (11)
ይኖሩታሌ፤ Commissioners;
፪/ የኮሚሽኑ ዋና ኮ ሚሽነ ር፤ ምክትሌ ዋና ኮ ሚሽነ ር 2/ The Chief Commissioner of the
እና ላልች ኮሚሽነሮች በሕዜብ ተወካዮ ች Commission, the Deputy Chief
ምክር ቤት ይሾማለ፤ Commissioner and other
Commissioners shall be appointed by
the House of Peoples ’ Representatives;
፫/ የሕዜብ ተወካዮ ች ምክር ቤት የሹመት 3/ The House of Peoples ’ Representatives
ውሳኔውን የሚሰጠው የቀረቡት ዕጩዎች በዙህ shall decide on the appointment of the
አዋጅ አንቀጽ ፲፫ ሥር የተቀመጡ nominees after ascertaining that they
መሥፇርቶችን ያሟለ መሆኑን በማረጋገጥ fulfil the criteria set out under Article
ይሆናሌ። 13 of this Proclamation.

፲፪ . የኮ ሚሽነሮች አሰያየም 12. Appointment of Commissioners

የኮሚሽነሮ ች አሰያየም በሚከተሇው አግባብ Commissioners shall be appointed in the

፩/ የሕዜብ ተወካዮች ምክር ቤት አፇ ጉባዔ 1/ The Secretariat of the Speaker of the

ማኅበራት ኮሚሽነር ሉሆኑ የሚችለ ግሇሰቦችን and civil society nominations of
ጥቆማ ይቀበሊሌ፤ individuals who could serve as
Commissioners;

፪/ በዙህ አዋጅ አንቀጽ ፲፫ ሥር በተቀመጡት 2/ In accordance with the requirements set

መሥፇርቶች መሠረት ከተጠቆሙት ሰዎች out in Article 13 of this Proclamation,
ውስጥ ቢያንስ አስራ አራት ኮሚሽነር ሉሆኑ the office of the Speaker of the House

፫/ የሚ዗ጋጀው የዕጩዎች ዜርዜር የፆታ እና 3/ The list of candidates shall be inclusive

ያዯረገ መሆን ይኖርበታሌ፤

፬/ አፇ ጉባዔው ከተፍካካሪ የፖሇቲካ ፓርቲዎች፣ 4/ The Speaker shall consult with the

፭/ አፇ ጉባዔው በዙህ አንቀጽ ንዑስ አንቀጽ (፬) 5/ After conducting the consultation
ሥር የተገሇፀውን ምክክር ካዯረገ በኋሊ provided for under Sub-Article (4) of
ከቀረቡት ዕጩዎች መካከሌ እንዯአስፇሊጊነቱ this Article, the Speaker shall submit to
ዋና ኮሚሽነ ር፣ ምክትሌ ዋና ኮሚሽነር እና the House of Peoples’ Representatives
ኮሚሽነር ሆነው ሉያገሇግለ የሚችለ nominations for appointments to the
ዕጩዎችን በሕዜብ ተወ ካዮች ምክር ቤት post of Chief Commissioner, Deputy

እንዱሾሙ ያቀርባሌ። Chief Commissioner and

Commissioners.

፲፫. ሇኮ ሚሽነርነት የሚያበቁ መሥፇርቶች 13. Criteria for the Appointment of

Commissioners

ማንኛውም ኮሚሽነ ር ሆኖ የሚሾም ሰው Anyone who shall be appointed as a

የሚከተለትን መሥፇርቶች ማሟሊት አሇበት፡- Commissioner shall fulfil the following
requirements:
፩/ ዛግነቱ ኢትዮጵያዊ የሆነ፤ 1/ Ethiopian National;

፪/ ሁለንም ሃይማኖቶች፣ የኢትዮጵያ ብሔሮችን፣ 2/ Committed to serve all religions,

ብሔረሰቦችን እና ሕዜቦችን በእኩሌ ዓይን Nations, Nationalities and Peoples of
የሚያገሇግሌ፤ Ethiopia equally;

፫/ የማንኛውም ፖሇቲካ ፓርቲ አባሌ ያሌሆነ፤ 3/ Not a member of any political party;
፬/ ሇሀገራዊ መግባባት ጉሌህ አስተዋፅዖ ሉያበረክት 4/ Capable to make a significant
የሚችሌ፤ contribution to national consensus;

፭/ መሌካም ሥነ-ምግባርና ስብዕና ያሇው፤ 5/ Have a good character and personality;

፮/ በሕዜብ ዗ንዴ ዓመኔታ ያሇው፣ 6/ Trust worthy by the public;
፯/ በከባዴ ወንጀሌ ተከሶ የጥፊተኝነት ውሳኔ 7/ Not convicted for charges of
ያሌተሊሇፇበት፤ committing any serious crime;
፰/ የኮሚሽኑን ሥራ በአግባቡ ሇመሥራት 8/ Shall have a competence to discharge
የሚያስችሌ የተሟሊ ብቃት ያሇው፤ the activities of the commission;

፱/ ሙለ ጊዛውን ሇኮሚሽኑ ሥራ ሇማዋሌ ፌቃዯኛ 9/ Willing to devote his full time for the

፲፬. የኮ ሚሽነሮች ዯመወዜና ጥቅማጥቅም 14. Renumeration and Benefits of
Commissioners

የኮሚሽነሮ ች ዯመወዜ እና ጥቅማጥቅም The renumeration and benefits of the

ሇመንግሥት ከፌተኛ ተሿሚዎች በተፇቀዯው Commissioners shall be provided in

ዯመወዜ እና ጥቅማጥቅም አግባብ ይፇፀማሌ። accordance with the benefits and salary
scheme of Senior Government Officials.
፲፭. የኮ ሚሽነሮች መብትና ግ ዳታ 15. Obligations and Rights of
Commissioners

፩/ ማንኛውም ኮሚሽነ ር የሚከተለት መብቶች 1/ Any Commissioner shall have the

Commission;

ሐ) ሇሥራ አስፇሊጊ የሆኑ ሰነድችን እና ላል ች c) get access to and consult documents

ሇ) ሙለ ጊዛውን ሇኮሚሽኑ ሥራ የማዋሌ፤ b) devote his full time to the work of

the Commission;
ሐ) የጥቅም ግጭትን የማስወገዴ፤ c) avoid conflict of interest;
መ) በሥራ ሂዯት ያገኘውን ምስጢር d) maintain the confidentiality of
የመጠበቅ፤ secrets acquired in the course of his
work;
ሠ) የኮሚሽኑን ገሇሌተኛነት፣ መሌካም ስም እና e) refrain from engaging in conduct
ክብር ከሚያጎዴፈ እና ውጤታማነትን that could undermine the

reputation, prestige and impede its

፲፮ . ኮ ሚሽነሮች ከኃሊፉነት ስሇሚነሱበት ሁ ኔታ 16. Removal of Commissioners
፩/ ማንኛውም ኮሚሽነ ር በሚከተለት ሁኔታዎች 1/ Any Commissioner could be removed
ከኃሊፉነት ሉነሳ ይችሊሌ፡- from his position on any of these
grounds:
ሀ) በህመም ምክንያት መዯበኛ ተግባሩን a) If he is incapable of discharging his
ማከናወን ባሇመቻሌ፤ responsibility due to serious illness;

ሇ) ግሌፅ የሆነ የብቃት ማነስ ከታየበት፤ b) If he is manifestly incompetent;

ሐ) ከባዴ የሥነ-ምግባር ጉዴሇት ከታየበት፤ c) If he engages in serious

misconduct;
መ) ያሇበቂ ምክንያት ሇተከታታይ አስር ቀናት d) If he fails to be present at his post
በሥራ ገበታው ሊይ ካሌተገኘ፤ ወይም of duty consecutively for ten days
without sufficient justification; or
ሠ) በዙህ አዋጅ አንቀጽ ፲፫ ሥር e) If it is found that he had not fulfilled
ከተመሇከቱት መሥፇርቶች ውስጥ one of the requirements provided
በሹመት ወቅት ኮሚሽነሩ ያሊሟሊው under Article 13 of this

፪/ በዙህ አንቀጽ ንዑስ አንቀጽ (፩) መሠረት 2/ A Commissioner shall be removed from

ሶስተኛ በማያንሱ የሕዜብ ተወ ካዮች ምክር of one of the grounds stipulated under
ቤት አባሊት አነሳሽነት ወይም ከሦስት Sub-Article (1) of this Article and if

፲፯. ኃሊፉነትን በገዚ ፌቃዴ ስሇመሌቀቅ 17. Resignation

ማንኛውም ኃሊፉነቱን በገዚ ፌቃደ መሌቀቅ Any Commissioner who desires to resign

የሚፇሌግ ኮሚሽነ ር የሁሇት ወር የጽሁፌ ቅዴመ from the Commissions could do so after

ማስጠንቀቂያ ሇኮሚሽነሮች ምክር ቤት እና providing a two-month prior written notice

to the Council of the Comission and the
ሇሕዜብ ተወካዮ ች ምክር ቤት አፇ ጉባዔ
Speaker of the House of Peoples’
በመስጠት ሉሇቅ ይችሊሌ።
Representatives.
፲፰. ስሇላሊ መንግስታዊ ኃሊፉነት 18. Other Government Post
በዙህ አዋጅ አንቀጽ ፲፮ መሠረት ከኃሊፉነት Any Commissioner who is removed from
የተነሳ ወይም በአንቀጽ ፲፯ መሠረት በገዚ his post pursuant to Article 16 or resign
ፌቃደ ከኃሊፉነት የሇቀቀ ኮሚሽነር ሇሁሇት voluntarily pursuant to Article 17 shall not

፲፱. ኮ ሚሽነር ስሇመተካት 19. Replacement of a Commissioner
፩/ በዙህ አዋጅ አንቀጽ ፲፮ እና ፲፯ መሠረት 1/ A Commissioner shall be appointed by

ወይም በሞት ምክንያት ሲሇይ በዙህ አዋጅ among the list of candidates who are

፪/ የዙህ አንቀጽ ንዑስ አንቀጽ (፩ ) ዴን ጋጌ 2/ Without prejudice to Sub-Article (1) of

ጊዛ ከተሸሙ ኮሚሽነሮች ወይም ከተጠባባቂ the appointed Commissioners or from

ስሇኮ ሚሽኑ ምክር ቤት ፤ ዋና ኮ ሚሽነ ር እና ጽህፇ ት COUNCIL OF THE COMMISSION,

SECRETARIAT
፳. የኮ ሚሽኑ ምክር ቤት 20. Council of the Commission
የኮሚሽኑ ምክር ቤት ሁለንም ኮሚሽነሮች The Council of the Commission shall
በአባሌነት ያቀፇ ነው። constitute all Commissioners.
፳፩ . የኮ ሚሽኑ ምክር ቤት ተግ ባር እና ሥሌጣን 21. Powers and Responsibilities of the
Council of the Commission
የኮሚሽኑ ምክር ቤት የሚከተለት ሥሌጣን እና The Council of the Commission shall
ተግባራት ይኖሩታሌ፡- have the following powers and
responsibilities:
፩/ የሕዜብ ምክክር የሚዯረግ ባቸውን አጀንዲዎች 1/ Examine potential topics for public

፳፪ . የዋና ኮ ሚሽነ ር ተግ ባር እና ሥሌጣን 22. Responsibilities and Powers of the Chief
Commissioner
የኮሚሽኑ ዋና ኮሚሽነር የሚከተለት ተግ ባር እና The Chief Commissioner shall have the
ሥሌጣን ይኖሩታሌ፡- following responsibilities and powers:
፩/ የኮሚሽኑን ምክር ቤት በሰብሳቢነት ይመራሌ፤ 1/ He shall serve as the chairperson of the
Council of the Commission;
፪/ አጠቃሊይ የኮሚሽኑን ሥራ የመምራት፤ 2/ Lead the overall activities of the
Commission;
፫/ የኮሚሽኑን ምክር ቤት ስብሰባ አጀንዲዎችን 3/ Table the Agenda of the Council of the
የማቅረብ፤ Commission;

፬/ እንዯአስፇሊጊነቱ አስቸኳይ ስብሰባ የመጥራት፤ 4/ Call extraordinary meetings of the

Council of the Commission as
necessary;
፭/ የጽህፇት ቤቱን አጠቃሊይ ሥራ የመቆጣጠር፤ 5/ Oversee the overall activity of the
secretariat;

ቤት አቅርቦ የማሾም፤ Commission a nominee to be
appointed as Head of the Secretariat;
፱/ የኮሚሽኑን ሠራተኞች በፋዯራሌ መንግስት 9/ Hire and administer the staff of the
ሠራተኞች ሕግ መሠረት የመቅጠር እና Commission in accordance with
የማስተዲዯር፤ Federal Civil Servants Law;
፲/ የኮሚሽኑን በጀት ጥያቄ ከገንዜብ ሚኒስቴር ጋር 10/ Prepare the budget of the Commission
በማ዗ጋጀት ሇሕዜብ ተወካዮ ች ምክር ቤት jointly with the Ministry of Finance
ማቅረብ፤ and present the same to the House of
Peoples’ Representatives for
approval;
፲፩/ ላልች በኮሚሽኑ ምክር ቤት የሚሰጡትን 11/ Carry out other tasks assigned to him
ተግባራት የማከናወን። by the Council of the Commission.

፳፫. የምክትሌ ዋና ኮ ሚሽነር ተግ ባር እና ሥሌጣን 23. Responsibilities and Powers of the

Deputy Chief Commissioner
የኮሚሽኑ ምክትሌ ዋና ኮሚሽነ ር የሚከተለት The Deputy Chief Commissioner shall
ተግባር እና ሥሌጣን ይኖሩታሌ፡- have the following responsibilities and
powers:
፩/ ዋናው ኮሚሽነር በማይኖርበት ጊዛ ተክቶ 1/ Carry out the duties of the Chief
ይሰራሌ፤ Commissioner in his absence;
፪/ በዋናው ኮሚሽነር የሚሰጡትን ተግባራት 2/ Perform tasks assigned to him by the

፳፭. የኮሚሽኑ ጽህፇት ቤት ተግ ባር እና ኃሊፉነት 25. The Responsibilities and Duties of the
Secretariat of the Commission
የኮሚሽኑ ጽህፇት ቤት የሚከተለት ተግባር እና The Secretariat of the Commission shall
ሥሌጣን ይኖሩታሌ፡- have the following responsibilities and
powers:
፩/ የኮሚሽኑን ጽህፇት ቤት መዋቅራዊ አዯረጃጀት 1/ Identify the organizational structure of
ሇይቶ ሇኮሚሽኑ ምክር ቤት አቅርቦ the office of the Commission for the
የማፀዯቅ፤ approval to the Council of the
Commission;
፪/ ሇኮሚሽኑ አጠቃሊይ የአስተዲዯርና ፊይናን ስ 2/ Provide overall administrative and
አገሌግልት የመስጠት፤ financial services to the Commission
፫/ ሇኮሚሽኑ ተግባር እና ኃሊፉነት አስፇሊጊ 3/ Provide the inputs and other services
የሆኑትን ግ ብዓቶችን እና ላል ች necessary for the performance of the

አገሌግልቶችን የማቅረብ፤ activities and responsibilities of the

Commission;
፬/ የኮሚሽኑን ቃሇ ጉባዔዎች፤ ውሳኔዎች፤ የሂሳብ 4/ Keep the minutes, records of the
መዚግብት እና ላልች መረጃ ዎችን በሚገባ decisions, financial documents and

አዯራጅቶ የመያዜ፤ other information in an organized

manner;
፭/ የኮሚሽኑን በጀት በማ዗ጋጀት ዋና ኮሚሽነሩን 5/ Assist the Chief Commissioner in the

Commission; and
፮/ ላልች በምክር ቤቱ ወይም በዋና ኮሚሽነሩ 6/ Perform other responsibilities to be

፳፮ . የጽህፇት ቤቱ ኃሊፉ ተግ ባር እና ኃሊፉነት 26. Responsibilities and Duties of the Head
of the Secretariat of the Council
፩/ የጽህፇት ቤቱ ኃሊፉ የሚከተለት ተግባር እና 1/ The Head of the Secretariat shall have

responsibilities:

ሇ) የጽህፇት ቤቱን ተግባራት አስመሌክቶ b) provide a report regarding the

of the Commission;
ሐ) የጽህፇት ቤቱን የሥራ ዕቅዴ ሇኮሚሽኑ c) present the work plan of the
ምክር ቤት አቅርቦ የማፀዯቅ፤ እና Secretariat to the Council of the
Commission for approval; and
መ) በዙህ አዋጅ ሇጽህፇት ቤቱ የተሰጡትን d) lead and administer the Secretariat in
ተግባራት እና ሥሌጣን በመምራት the performance of the duties and

Proclamation.
፪/ የጽህፇት ቤቱ ኃሊፉ ተጠሪነት ሇኮሚሽኑ ዋና 2/ The Head of the Secretariat shall be

ክፌሌ አምስት PART FIVE
ሌዩ ሌዩ ዴንጋጌዎች MISCELLANEOUS
PROVISIONS
፳፯. የበጀት ምንጭ 27. Source of the Budget
፩/ የኮሚሽኑ በጀት በመንግ ሥት የሚመዯብ 1/ The budget of the Commission shall be
ይሆናሌ። allocated by Government.
፪/ በዙህ አንቀጽ ንዑስ አንቀጽ (፩) ሥር 2/ Without prejudice to Sub-Article (1) of
የተዯነገገው እንዯተጠበቀ ሆኖ ከላል ች ሕጋዊ this Article, the Commission may
ምንጮች ማግኘት ይችሊሌ። collect fund from other legal sources.
፫/ የመንግሥት የፊይናንስ አስተዲዯር መርሆዎችን 3/ The Commission has the full power to

፩/ ኮሚሽኑ የተሟለና ትክክሇኛ የሆኑ የሂሳብ 1/ The Commission shall keep complete

፪/ የኮሚሽኑ የሂሳብ መዚግብትና ገን዗ብ ነክ ሰነድች 2/ The books of accounts and financial
documents of the Commission shall

be audited annually by the Auditor
ኦዱተሮች በየዓመቱ ይመረመራለ። General or by Auditors designated by

፳፱. ዯንብና መመሪያ የማውጣት ሥሌጣን 29. Power to Issue Regulation and Directive
፩/ የሕዜብ ተወካዮች ምክር ቤት የኮሚሽነሮችን፣ 1/ The House of Peoples' Representatives
የኮሚሽኑን ሠራተኞች፣ አወያዮ ችና በውይይት may issue Regulation regarding the
ሂዯቱ የሚሳተፈ አካሊትን የሥነ-ምግ ባር ሁኔታ discipline conditions of
በተመሇከተ ዯንብ ሉያወጣ ይችሊሌ። Commissioners, Employees of
Commission, panellists and Organs
take part in the consultation process.
፪ የኮሚሽነሮች ምክር ቤት ይህንን አዋጅና በዙህ 2/ The Council of the Commission may
አንቀጽ ንዑስ አንቀጽ (፩) መሠረት የሚወጡ issue Directives necessary for the

፴. ስሇ ኮ ሚሽኑ ሰነ ድች 30. Documents of the Commission
፩/ ኮሚሽኑ የሥራ ጊዛው ሲያበቃ በኮሚሽኑ የሥራ 1/ The Commission shall have a

አገሌግልት የማስረከብ ኃሊፉነት አሇበት። Secrteriat of the House of Peoples'
Representatives and to the Ethiopian
Archives and Library Service for
preservation.
፪/ የኢትዮጵያ ቤተ-መዚግብትና ቤተ-መፃህፌት 2/ The Ethiopian Archives and Library
አገሌግልትም ከኮሚሽኑ የተቀበሊቸውን ሰነድች Service shall have the responsibility,
በአግባቡ አዯራጅቶ የማስቀመጥና ሇተሇያየ the received documents, to properly
ዓሊማ ማየት ና መጠቀም ሇሚፇሌጉ ሰዎች organize, preserve and produce

፴፪ . ተፇ ፃሚነት ስሇማይኖራቸው ሕጎ ች 32. Inapplicable Laws

ከዙህ አዋጅ ጋር የሚቃረኑ ማናቸውም ሕጎች No laws, in so far that they are inconsistent
በዙህ አዋጅ ውስጥ በተሸፇኑ ጉዲዩች ሊይ with this Proclamation, shall be applicable

ተፇፃሚነት አይኖራቸውም። with respect to matters covered under this

Proclamation.
፴፫. አዋጁ የሚፀናበት ጊዛ 33. Effective Date
ይህ አዋጅ በሕዜብ ተወ ካዮች ምክር ቤት This Proclamation shall enter into force
