ESTABLISHMENT OF THE FEDERAL ETHICS

WHEREAS, the Government and the

የኢትዮጵያ መንግስትና ህዝብ ሙስና እና ብልሹ
Peoples of Ethiopia recognize that corruption and

ህገ መንግስት አንቀፅ ፶፭ ንዑስ አንቀጽ (፩) መሰረት
የሚከተለው አዋጅ ታውጇል፡፡
and it has become necessary to provide in law the
relations of the Commission would have with
other institutions so as to make the Commission
adequately represent the nation at international
and continental level in the area of anticorruption
struggle ;
NOW, THEREFORE, in accordance with
Article 55(1) of The Constitution of the Federal
Democratic Republic of Ethiopia, it is hereby
proclaimed as follows.

ክፍል አንድ PART ONE

ጠቅላላ GENERAL

፩. አጭር ርዕስ
1. Short Title
ይህ አዋጅ “የፌዴራል የስነ-ምግባርና የፀረ ሙስና This Proclamation may be cited as the
ኮሚሽን ማቋቋሚያ አዋጅን ለማሻሻል የወጣ አዋጅ “Revised Federal Ethics and Anti-Corruption

ቁጥር ፩ሺ፪፻፴፮/፪ሺ፲፫’’ ተብሎ ሊጠቀስ ይችላል፡፡ Commission Proclamation No. 1236/2021”

፪. ትርጓሜ 2. Definition
የቃሉ አግባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ Unless the context requires otherwise in this

በስተቀር በዚህ አዋጅ ውስጥ፡- Proclamation:

1/ "Commission" means The Federal Ethics
፩/ “ኮሚሽን’’ ማለት የፌዴራል የሥነ-ምግባርና
and Anti-Corruption Commission;
የፀረ ሙስና ኮሚሽን ነው፣

፪/ “ኮሚሽነር ወይም ምክትል ኮሚሽነር’’ ማለት 2/ "Commissioner or Deputy commissioner"

እንደ ቅደም ተከተሉ የኮሚሽኑ ኮሚሽነር ወይም means the Commissioner or the

ምክትል ኮሚሽነር ነው፣ DeputyCommissioner of the

Commission respectively;

፫/ “የመንግስት መስሪያ ቤት’’ ማለት ሙሉ በሙሉ 3/ "Public Office" means any office the
ወይም በከፊል በመንግስት በጀት የሚተዳደር budget of which is fully or partially

እና የፌዴራል መንግስቱ ስራዎች allocated by the Government and in

which any Federal Government activity
የሚከናወኑበት ማናቸውም መስሪያ ቤት ነው፣
is performed;
፬/ “የመንግስት የልማት ድርጅት’’ ማለት 4/ "Public Enterprise" means any Public
የመንግስት ባለቤትነት ድርሻ በሙሉ ወይም Enterprise or Share Company the
በከፊል ያለበት ማንኛውም የፌዴራል ownership of which is fully or partly

፭/ “ህዝባዊ ድርጅት’’ ማለት በማንኛውም አግባብ 5/ “Public Organization” means a body that

ሐ) የዓለም አቀፍ ድርጅትን፣ እና
መ)ዕድርንና ተመሳሳይ
ሃይማኖታዊ ይዘት ያለው ማህበርን፡፡
፮/ “የመንግስት ባለስልጣን’’ ማለት ለዚህ አዋጅ
a) Religious organization;
b) Political organization/parties;
c) International organizations; and
d) Edir or other traditional or religious
ባህላዊ ወይም
association;
6/ "Public Official" for the purpose of this

ፕሬዚዳንቶችና ምክትል ፕሬዚዳንቶች፣ የኮሌጅ General and Public Prosecutors,

ዲኖችንና ምክትል ዲኖች፣ የሆስፒታል ስራ አኪያጆች Presidents and Deputy Presidents of

እና ሌሎች በተመሳሳይ በሁሉም ደረጃ የሚገኙትን Universities; Deans and Deputy Deans of

፯/ “የመንግስት ሰራተኛ’’ ማለት በዚህ አንቀፅ 7/ "Public Employee" means any person,

purpose of this proclamation shall include

of the organization as well as any
የበላይ ኃላፊ ወይም በሌላ ስልጣን በአለው
management member appointed or
አካል የተሾመ ወይም የተመደበ የስራ ኃላፊን assigned by the Board, head of the
ያካትታል፣ Organization or any other competent
body;
፲/ “የመንግስት የልማት ድርጅት ወይም የህዝባዊ 10/ "Employee of a public enterprise or

፲፩/ “የስነምግባር መከታታያ ክፍሎች” ማለት 11/ “Ethics Liaison Units” are organizations
በመንግስት መስሪያ ቤት ወይም በመንግስት that the ethics and anticorruption

ልማት ድርጅቶች ወይም በህዝባዊ ድርጅቶች commission creates under public offices,
public enterprises or public organizations
ውስጥ የስነምግባርና የፀረ ሙስና ኮሚሽን
for it to accomplish its tasks in the
ስራውንበየተቋማቱ ለማስራት የሚያደራጀቸው
respective institutions;
አደረጃጀቶች ናቸው፣

፲፪/ “የስነምግባር መከታታያ ክፍል ኃላፊ ወይም 12/ “Ethics officer or employee of ethics
ሰራተኛ” ማለት በመንግስት መስሪያ ቤት liaison unit” means any person assigned
ወይም በመንግስት ልማት ድርጅት ወይም or employed and working in public
በህዝባዊ ድርጅት ውስጥ ተመድቦ ወይም offices, public enterprises or public

ተቀጥሮ የሚሰራ ማለት ነው፣ organizations;

፲፫/ “አደረጃጀቶች” ማለት ኮሚሽኑ በመንግስት ወይም 13/ “Mass Organizations” means students’

በግል የትምህርት ተቋማት ዉስጥ መልካም ethics and anticorruption clubs the

ወይም በመንግስት መስሪያ ቤት፣ የመንግስት
organizations so as to enable it to
ልማት ድርጅት እና ህዝባዊ ድርጅት ውስጥ
enhance good ethical values and prevent
የሚፈጠሩ ሌሎች ልዩ ልዩ አደረጃጀቶች
corruption;
ናቸው፣
፲፬/ “ለህዝባዊ አገልግሎት የተሰበሰበ ሃብት” ማለት
14/ “Resource collected for public purpose”
የተወሰነ የህብረተሰብ ክፍልን ወይም
means money, property or resource that
ህብረተሰቡን በአጠቃላይ ለመርዳት ወይም
is collected with the intent to support,
ለመደገፍ ወይም ለማበረታተት ወይም assist, encourage or develop the whole
ለማልማት ታስቦ የተሰበሰበ ወይም ለዚሁ or a section of the community or
ዓላማ እንዲውል በማንኛውም መንገድ የተገኘ obtained in any way with such intent
እና በበጎ አድራጎት ድርጅት ወይም ማህበር and administered or utilized by a charity
ወይም ይህን ዓላማ ለማሳካት ተብሎ በተደራጀ or association or a committee organized
ወይም በተቋቋመ ኮሚቴ የሚተዳደር ወይም or formed for such purpose;

የሚንቀሳቀስ ገንዘብ፣ ንብረት ወይም ሃብት

ነው፣

፲፭/ “የባንክ ሂሳብ” ማለት በባንክ የተቀመጠ 15/ “Bank Account” means money, gold and
ገንዘብ፣ ወርቅ እና የመሳሰሉት ውድ እቃዎች other similar precious items deposited

፲፮. “ጠቋሚ” ማለት ሊፈፀም ነው ብሎ ያመነውን 16/ “Whistle blower” means any person who

፲፯/ “ሀገራዊ የፀረ ሙስና ፖሊሲ እና ስትራቴጂ” 17/ “National Anticorruption Policy and
Strategy” means a national document
ማለት መልካም ስነምግባርን በመገንባት፣
that indicates the level the country
ሙስናን በመከላከል እና በመዋጋት ረገድ
envisages of achieving in the short and
በአጭር እና በረጅም ጊዜ ሀገሪቱ
long term in building good ethical
ልትደርስበትየምታስበውን ደረጃ የሚያመላክት
conduct, preventing and combating
ሀገራዊ ሰነድ ነው፣

፲፰/ “ሰው’’ ማለት የተፈጥሮ ሰው ወይም በህግ 18/ "Person" means natural or juridical
የሰውነት መብት የተሰጠው አካል ነው፣ person;

፲፱/ በወንድ ፆታ የተገለጸዉ ሴትንም ይጨምራል፡ 19/ Any expression in the masculine gender
includes the feminine.

ክፍል ሁለት
PART TWO
ስለኮሚሽኑ መቋቋም፣ ስልጣንና ተግባር ESTABLISHMENT AND POWERS AND
DUTIES OF THE COMMISSION
፫. የኮሚሽኑ መቋቋም 3. Establishment of the Commission

፩/ የፌዴራል የሥነ-ምግባርና የፀረ ሙስና ኮሚሽን 1/ The Federal Ethics and Anti-Corruption
Commission (hereinafter referred to as
ከዚህ በኋላ ኮሚሽን እየተባለ የሚጠራ
"the Commission") is hereby established
የፌዴራል መንግስት መስሪያ ቤት ሆኖ
as the Federal Government office.
በአዋጅ ተቋቁሟል፣

፪/ ኮሚሽኑ ተጠሪነቱ ለህዝብ ተወካዮች ምክር ቤት 2/ The Commission shall be accountable to

ይሆናል፣ the House of Peoples Representatives.

፫/ የአዲስ አበባ እና የድሬደዋ ከተማ አስተዳደሮች 3/ The Addis Ababa and Dire Dawa City

የራሳቸውን ኮሚሽን ያቋቁማሉ፡፡ Administrations shall establish their own

ethics and Anticorruption commission.

፬. ስለ ኮሚሽኑ የአሰራር ነፃነት 4. Independence of the Commission

ኮሚሽኑ ሙስና ለመከላከል በሚያደርገው The Commission shall be free from any

፭. ዋና መስሪያ ቤት 5. Head Office
The Commission shall have its Head Office
የኮሚሽኑ ዋና መስሪያ ቤት አዲስ አበባ ይሆናል፣
in Addis Ababa.

፮. የኮሚሽኑ ዓላማዎች 6. Objectives of the Commission

ኮሚሽኑ የሚከተሉት ዓላማዎች ይኖሩታል፡- The Commission shall have the following
objectives to:
፩/ የትውልድ ስነምግባር እና የሞራል እሴቶችን 1/ Effectively enhance ethical and moral
በብቃት መገንባት፣ values of the generation;

፪/ የሙስና ወንጀልን እና ብልሹ አሰራርን 2/ Prevent corruption offences and other

መከላከል፣ improprieties;

፫/ ለፀረ ሙስና ትግሉ አጋዥ የሆነ የህዝብ ንቅናቄ 3/ Make the public become owner of the anti-

፯. የኮሚሽኑ ስልጣንና ተግባር 7. Powers and Duties of the Commission

ኮሚሽኑ የሚከተሉት ስልጣንና ተግባራት The Commission shall have the following

follow up its implementation;
፪/ በመንግስት መስሪያ ቤቶች፣ በመንግስት 2/ Provide or cause the provision of training
የልማት ድርጅቶች እና በህዝባዊ ድርጅቶች on ethics and corruption prevention to
የሚሾሙ ወይም የሚመደቡ ወይም የሚቀጠሩ officials, heads and employees
የስራ ኃላፊዎች እና ሰራተኞች ስራ appointed, assigned or employed in
ከመጀመራቸው በፊት የስ-ነምግባር እና public offices, enterprises and

የሙስና መከላከል ስልጠና እንዲወስዱ organization before engaged to the work;

ያደርጋል፣

፫/ በመንግስት መስሪያ ቤቶች፣ በመንግስት 3/ Study or cause to be studied practices and

፷. የኮሚሽኑ አቋም 8. Organization of the Commission

The commission shall have;

፱. የኮሚሽነሩ ስልጣንና ተግባር 9. Powers and Duties of the Commissioner

፩/ ኮሚሽነሩ የኮሚሽኑ የበላይ ሃላፊ በመሆን 1/ The Commissioner shall be the top official

የኮሚሽኑን ሥራዎች ያደራጃል፣ ይመራል፣ of the Commission and, as

such, shall organize, direct and manage

፲. የምክትል ኮሚሽነሩ ስልጣን እና ተግባር 10. Powers and Duties of the Deputy
Commissioner
፩/ ምክትል ኮሚሽነሩ፡- 1/ The Deputy Commissioner, shall:

a) Assist the Commissioner in planning,

11. Term of Office and Removal from Office

ጉድለትኣሳይቷልተብሎ ሲታመን፣ c) He can no longer carry out his

13. Taking of an Oath
፲፫. ቃለመሀላ ስለመፈፀም Any person shall upon Assigned or
employed in the Commission take oath that
በኮሚሽኑ የተቀጠረ ማንኛውም ሠራተኛ ለፌደራሉ
he will be faithful to the Federal Constitution
ህገ መንግስት ታማኝ በመሆን የተጣለበትን ህዝባዊ
and fulfill the demands of public trust and
አደራና ሙያዊ ሀላፊነት ለመወጣት ቃለመሀላ professional responsibility bestowed on him.
ይፈጽማል፡፡ የቃለመሀላው ዝርዝር ይዘት በደንቡ Details regarding the oath shall be specified
ይወሰናል፡፡ in the administrative regulation

14. Rights of Employees

፲፬. የኮሚሽኑ ሠራተኞች መብት
፩/ ማንኛውም የኮሚሽኑ የስራ
ሠራተኞች ደሞዝና ጥቅማጥቅም ከስራቸዉ
ልዩ ባህሪ ጋር በተያያዘ የህዝብ ተወካዮች
ምክር ቤት በሚያፀድቀው የደመወዝ ስኬል
እና ጥቅማጥቅም ዉሳኔ መሰረት ተግባራዊ
ይሆናል፡፡ ዝርዝሩ ይህን አዋጅ ለማስፈፀም
በሚወጣ ደንብ የሚወሰን ይሆናል::
1/ Any officials and employees of the
Commission is entitled to a salary and
ሃላፊዎችና
benefits in accordance with a special salary
scale and benefit scheme approved by the
House of Peoples Representatives In view of
the special nature of their work. Details shall
be specified in regulation to be issued as per
this proclamation.

፪/ የማንኛውም ሠራተኛ ደመወዝ፡- 2/ The salary of any employee may not be

attached or deducted except in accordance
with,
ሀ) በሠራተኛው ስምምነት፣
a) A written consent of the employee;
ለ) በፍርድ ቤት ትእዛዝ፣
b) A court order; or
ሐ) በህግ በተደነገገው መሠረት፤
ካልሆነ በስተቀር ሊያዝ ወይም ሊቆረጥ c) Provisions of the law.
አይችልም፡፡

፫/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪)(ለ) ወይም(ሐ) 3/ The amount deductible in accordance with
መሠረት ከሠራተኛ ደመወዝ በየወሩ Sub Article (2) (b) or (c) of this Article
የሚቆረጠው ከደመወዙ አንድ ሶስተኛ may not exceed one third of the salary of

4/ Any permanent employee of the

፬/ ማንኛውም የኮሚሽኑ ቋሚ ሠራተኛ በጡረታ
Commission is entitled to a pension in

accordance with the Pension law.

፭/ የኮሚሽኑ ሠራተኛ፡- 5/ Any employee of the Commission shall:

ሀ) ሥራውን በተገቢው መንገድ በመወጣት
a) Be provided with attorney service at

መ) ከሥራው ጋር በተያያዘ ሁኔታ d) Be entitled to benefits provided in

፲፭. ከግብር ነፃ ስለመሆን 15. Exemption from Tax

በዚህ አዋጅ በአንቀፅ ፲፬ በንዑስ አንቀፅ Any compensation to be made pursuant to

(፭)(መ) መሠረት የሚከፈል የጉዳት ካሳ ከፍያ Article 14 Sub-Article (5)(d) of this
ከግብር ነፃ ይሆናል፡፡ እንዲሁም በእዳ ሊከበር Proclamation shall be exempt from taxation
ወይም በማቻቻያነት ሊቀነስ ወይም ባለመብቱ and may not be attached, deducted by way of

፲፮. ሰራተኛን ከሥራ አግዶ ስለማቆየት 16. Suspension from Duty

1/ An employee of the Commission may be

suspended from duty by withholding his

salary for a period not exceeding one

month if that course of action is necessary
ከሥራና ደመወዝ አግዶ ለማቆየት ይቻላል፣
for the smooth execution of the work;

፪/ በዚህ አንቀፅ ንዑስ አንቀፅ (፩) የተደነገገው 2/ Notwithstanding the provisions of Sub

month if he is formally charged with a

which his dismissal is to be expected if it

፲፯. ስለይርጋ ጊዜ 17. Period of Limitation

፩/ ቀላል የዲሲኘሊን ቅጣት የሚያስከትል ጥፋት 1/ Disciplinary measure may not be taken

የፈፀመ የኮሚሽኑ ሠራተኛ የምርመራውን against an employee of the Commission

who has committed an offense entailing
ጊዜ ሳይጨምር የፈፀመው ጥፋት ከታወቀበት
simple disciplinary penalty unless such
ቀን ጀምሮ እስከ ስድስት ወር እርምጃ
measure is taken within six months,
ካልተወሰደበትበዲሲኘሊን ተጠያቂ አይሆንም፣
excluding the time required for
investigation, from the time the breach of
discipline is known;

፪/ ከባድ የዲሲኘሊን ቅጣት የሚያስከትል ጥፋት 2/ No disciplinary charge shall be brought

የፈፀመ የኮሚሽኑ ሠራተኛ የፈጸመው ጥፋት against an employee who has committed
an offense entailing rigorous disciplinary
ከታወቀበት ቀን ጀምሮ በአንድ አመት ጊዜ
penalty unless such disciplinary charge is
ውስጥ በጥፋቱ ካልተከሰሰ በዲሲኘሊን
brought within a year from the time the

commission of the offense is known;

፫/ በዚህ አንቀፅ ንዑስ አንቀጽ (፩) ወይም (፪)

3/ The Official who has failed to take the

፩/ ኮሚሽኑ የተሟሉ እና ትክክለኛ የሂሳብ 1/ The Commission shall keep complete and

ስለሚኖረዉ ግንኙነት
፳. የስነ-ምግባር መከታታያ የስራ ክፍል ስለማደራጀት 20. Establishment of Ethics and Anti-
Corruption Liaison Offices
፩/ ኮሚሽኑ በየደረጃው በሚገኙ በመንግሥት
1/ The Commission shall establish Ethics and

5/ The Commission shall cause the

፫/ የክልል እና የከተማ አስተዳደር የስነምግባርና 3/ The City and Regional Ethics and Anti-
የፀረ ሙስና ኮሚሽኖች በየአካባቢያቸው corruption commissions shall submit

ስላለው የፀረ ሙስና እንቅስቃሴ የሚመለከቱ statistical data and periodic report
regarding the state of anti-corruption
ሪፖርቶችን እና ስታስቲካዊ መረጃዎችን
activities in their respective City or
በየጊዜው ለኮሚሽኑ ይሰጣሉ፡፡
Region to the Commission.

ክፍል አራት PART FOUR

ልዩ ልዩ ድንጋጌዎች MISCELLANEOUS PROVISIONS

፳፪. የመተባበበር ግዴታ 22. Duty to Cooperate

Any person is duty bound to cooperate
ማንኛዉም ሰዉ ወይም አካል ኮሚሽኑ በዚህ
whenever cooperation and assistance is

አፈጻጸም ደንብ ሊያወጣ ይችላል፡፡ may issue Regulations for the
implementation of this Proclamation;

፪/ ኮሚሽኑ ይህንን አዋጅና በዚህ አዋጅ መሠረት 2/ The Commission may issue Directives for
የሚወጣውን ደንብ ለማስፈጸም መመሪያ the implementation of this Proclamation
ሊያወጣ ይችላል፡፡ and the Regulations issued under this
Proclamation.

፳፬. የተሻሩና ተፈጻሚነት ስለማይኖራቸው ህጐች 24. Repealed and Inapplicable Laws
1/ Provisions provided under The Revised
፩/ በፌዴራል የሥነ-ምግባርና የፀረ ሙስና
Federal Ethics and Anti-Corruption
ኮሚሽን ማቋቋሚያ አዋጅ ቁጥር ፬፻፴፫/፪ሺ፭ Commission Establishment Proclamation
እና በማሻሻያ አዋጅ ቁጥር ፰፻፹፫/፪ሺ፯ ላይ No.433/2005 and Amendment
ተደንግገዉ የነበሩና በዚህ አዋጅ የተሸፈኑ Proclamation No. 883/2015 covered by
ድንጋጌዎች በዚህ አዋጅ ተሽረዋል፡፡ this Proclamation are hereby repealed;

፪/ ከዚህ አዋጅ ጋር የሚቃረኑ ማናቸውም ሌሎች 2/ All laws which are inconsistent with this

ህጐች በዚህ አዋጅ ውስጥ በተሸፈኑ ጉዳዮች Proclamation shall not apply on matters

ይህ አዋጅ በፌዴራል ነጋሪት ጋዜጣ ታትሞ
